Beware of a anything that sounds too good to be true! That exactly what EPenzio and its affiliates are. Like other people who got rip-off by these companies, here is my story.

On March 26, 2002, I attended a seminar, called Web Success 2002. It was held by Bring-It-Home (BIH), Epenzio and Small Business Benefit Association (SBBA).

I came because on its brochure, it told stories from some people who participate in BIH and Epenzio offers (not sure whether these people are real or just their make-up effort). A representative from BIH was there promoting internet business opportunities. He described a business where you could make money while you sleep.

He showed us several web sites that looked very good and professional. He said that it would be very easy to build such a web site using their tools. He also showed us several useful tools that should be used if we would like to use our sites effectively (eg: Web Stat).

At the end of the seminar I signed up for web account($99.00 sign up fee, $19.95 monthly hosting fee) and merchant account ($89.95 monthly payment for 3 years) because I had got a would-be customer that wanted to buy my products if I was able to receive her credit card for payment.

She (this customer) also said that she would like to do the business over and over again. That meant a continuous business for me. I didn't want to lose this chance. She gave me a 3-week time frame to get myself prepared to be able to receive credit card payment.

Everyone else also signed up for both accounts but nobody had a chance to read everything on the papers that had been signed, including me. It was almost 11:00 PM. I think they made the seminar last this long on purpose, so by the time all of us signed up it was already very late night.

They did say that I have 3 days to decide if I wanted to keep my merchant account or cancel it. But they didn't day about this to my web account (it has the same term) until I found out recently.

I came again two days later for the workshop. It was handled by completely different people, not like what they said at the first seminar. I started to feel disappointed.

They did explain the ways the internet businesses should promote their products but only in general. The rest of the time was used to promote their own business. They were selling web spaces and all supports (3 levels were offered, $3000, $4000, and $5000) at the end of the workshop.

Most people left after the workshop was finished. Only several people stayed to discuss about selling web space packages. I stayed for a while to see if they were going to buy 1 of those packages or not.

After 15 minutes I left because nobody bought anything yet and it was already 11:00 PM.

On April 3, 2002, I talked with epenzio customer service (CS) to ask about my merchant account. The CS told me that it wasn't ready yet.

I started to wonder why it took so long to process it. BTW, the first week of April was a second week of 3-week time frame that I got from my would-be customer. I also called to check the status of my web account. They said that I had to input the passkey that I got from the seminar to get access to my web account. I figured that my priority was the merchant account first.

Finally another CS called me to ask for my void check. I faxed my void check on 4/9/02. They said that this was necessary for me in order to receive the credit card and check payments, because they will be deposited directly into my checking account.

What I didn't know at all was that my checking account number was circulated to their affiliates too, so they could withdraw the money directly from my checking account instead of charging to my credit card.

They will debit the monthly payment of the merchant account (will be executed by Monterey Financial, maybe their affiliate too.

I received a letter from this company), the gateway access fee (by Pacific Web, their affiliate), the minimum discount & statement fees (from their bank, Bridgeview bank & trust) of the merchant account directly from my bank checking account.

I found out about this recently. I was very upset and disappointed with their business manner.

Then, between April 8, 2002 and April 19, 2002, I talked with the manager of marketing from BIH. He said that they contacted all people who attended the seminar to ask if they wanted to sell the web space accounts.

He said that this program was customized to suit a particular person's strength and weakness that would be chosen if he/she was qualified for that. He asked if I have a good credit history for this program and I have. He said that he would gave my case to his director to be reviewed and compared with other people.

I asked him how much investment was needed for this program. He didn't want to tell me. He just said that it depended on the type of customization of the program (I guess this is a lie). He said that don't take it personally if his director didn't choose me. Finally I and my wife talk to his director.

After several minutes my wife decided to stop discussing with him and let me continue without her. She got angry because he didn't respect her at all and he was very pushy. We then continued talking although I was getting upset with him, but I wanted to know more.

He began telling me that my web site would be built by his professional web development team so I can start selling my products immediately on the web and it will look professional for people so they would like to subcribe to web space that I'm selling.

