I purchased a condo in 2008 from Flamingos Acqua in Nuevo Vallarta Mexico. The developer Mr Eduardo Valencia was a crook and never signed off the title to anybody. The investors(included myself) wanted their title to we went ahead and started a huge lawsuit against the developer. Raúl Ruiz Gonzales, Mr. Charles Andres Bacichett, and Francisco Martin Lucia Perez took advantage of this problem and promised to help everybody get their title. They took over the administration and placed people who they have control over in the administration to run the whole development. Several owners, tired of problems, and paying over money to attorneys, gave up and ditched their condos. When the developer was arrested, Raul Ruiz and Charles Bacichett took advantage of the situation and fabricated false purchase agreements under random names whom dont belong to real people for various condominiums which were not inhabited at that time, took the possesion, which in Mexico means 80% of any law suit with regards to properties, and rented them out for their personal profits and benefits. Mr Raul Ruiz who is an attorney, promised several owners over a year ago, that he would get them all their titles and charged them for attorney fees and has not been able to deliver a single one. My condo was taken possesion of, and Mr Ruiz and Bacichett, along with the administrator Martin Perez, deny me acess to my own unit that I paid in full over 5 years ago. They get security to escort me out of the property, every single time I try to go. I have contracted an expert legal consultant who has been helping me and he has put enough pressure on them by threatening them to take them to court and expose them publicly, that mr Raul and Charles have even admitted that the property does not belong to them but forcing Mr Francisco to say that there are minimal outstanding maintenence fees which I agreed to pay if they give me back my unit but i'm scared that they will take my money and ignore me because they told me to write the check out to the name of some random woman who I had never heard of before and has no relationship to the development in any way, and also "remodelation fees" which I never authorized, and were obviously done to be able to rent out my unit and succesively getting a false title, which I know for a fact, that they have been renting out. I have also spoken with several other unit  who have suffered the same consecuences as me for not taking posession of the unit right away, and keeping posession until the title is handed, and many of them have even been threatened with violence and extorted for more money. 

Mr. Bacichett actually identifies himself as the sole owner of the units they steal to various condo rental companies around the bay and online. My consultant has investigated him, and found that he has various reports for fraud and laundering money, and is linked to the Hells Angels in Montreal, we believe that is why he left, and took off to Mexico where he also alleges to be protected by organized crime.

All I want, is for Flamingos Acqua to give me the posession of my unit which i legally purchased and have paid for in FULL, and for the Pieceofs*** developer Eduardo Valencia to sign me my title. A criminal complaint has been filed with the Attorney General in Tepic, Nayarit against Mr Valencia, Ruiz, Bacichett, and Lucia Perez.

We strongly suggest all owners to check very carefully what they sign and who they trust, this is a very delicate matter. We are also going to try to make this circulate to warn real estate agencies around the Jalisco and Nayarit coast and online. This is to protect innocent investors of Flamingos Acqua, and the honor of the honest Mexican workers who work hard every day to try to make it a better place for investors and foreigners. I have concerns....please address

I m looking at a unit in this condo development. Should I have concerns in getting a title for this property? Are all the issues concerning utilities and association dues been resolved? What guaratees are there regarding the solvency of the property does a condo owenr have especially since I am an American citizen? Has anyone had trouble renting their units to prospective clients because of thes issues?

Im unsure who created this Aquaowner accounts but its quite obvious the same person made many of those rebuttals. The administration takes the money and deposits it in personal accounts and never makes receipts for anything. Things are going to change though and we will get a proper administration and eventually get all of our titles. Goodluck to Unit owners in Aqcua.

 We have lived at Acqua full-time for almost 5 years now.  We have been paying maintenance fees for 5 years.  We would like to commend Raul, Charles and Francisco for their hard work to make living at Acqua more comfortable.  They have had to live with threats from our developer, Eduardo Valencia, ever since they began to help make a bad situation better.

Prior to their stepping up to confront Eduardo Valencia, we had to live without available services on a regular basis, i.e., water, gas, and elevators.  Because the electric bills for the common area were not paid, we would be without pumps to bring water to our condo and elevators to reach our floor.  Walking up 6 flights of stairs with a bucket of water from the pool to flush the toilets is not fun.

Speaking of pools, our pools are now clean and all of the pumps for the filters are working, which was not the case when Valencia was in charge.  At one time, both pools turned dark green. 

We owners can now use any part of the complex, with the exception of the uncompleted spa area.  Many sections were closed for our use even though we had paid for all of the outdoor furniture in these sections. 

We still do not have a title for our condo, but that is because Eduardo Valencia will not negotiate with the lawyers.  He wants to demand more money from us and be sure we do not own a part of the common area.

