INTRODUCTION

Ripoff Report was forced to file a Motion to Disqualify Ben Smith from his lawsuit against Ripoff Report. This just weeks after Ben Smith filed a frivolous 119 page Warrant Application against the mother of Tracy Richer who, in my opinion was falsely convicted.  You can read the Brief in Support of that Motion, it was filed in Sac County.  Smith dropped his lawsuit at the 11th hour, just before the Judge would have ruled to disqualify him.  This deceptive move to use and abuse the court system was right out of Michael Roberts of Rexxfield playbook.  Michael Roberts Rexxfield has a history of filing lawsuits in order to put false allegations into public records and use them as press releases, and abuses the court process of gathering information, and then dismisses the meritles suits. One other thing, I am unaware of any case where Michael Roberts Rexxfield ever served his lawsuits on anyone.  If he did serve someone, I think it was most likely for harassment, most of his dozens or more lawsuits never went forward. This is the same tactic that Michael Robert's stooge, for Sac County Attorney / Prosecutor Ben Smith used to spread false allegations and to use his subpoena power as a prosecutor to get personal and confidential information that should never have been released to prosecutor Smith or the public.  

Background / who’s who:

Michael Roberts Rexxfield is the husband of Tracy Richter Roberts who was convicted 10 years after she was hailed a hero for defending her children when an intruder came in the middle of the night trying to choke her to death, then shooting the intruder dead. The children reported 2 other men were seen running from the home.

Roberts also goes by the name / business name Rexxfield. What the article does not talk about is why Ben Smith took all of Tracy’s money. Tracy Richter was  in the middle of an appeal. It looks like to me that Ben Smith wanted to cut off all communications with her attorney and family members trying to help. Smith concocted a host of stories to justify a judge to give him subpoenas to get Tracy’s mothers computers to all the personal emails from ED Magedson’s personal account, all of Ripoff Reports bank records, phone records and then, distributing checks, checking account numbers, signatures, personal emails, attorney client emails’ and other sensitive information.  Prosecutors like this need to be stopped. Laws need to be changed.

Don’t let the term “warrant” confuse you. 

It was a search warrant, not a warrant for anyone’s arrest.  And the search warrant was not for the search of Ed Magedson’s property, it was for the search of Tracey Richter’s mother’s property.  There is no criminal case against me, ED Magedson, no indictment against ED Magedson and no substance to the propaganda that they have spread.  The statements about Ed Magedson and Ripoff Report in the affidavit submitted with the search warrant were included as a publicity stunt.  

The rambling,  119-page affidavit, boils down to an unfounded claim that Magedson featured the posts on Ripoff Report about the Tracy Richter trial in order to harass and defame the witnesses who testified in the Richter trial.  I,  Ed Magedson categorically denies those allegations.  While I, ED Magedson did not write the posts,  I featured them because of the importance of exposing prosecutorial misconduct allegations, and because of Michael Roberts Rexxfield past involvement in hacking Ripoff Report and attempting to extort Ripoff Report information about the hack Roberts admitted selling to businesses. Did Roberts return those businesses their money? Michael Roberts of Rexxfield hack purchase.   

The unfounded allegations of criminal charges are repeated over and over on websites, blogs, and social media so that those who have been accused of wrongdoing on Ripoff Report can respond by smearing the source instead of addressing the actual allegations against them.

Ben Smith Sac County Prosecutor – prosecutorial misconduct  

What’s really going on in Sac County Iowa?

You have heard the hype and read the spin, now here is the truth. 

A small group of shady characters have spent hundreds if not thousands of hours publicizing and mis-characterizing a search warrant issued by a Sac County Iowa Prosecutor Ben Smith that was used to seize the computers of the mother of a woman convicted by that same prosecutor “Ben Smith” of murdering Dustin Wehde.  

The search warrant application was accompanied by a 119-page affidavit (usually no longer than 3 to 5 pages) that included unsubstantiated allegations and false claims about Ed Magedson and Ripoff Report. Ben Smith did this self-serving work using tax payer’s / Sac County Iowa money in a deceptive and cunning way so that his cohorts could falsely claim that I, Ed Magedson had committed crimes. It amounts to abuse of process and prosecutorial misconduct, including things in my opinion that would likely be or at least ought to be criminal .. Ben Smith to abuse his power this way is outrageous and Smith should be disbarred and severely punished. The good people of Sac County trust this man because he is a public elected official / lawyer, a prosecutor,  they don't expect him to lie - so, when he does, it is an abuse of power. An egregious abuse of power and needs to be punished.  