He also told me that after my web site is built, it would be upgraded with all the whistles and bells of web site utilities, so I can use it very effectively and efficiently. He said that the package would cost me $8510.

I was shocked because it was so expensive, much more expensive than what was offered at workshop. He said that it was equipped with 1 year unlimited coaching and additional necessary help should I have more questions after 1 year. I felt confused for a moment.

I finally signed up and my creadit cards were charged for this amount. After hang up the phone, I started thinking why the director decided to choose me directly instead of taking time to review first.

I also thought why he said that when the web site was ready, it would be upgraded with more tools. The speaker at the seminar told all of us that the software that we will use has all these bells and whistles. I was getting courious because I had to pay more for them.

The following week (4/15/02 - 4/19/02) we finally cancelled this program. The director at first threatened me to give this case to their legal department because he said that I couldn't retreat anymore once I signed up (which sounds very ridiculous).

Hearing that my wife became very angry, threatened to get this case to a lawyer too, and we disputed the charge thru our credit cards company. For some reasons, he finally decided to let me go. The point that I'm trying to say is be very careful with this kind of marketing especially from this company. It looks like they just want your money.

By this week I already lost my would-be customer because I still couldn't receive credit card payment. She (my would-be customer) told me that her clients had been expecting the products and that forced her to find other sellers that have the same products like I do.

And I also lost the opportunity to have a continuous business with her. My merchant account package (its manual book of how to use it) arrived on April 19, 2002. It was useless because I had lost my would-be client a week ago.

I first considered myself very lucky to get a buyer like this in this kind of economic condition. Now I'm totally broke and I can't pay this monthly merchant account fee.

I wrote a first letter to epenzio cancellation committee and they already replied my letter with a refusal, saying that they didn't see any reason why I should cancel my merchant account.

Apparently they also think that I want to cancel my web account too because they forwarded my letter to BIH cancellation committee.

They suggested me to find a buyer who wants to buy my merchant account, call them with the new buyer to have the transfer process done, and I pay $50 transfer fee.

I had contacted the Bridgeview Bank to ask them to stop charging min. discount and statement fees, and Pacific Web to ask them to stop charging gateway access fee.

Now I'm wondering if it is possible to sell a merchant account or it is just their excuse to keep me away from thinking about canceling it? I had already written a second letter explaining in detail my real situation. I hope this gets their attention.

I'm thinking of closing my local bank checking account to stop their debit effort next week for the 1st monthly debit of the merchant account.

I think this will get their attention more and probably make them angry because thay can't retrieve the money from me. If this still doesn't work, anyone out there can help me?

BTW, I'm unemployed now so going to a lawyer is an impossible option to me at this time.

The Truth about Russ's Accounts

AUTHOR: Brad Crawford - (U.S.A.)

POSTED: Thursday, December 19, 2002

I am sorry that Russ feels that there is a problem with the Website package that he purchased from Bring it Home or the PenzPay Internet Payment Gateway that he purchased from ePenzio that would have caused him to have to seek a remedy by this means. I have read Russs complaint, reviewed all of the contracts that Russ signed, reviewed all of the notes in the Bring it Home database and the ePenzio database concerning Russs accounts, and I found the following:

1.. Russ purchased his Website and applied for the financing package for his PenzPay Internet Payment Gateway on March 26, 2002. The contracts that Russ signed on March 26, 2002 required Russ to sign in 8 different places. Russ was given copies of all of the contracts that he signed, so that he could review them at his leisure.

2.. Russ had until March 26, 2002 at midnight to cancel him applications and eliminate all of his obligations concerning these contracts. Neither Bring it Home nor ePenzio received a cancellation notice from Russ during this time.

3.. Russ received the Website that he purchased at the time of purchase.

4.. On April 3, 2002, Russ called and left a voice mail message for ePenzio stating that he wished to make his payments with a Credit Card instead of from his checking account. Russ requested that an ePenzio representative call him back to confirm that we had received this message.

