I ordered Ed Hardy eyeglass frames from eMalish www.decormyeyes.com. I received JC Cavelli sunglasses, far from what I actually ordered. I contacted the customer dervice dept who wanted me to mail back the merchandise at my expense. I asked to speak to the manager. I received a phone call back and the male stated he would send me a shipping label so I could mail the sunglasses to the correct buyer.

At that time I requested that my order be cancelled and a refund given because the manager stated he did not know where my frames were and that he could not guarantee I would receive the frames in time for my eye exam. He agreed to refund me if I mailed the sunglasses to the buyer in Ohio. UPS picked up the sunglasses as per Tony Russo at eMalish request and I expected to be refunded my full purchase price as promised on the phone and via email.

I also contacted PayPal and my Visa about my refund request.

After I informed the seller, eMalish, that the wrong merchandise was shipped to his buyer in Ohio as per his request (I have emails to prove it!) he proceeded to tell me that he was NOT going to refund me as promised and that he was going to ship the Ed Hardy frames even though I had requested that he not ship and just refund my $189.99. He stated he did not have the frames in hand but that he told his distributor to ship them and he was 'not going to be stuck with the frames".

This is NOT what I had asked him to do and NOT what he agreed to do on the phone and in his emails. When I told him I had already contacted my credit card for a refund due to non-shipment He preceded to send multiple harrassing emails and told me that he is shipping the frames out so that he could get his 20% restocking fee. I have multiple emails showing I requested a refund BEFORE he had the frames in hand, emails of his harrassment and proof that I did send the wrong merchandise the his buyer in Ohio as Tony Russo requested.

He even proceeded to send me an email stating I cannot prove I mailed the wrong merchandise back to him, thank goodness I kept all the emails asking me to ship to his buyer in Ohio and tracking information that Tony Russo himself supplied!!

He refuses to refund my $189.99 and states he will take his time IF he ever does. He stated IF he refunds me he will keep 20% even though all of this was his mistake and that I actually requested he NOT SEND THEM AT ALL. He has also sent me a harrassing email showing me that he did an internet search of my name where he
copy/pasted my professional association and work address...he wrote on the email \"is this you\" I still have the email in my inbox. Very frightening that he
is now searchinng for my personal information on the web.

I have kept all of his emails and my email responses as proof of his dishonesty, bad customer service and fraud. He has harrssed me via emails and by phone. This company will not ship what you have ordered and will try keep your money. Do not buy from them not worth the money, his bad customer service, his foul mouth and cheap goods. Beleive me when I opened the package not only was it NOT what I ordered but the sunglasses he did send were of cheap and bad quality.

How do you mix up prescription eyeglass frames and cheap sunglasses? Obviously he does not have anything in stock and uses a drop ship company to do his business. He has NO idea what he is doing. I think his web site is the drop sites web site with his name. Who knows.

I have reported him to Consumer Affairs, the Consumer Protection Agency, the NYS Consumer Affairs and the Better Business Bureau. Beleive me, I really do not have time to do this but this company is such a rip off I took the time so that it doesn't happen to anyone else.

Don't Buy From eMalish www.decormyeyes.com I can verify all my statements above with all of the emails I have saved.

I was able to get my money back from Visa after a thourough investigation and months later. I have reported Tony Russo www.decormyeyes.com to the New York BBB and the New York State Consumer Protection Agency. I am planning on reporting him to the New York Attorney general too because after I got my refund he sent me a threatening letter. I will quote it "you are a pathetic human being" and "You will pay!!" He also called me three times at one o'clock in the morning on my cell phone and I can prove it. I have records showing the harrassing phone calls.
Don't do business with this guy. He has poor business practices and is a definite rip-off. BTW, I never got the Ed Hardy eyeglass frames but he still wanted to keep my money!
