EMC keeps reporting that I am 1 month behind on my payments.

I pulled up my account on their website and pointed out to them that my records showed no deficiency.

The lady told me that they had applied part of the September 2004 payment to a payment that had been deferred back in July, 2002.

They had granted me a one month deferral that was to be due "upon payoff, acceleration or maturity of the loan, whichever comes first".

She said that this mistake would be corrected. I had spoken to her on 2-16-05. On 3-2-05, it still had not been corrected but the lady couldn't tell me why but would see that correction was made.

EMC is evil. Quarenteed to have you in default- foreclosing & stealing your home-EVEN IF YOU MAKE ALL PAYMENTS. They will split your payments to apply to ficticious charges. They will mark on time payments late INTENTIONALLY.

Eventually we all catch on & then they try to put you on a forebearance plan to make up for the behind payments. They will demand DOUBLE payments. But you will find that you will never catch up. NEVER. I have tried for 3 years. I owe them more than when we started.

If you have EMC as a servicer & they haven't started foreclosure YET---then RUN-RUN-RUN- as fast as you can. Refinance- sell--do anything you can before they steal your home. They will. They make Fairbanks seem like p***y cats.

I know--- I lost my home after making 3 years of double payments. I proved in court that all my payments were made. They refused to explain where the extra amounts went to. I won---but still lost the house. With no regulating body to enforce the courts wishes- EMC is allowed to keep doing what they were doing.

Even if you try Bankruptcy---they have a plan that dismisses any BK plans. It will not work. They completely ignore any laws, judgements or any concept of legal. They feel they are beyond the law & will stop at nothing to steal your home. They will sell your home right out from under you- without your knowledge.

They will not correct any mistakes. Because they aren't mistakes. They are intentional evil ways to steal your home. Don't trust them. RUN.

GET A LAWYER NOW The best you could do there is get a judgement

I am currently dealing with EMC I have made all of my payments, I talk to them every month, however they have me in forclosure for non payment for 2 yrs.

Stop messing with them get a lawyer to contact them, report them to the attorney general and anyone else you can think of. From this point on when making a payment ( this advice came from an attorney) make all payments in the form of a certified check, send all payments after making copies to co.

with return receipt, this means that they have to sign for it. now you have proof the payment was in their hands on time. ask for payment history every 3-6 months,ask them to show where and how each payment was distributed, when sending extra money for princiable do not send with normal payment, be very specific as to what the addtional funds are for. get names, dept. and i.d. numbers for all people you speak to regarding your loan, as well as dates and times. these co.'s will try to change the call log for their benefit.

AT THIS TIME YOU NEED A ATTORNEY TO CONTACT THEM, THIS IS ONLY THE BEGINING! go to the clerk of courts to check and The best you could do there is get a judgement see if there has been anything filed on you or your property, as they will say you were notified and show that you are on the service list, but they do not send you anything. BEWARE THIS IS A BATTLE AND YOUR ARE NOT WINNING YET!!!

DO NOT BELIEVE ALL THEY TELL YOU!!! DO NOT LET THIS GO THEY ARE ADDING FEES YOU DO NOT KNOW ABOUT! ASK FOR A NEW ESCROW ACCOUNTING FOR YOUR MORTGAGE, THEY MAY BE MAKING UP SHORTAGES THEY ARE CREATING FROM THAT ACCOUNT.

AND THEN THEY FILE FORCLOSURE FOR ESCROW SHORTAGES!! I know what I am talking about I am going through this with EMC as well as another well known mortgaage co. Good Luck also look for class action notices, whatever, regarding them, you are not alone!!

Same thing is happening to me

I read your post and I feel for you, I really do. I have the same issue with EMC for months now. I do not see a resolve either after numerous phone calls with the EMC collections department and Customer Service people, they still state I am behind but mine is as they say 60 days behind. I have made them a total of 14 payments for the year of 2004 and I get the same run around I always do when I call. They pass me fictisous names of supervisors I am suposedly talking to and I call back to speak with them and they are not available or they pass me off to someone else. I also tried to refinance my house a few weeks ago and they gave the same line to that bank and of course told them I was 60 days behind. I even hired a broker, freind of my family and he looked into the problem and told me if there was anything he could do he would try. he also stated they are screwing you and you have to get away from them if you can. I hope the best for you in resolving this matter and If I do come up with something I will post.