5.. There was some information missing from the ePenzio contracts that Russ signed, so on April 4, 2002 at 2:55 PM, an ePenzio representative spoke with Russ on the phone. The representative confirmed that we had received his phone message, and then informed Russ that ePenzio still needed a voided check form him. The ePenzio agent also confirmed the other necessary information. Russ to the ePenzio representative that he would send the voided check on Monday April 8, 2002.

6.. By the afternoon of April 8, 2002, ePenzio had not received the voided check, so an ePenzio representative called and spoke with Russ again. Russ stated that he forgot about the check, but that he would send it immediately.

7.. On April 9, 2002, ePenzio received the voided check.

8.. On April 17, 2002, Russ called ePenzio to check on the status of his account setup.

9.. The package that contained the Login ID# and Password for Russs PenzPay Internet Payment Gateway transaction system was delivered to Russ by FedEx on
April 19, 2002. Upon receipt of this package, Russ had everything necessary to operate his PenzPay Transaction system.

10.. On April 24, 2002, only 5 days after Russ received his PenzPay package, and only 7 days after Russ called to check on the status of his account, Russ contacted ePenzio and inquired about the possibility of canceling his account. Unfortunately, at the time that Russ received his package, ePenzio had spent a large amount of money in order to fulfill its obligations concerning the contracts that were signed with Russ on March 26, 2002.

11.. It does not appear that Russ EVER called Bring it Home requesting help in designing his Website.

Based on this information, I see no reason why ePenzio should be compelled to cancel the financing package for Russ. I feel that Bring it Home and ePenzio have lived up to all of the terms of the contracts that Russ signed on March 26, 2002. Bring it Home stands ready, willing and able to assist Russ with his Website design at any time. ePenzio has delivered to Russ exactly what he contracted for. It appears to me that Russ has made no effort to make the products that he purchased work.

I do have one question for Russ. If he was in such a hurry to get his PenzPay account set up, why did he wait 2 weeks to fax his voided check? He was given a form on March 26, 2002 to use to fax this check in. He was obviously aware that he needed to send in the voided check, because he called on April 3, 2002 to state that he wanted to use his Credit Card to make payments instead of his checking account. He tries to make it seem like it was ePenzios fault that it took so long to setup his account, thus supposedly causing him to loose his potential customer, when it was actually his forgetfulness and lack of action that caused the delay.

Fortunately, if Russ has determined that he no longer wishes to develop his Website and use his Internet Payment Gateway, there are several things that Russ can do to lessen or eliminate his costs. He can call Bridgeview Bank at 1-877-877-8164 and cancel the monthly service for his Merchant Account and call ePenzio at 1-800-494-1563 and cancel his gateway access to his PenzPay Internet Payment Gateway. He may also call Pacific WebWorks at 801-578-9020 and cancel the monthly hosting fee for his Website. This will eliminate all of his monthly costs except for his financing package payment for his PenzPay transaction system. I do however, have a system in place to help Russ sell his PenzPay transaction system and thereby eliminate his monthly financing package payment. This actually costs me quite a bit of money, but I am willing to do this because I really do not want to have anyone stuck with equipment that they are not using. Russ needs to be pro-active and find one or more companies that need an Internet based PenzPay transaction system and then send ePenzio these qualified leads. Please have Russ send these referrals to my personal attention so I can make sure they get handled properly. My email is bcrawford@epenzio.com and my fax is (801) 365-1010, attention Brad Crawford. I will have our salespeople call Russs referrals and try to close the sale for his. If they are successful, it will be necessary that Russ pay a $50 transfer fee, but I will pay all of the other sales costs associated with this transfer.

Sincerely,

CEO, ePenzio Inc.

To be honest, I have been a little tied up at the moment with some other pressing issues, but I haven't forgotten about this and I am still collecting data.

