This company uses TV and radio advertising offering customers a "Free" 30 day product sample, for the cost of "shipping" only. In order to get the free sample, the consumer must give out a credit card number. The company send the "Free" sample.
The scam begins, when the very next month the consumer finds another 30 day product sample in their mail box! Surprise! Another check reveals the company has charged the product to the credit card number given for the "Free" shipping.
When the consumer calls Berkeley Customer Service Department, if they are so lucky as to not get a busy signal, they are informed that there is a "legal contract" printed on the "Free" sample container and that this "contract" empowers them to keep sending and billing for product for an entire year!
The wording of this fake contract is written in print not readable with the naked eye. I had to use a 10X magnifying glass to read it. The wording has been printed over a blue background that is designed as a part of the label logo. The wording appears as a design element, not words. No one would ever dream that words were there is they weren't looking for them.
It is truly amazing that this firm is allowed to remain in business! I've reported them to the FCC and the Cincinnati BBB. If you've had a similar experience, please report them also!
This is how to get your money back:
1. Send back any unordered product via the post office. They will give you a receipt.
2. Dispute the charge with your credit card company after it appears on your bill.
3. If you're really worried, report your card as having been stolen (which in actuality it has).
4. Send a registered letter to Berkeley demanding a refund and tell them you are reporting them to the FCC and the BBB. Don't call their Customer Service Department ... trust me they won't help you, it's all just a giant scam.
5. File a report with www.bigclassaction.com. They have an entire enzyte section.
