Toma ILEGAL de alcaldas y gobernaciones

La suerte de gobernadores y alcaldes opositores ha sido puesta en manos de los Tribunales, y mientras algunos han sido ya defenestrados, al resto parece esperarle un destino similar. Este hecho viene siendo denominado judicializacin de la poltica y se hace posible merced a que tanto el Ministerio Pblico como la Justicia, vienen perdiendo su independencia funcionalmente a una tcita decisin del Gobierno Central de acabar con dichos niveles de oposicin. Para este efecto no importa el atropello a la legalidad, una de cuyas graves manifestaciones es el desconocimiento a las garantas de jurisdiccin y competencia, de modo que desde la Sede de Gobierno se procesa a autoridades y personas del interior, corriendo el riesgo de incurrir en una nulidad absoluta, que revisada algn da los responsables debern sufrir las sanciones de ley.

Frente a esta situacin ajena al debido proceso, sus vctimas pecan de ingenuidad al demandar judicialmente a las autoridades, jueces o fiscales, tratando de equilibrar la situacin. Vano intento que no tardar en volverse contra ellos, en vista de que el poder judicial no da muestra alguna de contrariar los deseos de quienes manejan el poder.

Bajo tales premisas han sido juzgados los ex alcaldes de Sucre y Potos, adems de otros en diversas provincias, y la revancha poltica ha dado cuenta del ex gobernador de Tarija, Mario Cosso, haciendo pesar ahora la espada de Damocles sobre el alcalde de La Paz, Luis Revilla y contra el gobernador del Beni, Ernesto Surez. En lista de espera se encuentra el gobernador de Santa Cruz, Rubn Costas. En cuanto a Pando, es conocido que Leopoldo Fernndez fue apresado y depuesto, quien desde hace dos aos guarda detencin preventiva, en un proceso que de entrada acusa retardacin de justicia. Es posible que en algunos casos exista materia justiciable, pero la intencionalidad poltica es clara e irrefrenable y su fallo condenatorio ha sido dictado con anticipacin. A diferencia de tanta celeridad, el Ministerio Pblico y los jueces no actan con similar prontitud o simplemente omiten procesar las denuncias de corrupcin relativas a funcionarios actuales de diverso grado.

Suena a burla decir que slo de trata de una suspensin de funciones a fin de que los encausados asuman defensa y puedan ser restituidos despus de probar su inocencia. La obsecuencia de los tribunales no permitir jams esa posibilidad y tiene todos los resortes para dilatar los procesos y demostrar su eficiencia ante quienes presta obediencia. Al mismo tiempo se presume que este comportamiento no aparta los ojos de la prxima eleccin de magistrados.

Entre los casos en cuestin hay sindicaciones que lindan en la invencin o rebuscan fallas o errores administrativos inclusive no imputables a los procesados. As el seor Jaime Barrn no intervino ni remotamente en la supuesta humillacin a campesinos. Los actos de Ren Joaquino no ocasionaron dao econmico, sino todo lo contrario. A Luis Revilla se lo juzga por cargos leves que no se le permiti descargar ante la Contralora, fase previa a una accin coactiva y de ninguna manera penal. El Gobernador del Beni es inculpado de un contrato no firmado por l, y la Corte Suprema lo deriva a los tribunales ordinarios desconociendo que el presunto hecho se enmarca por razn de tiempo en Caso de Corte, previsto por la Constitucin que se encontraba todava vigente.

La perspicaz ciudadana, siempre alerta y oportuna, es consciente de que las esferas de Gobierno siguen el plan de rescatar por cualquier medio las gobernaciones y alcaldas que perdieron por el voto popular, echando por la borda sus juramentos democrticos. Estas esferas son fieles a la democracia cuando les favorece, pero la desconocen sin enfado si les es adversa. Estamos en el escabroso camino hacia un totalitarismo secante. No en vano se viene reiterando la bsqueda del poder total y permanente, pese a que se lo llam eterno.