Back in 2011 Ben Smith successfully prosecuted Tracey Richter for Wehde’s murder that had happened about 10 years prior.  Richter’s supporters posted stories on various websites including Ripoff Report criticizing Sac County Prosecutor Ben Smith, the case, and the conviction.  Michael Roberts and Sac County Prosecutor Ben Smith were successful in getting other opinions and evidence removed from websites and other places on the Internet like Scribd and the Wayback Machine, but not Ripoff Report.  Ripoff Report is THE only permanent record, with the exception of specific word redactions.




Tracy Richter and the children she was trying to protect during the home invasion. The children stated to police that there were also 2 other men running from the scene the night of the murder.  Michael Roberts has removed the children from the USA with the help of Iowa Tax Payers, see letter Ben Smith sent to the Australian Consulate.

Ben Smith then joined forces with John F Brewington AKA Paladin PI (dishonest and criminal private investigator reported on Ripoff Report since 2007), and Michael Roberts AKA  Rexxfield (the Husband of Tracy Richter at the time of the murder who hacked Ripoff Report and attempted extortion to Ripoff Report attorneys ).

John F Brewington – Paladin PI / AKA John Brewer

John Brewington Paladin PI who touts himself as a Paladin is a convicted felon  and to his own admission under oath, he has been obsessed with Ripoff Report for many years.  Read hear about attempted extortion to Ripoff Report’s in-house council. In other incidents in the past, a federal judge found that that John Brewington had assisted convicted felon William Stanley to harass and intimidate people who worked with Ripoff Report, in an attempt to damage or shut down the website, and his activities apparently continue.  Ripoff Report was paid money in an out of court settlement with Brewington. The stories on Ripoff Report included compelling evidence that Richter may have been telling the truth about Wehde being an unwelcome invader in her home. 

Michael Roberts was married to Tracey Richter who murdered Dustin Whede during a home invasion. Michael Roberts of Rexxfield was involved in hacking the Ripoff Report website, selling Ripoff Report removal services based on the hack and then attempting to sell the HACK information to Ripoff Report ((attempted extortion)) about the hack for 105,000 euros.  (about $165,000 US Dollars at the time).  More,  Proof Roberts purchased the hack.  

It seem like Ben Smith avoided telling anyone about the failed POLICE polygraph taken after the murder.  Investigators determined that Roberts was 99% deceptive with all relevant questions about the murder, questions like whether he arranged for Wehde to be in his home the night of the shooting.  Ten years after the murder when the trial took place, it has been reported that the only polygraphs talked about were the polygraphs that Michael Roberts paid for.

See this Sac County Iowa Document: “NOTICE OF CHILD ABUSE ASSESSMENT: Founded”  against Michael Roberts …this was a document that Tracy Richter received as the Victim ..  the findings was FOUNDED. And Confirmed against her husband Michael Roberts. I have to ask Sac County Prosecutor Ben Smith, didn’t any of this evidence come into consideration before prosecuting Tracy Richter? This evidence came thru Darren Meade, also a victim of Ben Smith’s actions. Now Roberts is claiming foul. (NOTE: the postings written by Darren Meade are the work of Darren Meade. Ripoff Report had no way of knowing what parts are true or false when Meade created these posting. Ripoff Report is in the middle of investigating Ben Smiths allegations that that the Reports contained false statements. Michael Roberts and his cohorts don’t want anyone to see evidence supporting negative reports about them.  They have worked hard to get postings and documents taken down from websites like Scribd, so that you can’t see documents that put them in a negative light.

Smith, Brewington and Roberts have all been the subject of negative reports on Ripoff Report and all have a common purpose to discredit this website and myself, ED Magedson.  Roberts and, Brewington both used Ripoff Report many times, years prior to ED Magedson knowing who they were, possibly starting around 2007 or before.

The unfounded allegations of criminal charges myself ED Magedson are repeated over and over on websites, blogs, and social media so that those who have been accused of wrongdoing on Ripoff Report can respond by smearing the source instead of addressing the actual allegations against them.
