Iam a 27yr, old wife and mother of two children, We have had nothing but problems w/FB and really what are they thinking because some of the things that they pull with people who are just trying to live and have a little somthing,I know we earned it and they are NOT taking it w/out a fight because now they are taking from our children and thats where I draw the line......

You dont know how I felt when I seen this site..cheeeeeez
Iam not alone wow, I have done everything I could to keep my home each time somthing, the story is a novel and would take my forever to finish but Im gona give the highlights and as you all have read our stories are somewhat the same.

My husband worked for AT&T and we were happy in our own world doing what we could to get by and were alright, We bought our home w/ my parents help in 1998 and waited two yrs to refi thats where somehow my cozi world was gone, 2000 we went through Alliance Funding a Division of Superior Bank FSB and dont even know when my loan was sold! some time in Nov of 2001 I recived a phone call telling me we were two months behind and that they were our new loan servicer.

So after telling them I was not behind and I have the proof if they wanted it. Well I was told they didnt have my account yet because they were not in the system. I called S.B. and wanted a account sum and was told they didnt hold our loan anymore and I asked well when was someone going to pass that info to me, so you dont have my info and F.B dont have it either than where is my money? (we pay 852.00 a month and have escrow) well Mrs ---
if you want YOU can call back in a week or two and you should be reciving a letter telling you your loan was sold.

OKAY where is my money? and who has our loan???????????????

To make A long story short I have been hung up on, yelled at, called after 9:30pm and on sundays, umm lied to, givin the run around ooohh but when thay want their money there quick to call.

my land and house were never purged causing the first loan to fail, it needed to be purged for atleast 12mo and we had the loan from 1998-2000 someone didnt do there job! (I dont know)F.B. even went so far to cuss my mother telling her "Its not our fault your daughter cant pay her bills maybe you should have done a better job raising her" WHAT THE --LL HOW DARE YOU......
Iam 27, 22 when I became a homeowner and if you dont have hard times now and then, then your still livin w/mom and dad, ohhh no thats right you live on our money!!!

Next comes the second loan needless to say I found all the foul, greedy, hungey sharks, I did not think to keep track of the dates and now could kick myself in the &$% who knew?? durning this time my when it could not get any worse....It did my husband was burned over 40% of his body and we spent one month in Univ of southern Colo's burn unit. I was told we were in forecloser and the selling date was set for Aug 7th my sons birthday I'll never forget that date, we left to Denver on sept 24th and had the broker working on our refi already for a month.

The broker told my not to stress he would take care of it to get my husband well so he could come home. We still had till Nov and I waited, well with all that was on my plate my father was taking care of things, Nov came and went only to find that they didnt sell in Aug but sold in Nov, now it was starting to stress me, After all that and I left out A-LOT this man wanted my to refi my house for 120,000 and my payoff was 78,000 UUUHHHHHHHH
what the H--L are you thinking, as were sitting at the closing table w/ my father my new payment was going to be 900.00 a month and didnt have escrow, my dad said "lets go" and we went.

Times tickin and pops said he would help once again so this time he went hunting and found Pam (wonderful) movin on.... Okay Pam did everything she could and now my husband can not work and I was a student who was gona give us a loan????????

Dad!!! he was going to buy our house and we were going to rent it from him I didnt care just as long as one of had it and happy we will be you think????????
fat chance Pam had everything set for GO when we were put to a stop F.B. would not give the C.Union, title co.,me,dad,mom county court house, we were told to contact the atty, and they could answer any ? we have (ya right) there we went down the line once more and only had 4 or 5 days left. Pam was the phoo (****)she did all her part she was heven sent! But once more our call were not returned, there nothing we can do they sent us on a wild goose hunt and the goose never left the nest!!!

The court house didnt have any records and F.B. didnt want to give any up so, Here we are after all that think im ready to give in not just yet, F.B. never paid any taxes and added ins to our acct Whats escrow??? Fairbanks Capt. more like.... Fakebandits Rus. Out to steel your home and toss your kids in to the street. Like I said there is much more but my mouth wants a turn and my fingers are tired of walking.