The funny thing is, I sent them a voided check and they took out 2 months payment for the 89.95, and they passed out my checking account information to all of their little scheming pals. Some how, they they lost my checking account information and started sending me collection notices for the 89.95 and then the full amount. Strange thing is that they still deduct $10 from my checking account every month. I call the EBBA and told them to cancel my membership. Actually, what they didnt tell me was I have to send them a letter, so I eventually had to do that and EBBA finally stopped debiting money from my account.

The Internet Gateway feature was a little bit more difficult. I called them several times to cancel it and they never did. Finally, I sent them a letter to cancel it. They told me that it would cost $250 to cancel. Luckily for me, they never deducted that out of my account.

I am still working with a collection agency on the whole merchant account scam, but I am currently trying to start my own legit business, so I am only sending them $20/month. Unless something happens, I am thinking of settling my account with them for half the cost and learning a valuable lesson.

And a word to everyone else out there. If you ever get a notice from these people about a seminar coming into town, PLEASE go there and tell everyone you can not to do this and that it is a scam. I plan on doing that if I ever get one in the mail or anyone I know gets one in the mail. I am sick and tired of people like this that prey on people's dreams. I really should have known better, in fact, I was just going becuase I was a web developer and wanted to see what they offered and everything. From the material it seems that like you are missing out on some hidden knowledge, you really arent. In fact, anyone thinking about doing this you can get a merchant account for about $300. You will always have the Gateway fee. But at least you can get a merchant account at the time you need it, not 6 months before you are ready. But I knew better and I should slap myself for this.

I would appreciate any help or knowledge aout getting rid of this cancer.

Yes, you have to....

Russ,

Yes, you have to send everything to the Utah Attorney General's office because that is where the problem lies, not just in Mo. It is better to alert the authorities where the business is located.

I'm sorry you have to go through extra work, but you could save others from misery with your effort.

Good Luck,

Update from me

AUTHOR: Russ - ()

POSTED: Tuesday, October 01, 2002

Dear Fraud Chick,

As you had told me before, yes, I had filed a complaint to AG's office in MO. But they have overloaded work. 2 weeks after I sent all copied forms and filled-out forms of complaints, I called AGO. The lady who received my call told me about this overloaded work. So I expect to get a call from investigator of AGO in MO at the end of this month or early next month.

Do I have to do the same thing again to AGO in Utah with additional info that you just posted? I certainly will give this info to investigator from AGO in MO when this person calls me.

Kerry, how is your progress?

1 interesting thing that I find out again is that this company (either BIH or Epenzio) sent another invitation letter again to me and my wife (2 letters) for attending their trap seminar last week. I had emailed the editor of local newspaper company (St. Louis Post Dispatch), letting him/her knows about this event completely. I requested that if it's ok to let people in St. Louis know about this danger, and also requested if it is ok to publish a small announcement to people in St. Louis that already got trapped like me (but don't know what to do) to come to this web site and post their stories. I even told the editor to come and check the seminar out if he/she didn't believe what I told him/her and had experienced so far.

The other interesting thing is that the sender of this letter uses the name "Web Success 2002" and the address is not current BIH or Epenzio one. It is "2755 South Cottonwood Parkway 4th Floor Salt Lake City, Utah 84121", as written on the letter envelope.

That's all my update so far.

We need to get a professional, experienced investigator to check into BIH.

AUTHOR: The Fraud Chick - ()

POSTED: Friday, September 27, 2002

Kerry and Russ,

I hope you two are hanging tough. Kerry, in response to your question, have I ever been scammed by this type of thing? The answer to that question is no. I just know a lot about scams, scoundrels and fraudsters. My friends refer to me as the "fraud chick", which is where I picked up my online moniker.

The whole BIH scheme seems a little "expensive" with little or no actual return on investment. We need to get a professional, experienced investigator to check into the business.

