This past Monday, I received an email from a Richard Duckett, claiming that I received a pay day loan on July 25, 2014, and never paid it. I found this suspicious, since I NEVER put in for ANY pay day loan from ANY company during this time, and I responded by sending them a cease and desist letter. This was their response below:

We apologize for the inconvenience, but we will have to proceed with legal measures. Despite sending you several reminders, we have received no response from you about your seriously past due account. We feel we have given you ample time and have been more than patient with you.

Therefore:

1. We feel there is no recourse but to put your account in the hands of our qualified lawyers to get a lawsuit filed against you.

2. This action will affect your credit rating.

3. We may also report this to the I.R.S. as “bad debt loss” with form 1099-A if payment is not received.

4. We have filed Wage Garnishment Process and ready to contact your employer and Social Security Department.

Bankruptcy laws will not work in this issue. With or without bankruptcy we have all rights to garnish your wages. This debt is not mentioned in bankruptcy laws. We will apply for Earnings Withholding Order to collect your delinquent debt. We will contact your Employer or Social Service Department to garnish your wages.

This is a scam!

AUTHOR: Harry - (United States)

POSTED: Wednesday, October 09, 2019

I recently received what is probably the best scam email I have ever received, which is very much like the poster of this ripoff report.

This email contained an old address, telephone number, social security number, and information regarding a supposed payday loan with this company, claiming that I had opened a payday loan in 2016, and offering me payment options.

This email also had a (very fake) document indicating that a lawsuit against me had been filed with the Superior Court of California. Obviously, this information was obtained in one of the numerous leaks throughout the past few years. Thankfully, I'm generally pretty savvy, so a few things stood out to me in this email.

First, the supposed document from the court was written in-line in the email, and had a 'stamp' from the court which was a JPG, and had clearly been altered.

Second, this loan never happened. No such loan was ever taken out by me, especially in that time frame, and certainly not at or from the address listed within that timeframe.

Third, and most importantly, the company indicated by these scammers has seemingly only been in operation since May 2019, and only provides payday loans in select ZIP codes in California.

This particular scammer is VERY good at what they do, and provides so much information, that it's virtually impossible to ignore. I took quite a bit of time to pick this one apart, making 100% sure it was fake, before choosing to ignore it.

Hopefully others receiving the same scam will see this comment and know that it is definitely a scam!

Thank you so much for this information. That is just what I am doing. I sent out a certified letter demanding they cease ALL contact with me, or I will take legal action.

I even contacted my local police, as well as my state attorney general's office, so IF they go any further, I WILL press charges.

...then you are safe to ignore them, but you could also send them a letter of your own telling them that you intend to counter-sue for harrassment, blackmail and attempted theft.  These people are just fishing for money and hope that for every thousand letters they send out 3 people will get scared and send them money.

I would also urge you to contact the police and turn copies of all correspondence to them. Keep a paper trail.
