I hired Farrell Fritz to handle a probate matter in New York State Supreme Court. They assigned Frank T. Santoro to the case. I was charged a $25,000 retainer. Frank burnt through the retainer the first month and the bill for that first month was actually higher than that initial retainer. I was told the fees may exceed the retainer but I anticipated that I would at least receive a bill showing what portion had been used. So I paid another $15,000 and they sent me the papers Frank had drafted. Frank got all the facts of the case wrong. I do not know whether he just doesn't listen or what.

I told him I would not sign the affidavit he was insisting I sign so he redid that. He still got it wrong and when we got to court the other side blasted us. It was all avoidable. And part of this was the fact that Mr. Santoro was drunk half the time. I could actually smell alcohol on his breath in the courtroom. The judge laid into him for that and said he'd report it to the State Bar if it appeared to him one more time that Mr. Santoro was 'impaired'. Mr. Santoro said he was on medications for his knee. The judge didn't buy it. We lost and now another firm is handling the appeal.