I suggest that both of you send an online complaint to the Utah Attorney General's Office to make a complaint. The link is http://attorneygeneral.utah.gov/contact.html. I want you to complaint to the Utah AG's office because that is where BIH is based. I found that a man by the name of Kevin Rowe owns the web page domain of www.bring-it-home.com. His registered address is:
1500 Wells Fargo Plaza
Salt Lake City, UT 84101
US
Phone: (801) 521-3200
Fax..: (801) 328-0537
Email: bihi_ad_min@hotmail.com

I then searched the corporation records of the Secretary of State's office and found that Kevin Rowe registered Bring it Home as a corporation in Utah on March 23, 2001. "However"---according to the records this business is now expired as of 6/24/2002 for failure by Kevin Rowe to re-file. For documentation of this follow this link...
http://www.utah.gov/serv/bes?id=411436&action=details

That's very interesting, there could be several reasons for Kevin not renewing--we could only guess at this point.

When you write your e-mails to the Utah AG make sure you are very clear about how much money you've paid into this scheme and what you want back. Use the information I've posted here to direct the AG to the owners of the web pages and directors of the scheme. Refer the AG's office to the Rip-Off Report as well.

Please keep us all posted. If you know anyone else who believes that they have been deceived by BIH encourage them to write to the Utah AG as well.

Good Luck

Hi Kerry,

So far what have you done to stop them retrieving your money?

I'm thinking about a class action law suit but nobody seems getting ready to do this yet. I'm a little concerned here.

Try to contact the editor of this web site. I'm thinking of asking the editor to coordinate us who had posted our articles and getting other people who have been victims of these companies too.

AUTHOR: Kerry - ()

POSTED: Friday, September 20, 2002

Dear Fraud Chick,

How do you know so much about all of this. Did you get scammed by this in the past?

I am on of the many other people Shanghaied by HOME and ePenzio and all of their affiliates. I want to get out of this mess that I got myself into and I am going today to my bank and also try to file a complaint with the AG office here. I am in Little Rock, AR.

I would really appreciate any help with this at all possible. Can you get rid of this whole ePenzio thing with out declaring bankruptcy. I really do not want to do this, but I do not want to give them one penny more. Any help would be greatly appreciated. You can post your info below, that would be appriciated. Thanks.

More updates on 5/29/02 Dear TheFraudChick, Thanks for your help so far.

Dear TheFraudChick,

Thanks for your help so far. Yesterday I just received 2 mails from Epenzio and Monterey Financial. Epenzio still refuses to cancel and close my merchant account. Two reason that they said; the first one is that they were missing information from me (my void check).

I hadn't faxed it to them until 4/9/02. So they blamed me because I faxed it late to them.

Second reason is that there is a sentence at the bottom of the notice of cancellation form saying "I understand that Epenzio makes no guarantees as to the time involved in processing my merchant account or financing application".

So they are trying to say that they aren't responsible for the time it takes to complete the whole thing before I get my merchant account and its password.

Infact when I received the package from Epenzio on 4/19/02 (it was sent by fedex overnight on 4/18/02), I got only the manual of how to use the merchant account (I really don't understand why I need this book if the credit card transaction will be done over the internet automatically without my intervention). I never received my merchant account with the password in the

package as they had claimed (Do I need a password if the transaction is done through the internet without my intervention?)

The second letter is from Monterey Financial. They asked for the monthly payment of the merchant account + the charge of $15.00 because I stop the debit transaction.

What do you think, The Fraud Chick? In your letter to me on ripoff web site, you suggested me to file out an online fraud complaint to AG office. Will that back fire on me later on?

Is it true that a merchant account can only be leased/rented like an apartment rent? Once I don't need it, I can release/close it. If it is true, then if Epenzio sells the merchant account and they say that if I don't need it anymore, I can find someone else who wants to buy it from me. That means this is an illegal business then. I get the feeling like this because I once talked to the Bridgeview bank & trust personnel, which handles the money that I receive from credit card transaction if I get it, and he told me that my merchant account can only be used by me. When I don't need it anymore, I can close it and can't be transferred to someone else. Someone else has to get it for himself/herself by himself/herself.

Thanks for your help,

Sincerely,

Russ

Here's a link to your state's attorney general...

Russ,

By the AG's office I meant The Attorney General's office. You should go ahead and file a complaint as soon as possible. The fraudsters attempted to defraud you and you had to team up with your bank to fight back--that's terrible.