Can anyone answer me this?
I have been trying to find my house on the forecloser list and cant find it anywhere in Colorado on anyones list, do they list them?

I think to myself how much more can I take and once more sent from heven.......This site.. What more can I ask for? uuuuuuuuhhhhhh MY HOUSE BACK!!!!!!!!!
I thank god every day for giving me to my parents, and
this report with out you I (maybe) would have givin up.
Every dog had its day! and all them suckers will pay!!!!

Your Rights and the Responsibilities of the Mortgage Servicer

When you apply for a home mortgage, you may think that the lender, or loan originator, will service the loan until it is paid off or your house is sold. However, in today's market mortgage servicing rights often are bought and sold. The Real Estate Settlement Procedures Act (RESPA) is a consumer protection statute. Sections 6 and 10 of RESPA provide you with certain rights regarding the servicing of your mortgage and escrow account. Please read this important information concerning your rights and the responsibility of your loan servicer.
Duty of Loan Servicer to Respond to Complaints. If you have questions or problems with the servicing of your loan, the servicer is required to respond to you. Write to your servicer and call it a "qualified written request under Section 6 of RESPA." It should be a separate letter and not mailed with your payment. The mortgage servicer must respond to you within 60 business days of receipt. (See Sample Written Complaint to Lender.)

Loan Transferred to New Servicer. Your loan servicer is required to notify you in writing at least 15 days before the servicing of your loan is transferred to a new servicer. The notice must include the following information:

The effective date of the transfer, the date your current servicer will stop accepting payments and the date the new servicer will begin accepting them.

The name, address, and toll-free or collect call telephone number for the new servicer.
Information that tells whether you can continue any optional insurance, such as mortgage life or disability insurance, and what action, if any, you must take to maintain coverage.
A statement that the transfer of servicing does not affect any term or condition of your mortgage documents other than the terms directly related to the servicing of the loan.
Treatment of Payments During Transfer Period. During the 60-day period beginning on the effective date of the transfer, the payment may not be treated as late if you mistakenly send it to the old mortgage servicer instead of the new one.

Escrow Account. RESPA does not require that you maintain an escrow account for the purpose of paying property taxes, hazard insurance, etc. Nor does RESPA have any jurisdiction over the decision of the lender or servicer to require or terminate an escrow account. RESPA does, however, provide you with the following protections with regard to the escrow account:

If your lender or mortgage servicer requires you to maintain an escrow account for the purpose of paying property taxes, hazard insurance, etc., RESPA requires that the servicer pay such items by the dates due to avoid a penalty or late charge.

RESPA sets limits on the maximum amount of money the servicer may require you to maintain and pay in the escrow account. (More information about escrow accounts, including how to calculate the maximum amount RESPA allows the lender to require in the escrow account.)

PMI (Private Mortgage Insurance). RESPA has no jurisdiction over the lender's decision to require PMI. Nor does it have any jurisdiction over the lender's decision to cancel PMI. (The PMI Act provides information regarding cancellation of PMI.)

RESPA VIOLATIONS

This story is an example of RESPA violations.
I am referring to RESPA 12 U.S.C. 2605 (YOU WILL BE NOTIFIED THAT THE SERVICING OF YOUR MORTGAGE LOAN BEING TRANSFERRED FROM ORIGINATOR OF LOAN TO
SERVICER.)

Except in limited circumstances, the law requires that your present servicer send you a notice at least 15 days before the effective date or at closing. Your new servicer must also send you this notice no later than 15 days after this effective date or at closing. (or present servicer and the new servicer can combine all necessary information on one notice.)

During the 60-day period following the effective date of the transfer of the loan servicing, a loan payment received by your old servicer before its due date MAY NOT be treated by the new loan servicer as late, and a late fee may NOT be imposed on you.
