It all started with a at home business opportunity with the Economic Freedom Corp (EFC) on Nov. 24, 2010.  I paid $495 for the financial website kit, with a $24.95 monthly website fee.  I talked to my marketing advisor several times about the business and the amount of money I would have to pay to get started.  He told me that they finance the amount within his company and that the money would not be charged to my credit card. I asked several times to make sure that is would not be charged to my credit card and every time I was told that it would not. 

On Nov. 30, 2010 I agreed to 3 charges of $1500, $7000 and $7500 for my "purchased leads" to get my business started quickly. I was told that a lap top with my 18,000 leads would be coming in the mail within 5 business days. I was told that I would most likely earn back all this money with in 3 months. 

On Dec. 1, 2010 the above charges were charged to my credit card, I called my marketing advisor and told him I did not wish to continue with this company, and he told me it was to late that the charges were already processed and that there was nothing I could do. He told me that I would have to try the business for 3 month, and if I do not earn any commissions that by law they would have to refund me the $16,000.

At this point I thought I had no choice but to continue, he told me to relax for the next couple days until I get my mini lap top so I could start working. I waited 12 days and tried to contact my marketing advisor 4 times and never got a call back.

At that point I contacted my credit card company to see if there were any options I had with them. I opened a dispute with the credit card company to work on getting a refund.  My credit card company told me to formally cancel everything with the company, so I sent in a fax to EFC on Dec. 20th to cancel my employment and the website.

I received a call from EFCs disputes and they said that they have 30 days from when I signed the contract to get the leads out to me by mail or on my website. As of  Jan. 3, 2011 (pasted the 30 days after I signed the contract and supposed to get the leads) I had still not received any leads by mail or on my website.

I called the lady in the disputes department and left a message stating that I still do not have the lead and that I would like to cancel any involvement with this company and would like a refund.  She never called me back. My credit card company removed the charges on the account pending the dispute.

 On Feb. 2, 2011 another person form the disputed department at EFC. called and said that they are sending out the laptop to me, I told him i did not want it and I wanted my money back. He told me the company does not give refund.

Every time I talk to someone at EFC I am told something different. Per my contract and the payment invoices "If an order is placed and the product is not delivered, a full refund will be issued" and "We will complete lead fulfillment within 30 days." They did not fulfill their end of the agreement and now refuse to issue a refund.

Sub Prime thinking

CPS is a Sub-Prime lender, and as you have noted you had bad credit so that is why you are with them.  Now, while you don't mention it I would be willing to bet that the reason they are contacting you is because you are late on your payments.  So if any of the "threats" that they would reposess your car and still hold you responsible for the balance owed..those were not threats.  They were real actions they can take, and the same actions that any other lender would take if you don't make your payments.

So your "Sub-Prime thinking" leads you to what you think is a smart idea and that you will get one over on them.  That is to file Bankruptcy.  Do you really think that a Bankruptcy is going to make your credit better?  Do you really think that they care?  All they will do is write off the loss and not even look back.  Even if you qualify for Bankruptcy it is not free, it is going to cost you several hundred to a couple thousand dollars to file.  Then even after you file the court may still force you to repay part of your debt.

I just wanted to add that I have filed a complaint with the Better Business Bureau of Arizona and with the Attorney Generals Office of Arizona.