Go to http://www.ago.state.mo.us/fraud.htm and fill out an online fraud complaint form. You may want to cut and paste what you wrote to the Rip-off Report because you were fairly eloquent.

Good Luck

The Fraud Chick,

Thanks for your further help. Yes, I only deal with my local bank. I never deal with these companies anymore since I wrote the 2nd letter and faxed it to EPenzio. I already got two refunds from 2 debits ($10.00 and $25.00). Today I got a form from my local bank (Affidavit of unauthorized EFT) that I have to fill out and return it to them. It has the investigation #. I don't understand why they still send me this but my money has been returned. And I got only 1 form for the $25.00 one. I didn't get the $10.00 one.

The Monterey already debited my account too yesterday ($89.95). I asked for the ACH fraud complaint again. But the bank personnel decided to stop the payment and waived the service fee for this ($20.00). I felt very grateful to her. Tomorrow I'm gonna close my checking account and take out that money.

BTW, I haven't got any reply letter yet from epenzio for my 2nd letter to them. And I haven't got letters also from pacific webworks ($10.00) and bridgeview bank ($25.00) regarding the charge back to them. Do you have any suggestions how to handle this when they contact me someday later.

What is AG office?

I have found out that the visual webtools 4.1 (pacific webworks' newest software) that I got from the workshop only allows me to use webwizard and clipon commerce utilities. Webcontacts, webprofiler, webchannels, and webstats utilities require additional money if I want to use them. The speakers from the seminar and workshop had lied to me (and the rest of participants), telling me that all those utilities are included for this ver. 4.1. That's not true. I still can't use their software right. It still doesn't show up all utilities that I had paid for so far.

I have tried to remove and reinstall it several times without any good result. I have asked the CS from pacific webworks and I got the answer that if I need to update the whole files, I have to download them from the URL that they gave me. I have tried to download them again a couple times without any luck. My web window keep saying "done" at the bottom left side. I guess they make it like this so the user has no choice but to contact them to ask for building his/her web site. Sneaky trick. I think I'm gonna stop using it and stop using this web space too. Luckily I haven't been charged yet as what they had promised (I will be charged when I say I'm ready to publish and run the web site).

Thanks for the help, the fraud chick. I'll keep post more result.

Stay focused, you're on your way....

Russ,

You only need to deal with your bank. While you're waiting you should make a complaint through your state's AG office.

This whole process can be frustrating but, in the end, highly rewarding.

Let BIH know you intend to report them to the AG's office.

Good Luck!

Thanks to you, the Fraud Chick in Ethics Arkansas

POSTED: Monday, May 13, 2002

As the Fraud Chick told me, I have already filed an ACH fraud complaint thru my bank. Thanks to you, the Fraud Chick in Ethics Arkansas. But, my bank needs at least 10 days before I can know the result. I have also planned to close this checking account. The Monterey Financial who handles the money retrieval directly from checking account (instead of charging to credit card) surely will contact me regarding this. Fraud Chick, can you help me with this? Or is there anyone out there who can help me with this? I really need help facing this crazy companies. Please post your information below so everyone can benifit from this.

Thanks

Russ

You still have an option...

AUTHOR: The Fraud Chick - ()

POSTED: Thursday, May 09, 2002

Russ,

Go to your bank and file an ACH fraud complaint form. ACH stands for Automated Clearing House. Tell your bank that you've cancelled your program with this company, you've received no services and that you repeatedly asked them to stop debiting your account to no avail. Ask them to put the money back into your account that was taken out. What they do is charge back the account of the debiting party. Ask your bank to change your bank account number as well.

If you are successful with the ACH Fraud Form then walk away from what remaining money you lost and consider yourself lucky. Tell everyone you know what happened to you to save them from this turmoil.

Report this company to your AG office in your state. State the facts clearly and your suspicions. This sounds like a web mall scheme but I can't be sure without more facts.

You really dodged a bullet by avoiding that $8,000 plus charge by these fast talking salesmen--nice job.

Good Luck
