Many of you have come across ePenzio and Bring-It-Home and the other fictious business created by the same individual (not naming names but goto BBB.ORG (better business bureau) and look it up... same man owns all these companies... yet when they promote themselvs in the confereces, they act and tell everyone they are completely seperate and not owned by the same people.

They lie to make a sale of a software product that you don;t actually get to own.. all it is, is a link to a web site where you can use the software on their servers, but you never actually own it... Also.. they fraduently charge your accounts for hosting fees, even if you only bought the software for development or personal use, and never use the hosting services at all!

Then you try to reason with them, good luck, they will tell you they will stop billing you, maybe even reverse a few months hosting fees... wait a few months.. they'll back bill you in one lump sum... it doesn;t matter if you change your credit card numbers, bank account or anything.. they also own a fake collection agency and have access to ALL you personal information and accounts!

I spent hundreds of hours talking and researching this b*****d of a company and found EVERY STATE I called had complaints against them. US Attorneys even have looked at it... yet with all the MILLIONS OF FRAUDULENTLY STOLEN dollars still doesnt motivate them to posecute! They say there's nothing criminal... So lets make a class action civil law suit fellas! Call me!

The TRUTH about Eric's contracts

I am sorry that Eric feels that there is a problem with the Website package that he purchased from Bring it Home or the PenzPay Internet Payment Gateway that he purchased from ePenzio that would have caused him to have to seek a remedy by this means. I have read Erics complaint, reviewed all of the contracts that Eric signed, reviewed all of the notes in the Bring it Home database and the ePenzio database concerning Erics accounts, and I found the following:

1. Eric purchased his Website Package, which included a Website, Web Wizard, Shopping Cart, Authorized reseller status and SBBA membership for only $99, and applied for the financing package for his PenzPay Internet Payment Gateway on April 25, 2002. The contracts that Eric signed on April 25, 2002 required Eric to sign in 8 different places. Eric was given copies of all of the contracts that he signed, so that he could review them at his leisure.

2. Eric had until April 30, 2002 at midnight to cancel his applications and eliminate all of his obligations concerning these contracts. Neither Bring it Home nor ePenzio received a cancellation notice from Eric during this time.

3. Eric received the Website Package that he purchased at the time of purchase.
4. The package that contained the Login ID# and Password for Erics PenzPay Internet Payment Gateway transaction system was delivered to Eric by FedEx on May 15, 2002, FedEx tracking #476963415866 (look it up if you want). It appears that Eric personally signed for the package. Upon receipt of this package, Eric had everything necessary to operate his PenzPay Transaction system.

5. On June 21, 2002, Eric called ePenzio to inquire about further information about the Affiliate program.

6. I have NO records of Eric ever calling Bring it Home or ePenzio to indicate that there were any problems or issues with his Website Package or PenzPay Internet Payment Gateway system.

7. It does not appear that Eric EVER called Bring it Home requesting help in designing his Website.

Based on this information, I see no reason why ePenzio should be compelled to cancel the contracts for Eric. I feel that Bring it Home and ePenzio have lived up to all of the terms of the contracts that Eric signed on April 25, 2002. Bring it Home stands ready, willing and able to assist Eric with his $99 Website Package at any time. ePenzio has delivered to Eric exactly what he contracted for, a PenzPay Real-Time Internet Payment Gateway system. It appears to me that Eric has made no effort to make the products that he purchased work. If Eric has any information to show that ePenzio did NOT fulfill the terms of the contracts that he signed on April 25, 2002, I would welcome him to fax this information to me at (801) 365-2135 and I will be happy to review it.

Based on the above information, I am confused about the following items that Eric mentioned in his complaint:

1. Erics claim: They (ePenzio?) lied to make a sale of a software product that you dont actually get to own.

a. Response: Why would anyone need to lie about this issue? There is Software Credit Card processing solutions available if that is what Eric wants. The Software solution will NOT allow Eric to do Real-Time transactions on his Website, and it has vastly inferior reporting capabilities. But ePenzios cost for the Software is significantly LESS than the PenzPay Real-Time Internet Payment Gateway system.

2. Erics claim: but you never actually own it

a. Response: Eric DOES own his PenzPay Internet Payment Gateway system. It is hosted on a secure remote transaction server, but this is what allows Eric to accept credit card payments Real-Time. Eric can sell his PenzPay system to a new owner at any time (see below). Just because Eric cannot touch it with his hands does NOT mean that he does not own it. I have a Website that I own, but I cant touch it.

3. Eric claims he has tried to reason with us.

a. I have NO records of Eric ever calling Bring it Home or ePenzio to indicate that there were any problems or issues with his accounts.

4. Erics claim: I have spent hundreds of hours talking and researching this b*****d company

a. Response. It is too bad that Eric decided to spend hundreds of hours researching ePenzio instead of doing ANYTHING to try to develop his Website and make his new business successful. I am very confident that if Eric had invested hundreds of hours in his new business, it would have been successful. It is too bad that some people are successful in spite of what happens to them, and other people will spend all of their time blaming everyone but themselves for their failures.

Fortunately, if Eric has determined that he no longer wishes to develop his Website and use his Internet Payment Gateway, there are several things that Eric can do to lessen or eliminate his costs. He can call Bridgeview Bank at 1-877-877-8164 and cancel the monthly service for his Merchant Account and call ePenzio at 1-800-494-1563 and cancel his gateway access to his PenzPay Internet Payment Gateway. He may also call Pacific WebWorks at 801-578-9020 and cancel the monthly hosting fee for his Website. This will eliminate all of his monthly costs except for his financing package payment for his PenzPay transaction system. I do however, have a system in place to help Eric sell his PenzPay transaction system and thereby eliminate his monthly financing package payment. This actually costs me quite a bit of money, but I am willing to do this because I really do not want to have anyone stuck with equipment that they are not using. Eric needs to be pro-active and find one or more companies that need an Internet based PenzPay transaction system and then send ePenzio these qualified leads. Please have Eric send these referrals to my personal attention so I can make sure they get handled properly. My email is bcrawford@epenzio.com and my fax is (801) 365-1010, attention Brad Crawford. I will have our salespeople call Erics referrals and try to close the sale for his. If they are successful, it will be necessary that Eric pay a $50 transfer fee, but I will pay all of the other sales costs associated with this transfer.
