I had an account with FCNB/Spiegel.I paid of the account in 1997.I enclosed a written statement notifying them to close the account upon receipt of payment. For a year, nothing. I changed jobs(truck driver)and was only home on weekends. I would get home in the middle of the night. I would get my bills together and do them so they would be taken care of. I recieved a bill. Paid it. I didn't realize who it was from.It was form FCNB. I paid it. I hadn't recieved a bill in a yearand I didn't recognize it.I did that one more time . The next time I recieved a bill, I remembered that I had paid off this account already. The collection calls started. I explained to them what happened and they would stop calling. Then, in early 2005 I get a letter from a lawyer representing a collection agency on behalf of FCNB/Spiegel.

I told them to send me in writing what I owed and a statement to the effect the account would be taken care of for good and I would pay them. The lady on the phone was hatefuland rude. She told me she couldn't send me a letter of how much I owed. I couldn't send them $600 without it. Well, four months later and I have to go to court 10-18-2005. I don't have the last bill stating the zero balance. I am screwed. I was going to pay anyway. At least maybe a court order will make sure it is over. I feel better knowing I am not alone.

They are required to provide documentation supporting the claim for the amount they are filing against you.

Answer the court, by requesting an accounting
that makes up the balance they have filed suit for... and gather your cancled checks to determine if they posted all your payments.