Without the extreme efforts of Raul, Charles and Francisco, we would still be worrying each day what was going to go wrong, like the cutting of gas pipes.  I believe the person who wrote this article would not think as he does if he had been living here and experiencing the things that we have endured.

I am sure the anonymous reyna del Norte is another ficticious entity of Eduardo Valencia C., arguably the most unscrupulous crook I've ever met. I worked in sales for Acqua for a couple of years and believed in the product or I wouldn't have been there. I even bought a double unit myself, much to my sorrow. Valencia started to show his true colors when he stiffed the concrete contractors (who are suing him still). And continued to not pay the many subcontractors, many of whom walked off the uncompleted job. Then his mad rantings began toward anyone who dared question his off the wall demands! Including myself. He even posted a blacklist barring many owners from entering the property if they had angered him. His outrageous demands for more and more money for hugely inflated prices for 'extras' and overpriced outdoor furniture?  He then tried to bar those who paid from using that same furniture. This just reinforced his unstable behavior.

He frequently called buyers/owners with extortionary demands or threats, and many times telling foreigners that if he found them in Mexico he would have them harmed or worse. This man is not normal, and is dangerous. He is used to getting his way by bribing officials, an easy thing to do in MX where pay is low.

Why have the courts regularly found him culpable for the things he has been accused of, ioutstanding the 'injured party'?

As for Raul Ruiz & Charles Bacchiet, these men are the only reason many even got posession of their embattled units, and they are the only ones who have been able to keep Eduardo Valencia at bay so Acqua can progress, rather than rot into the ground as Eduardo was letting happen, while he lived the high life in his zen mansion in Guadalajara n the extortion money.

Best of Acqua

 We are owners at Acqua.  We suffered at the hands of the developer Eduardo Valencia.  He extorted money from us, threatened us and charged false penalties to us as punishment.  WE are so grateful to Raul Ruiz and Charles Baccichet for their relentess pursuit for justice for all of Acqua owners.  These men are honest and have only the best interests for all Acqua owners even though Valencia and his people have threatened harm to them and their families.

If an owner does not pay his maintenance fees then he should be penalized and his services cut off and/or limited. 

We gladly paid legal fees (not attorney fees because so far Mr Ruiz has put his time and effort into this legal fight without compensation) to keep the battle against the unscrupulous developer Eduardo Valencia going.  We support Raul Ruiz and Charles Baccichet completely.  We believe owners will get titles to their property when Eduardo Valencia is defeated in court.  We must continue the battle against Valencia.  It is he, Eduardo Valencia, who is preventing us from getting titles.

We have seen employees fired from Acqua for stealing, and trying to make owners and visitors pay them tips for doing their jobs.  Any employee fired from Acqua was justly fired.  It was the developer Valencia who didn't pay his employees or the government for the social security money. Valencia is the crook, the liar, the thief.

Acqua owners now because of these two men, Raul Ruiz and Charles Baccichet do not have to fear of our water, gas and electric being shut off as punishment for no reason, we owners do not fear physical threats, we owners enjoy beautiful grounds and pools with no fear of using the common areas as we could not use them before.  We have happy, helpful employees that offer help to us.

Whoever you are that wrote this, I don't think you are an owner of Acqua, I think you are part of the Valencia mob.

Acqua Owners are finally getting justice

There is no need to dispute each and every one of these claims against Charles and Raul.  Both of these gentlemen have represented the owners of Acqua execeptionally.  I think that you will find that many owners will refute the claims and are happy with the governance of the condo, improvements, and representation of Charles and Raul.  Eduardo Valencia is the real crook in this case (kind of a stupid one also). 

 

Things are looking good at Acqua.

Owner is not paying his Association Dues

We have been owners at Acqua since 2005. We have been plagued for years by a very corrupt developer Eduardo Valencia.  Charles B and Raul R finally had the courage to stand up to him and take him to court. Before them we have had a half dozen lawyers or more try and fail. They were the first to succeed. We now have our own Homeowners association. We no longer have a developer using our facility for his private parties, using our funds for his own use. and running up electric and water bills that were unpaid. etc. We are still in court however with more problems to solve.

For some reason some owners have been remiss in paying their Association dues which we all have to pay to keep up the development and pay some of the past bills from the corrupt developer like past utilities.  There have been so many improvements to the property since we have had Charles B as our board president.  Alexandra is our secretary and deposits go into the bank in her name. 

I don't know who this owner is, but I can say that no one feels cheated by our present board.  I think it is a shame for someone to turn on his own.  We need to work together to make Acqua a better place.  This man needs to pay his fair share.  This is why he lost access to his condo. That is only fair since we have been paying since 2005 when we paid off our condo.  We all need to pay our fees, that is how we keep up with the bills at Acqua.

I used to work in the administration before they fired me because they knew that I was an honest person and they would be able to manipulate me. The real head of the snake is Mr Bacichett!!!!
