I can not even begin to go into the details of all of the things that Franklin Credit has done but I wanted to speak with some of the other victims about a possible class action suit. It seems to me that they are using the same predatory lending tactics over and over and accumulating a great deal of real estate because of it.
I will say however that they called me on Tuesday of this week and I explained to the loss mitigation rep that we are currently seeking legal representation but was willing to hear the solution he was offering. he sated that it may not be in both of our best interests to go there just yet. Today, Friday I come home from work at lunch to let my dogs out and my neighbor calls to tell me that a whole bunch of cars and two guys with an action sign were just at my home.

After calling back the loss mitigation he said he could not help me with that part but my account was not listed as for sale. He transferred me to the foreclosure department who told me to call the lawyer. I called the lawyer and they told me that Franklin Credit needs to issue a rescindance in order to stop the sale. That they could easily do that on their "new track" system.
Again I called the foreclosure department and the associate I was speaking with was out to lunch, her number was the only foreclosure number I had at the time. So I called loss mitigation one more time, the representative said that in order to rescind the sale I would need to come up with one payment or the attorneys fees.

Foreclosure called me back (after 4 calls) and said that the loss mitigation rep was incorrect ad that I would have to pay the entirety of the lawyers fees in order to get the rescission. I asked for the sum that needed to be paid and was told that they do not have it, but they will request it. Now 3:30 on a Friday I ask if we will be seeing this number before the end of the business day, to which I am told "these things take time". A few hours ago I had no time, I was too late, now these things have time?

I was in tears and a migraine was creeping in fast. So I asked the representative in the foreclosure department to contact me as son as the information for the attorney fees was complete. Looking back I should have asked to speak with the manager, I will be trying for that tomorrow. Now 11 pm and no call. In limbo and wanting to ring someone's neck.

They called me on Tuesday, to "work something out". The loss mitigation department had no knowledge of the sale as apparently, according to the foreclosure agent, they are on different systems. I am currently in contact with an attorney who is very interested in representing me in this case and was quick to see if any other victims would come forward and fight along side. I googled it and here I am. Please, please contact me if you are willing to join a class action suit against Franklin Credit/ Tribeca Lending. Either way I am pursuing legal action and trying to save my home in the process, but maybe it could serve a greater good to other victims and potential victims.

They juggled me between loss mitigation, short sale and any dept they could think of with any excuse or stalling con they could think of. They did too much for me to write in one day here. I  too suffer from migraines and chronic health problem they caused from the stress.  I am definitely in for a lawsuit and finally with help with a friend in a high position who helped me find out much about what they had done to me and others who got involved I am now in a position of knowledge and I am definitely pursuing this through every avenue possible, including legal, media, you name it.  Yes , I 'm in on any suit filed against these vultures.  They have to be stopped. There is not telling the lives they have cost in their no conscience terrorism of home owners.  Keep fighting!

Still to this day, I am annoyed that we have this venue to express situations needing legal attention....Yet there's no way to get help or contact fellow victims... ABSOLUTELY we have just cause to go after these people, will someone PLEASE inform us "how" to contact others ???  Weeks ago I did get a letter and packet stating our foreclosure is under Federal review.... I can't get ANY documents from their end. Franklin or Cal-western who between the 2 made life unbearable. That "Home" we had was our future so to speak... with 200-250 K in equity, and a loan bal. of 181 K went completely sideways due to their actions and inaction, approved to re-fi they refused to give either Banks and the title co and my Husband our pay-off amount..... they held back and then filed the foreclosure papers.. there was NO pre- foreclosure letters proceeding etc. We had the home sold to "stop" this action but by the time they added all their late, legal, processing etc. fee's it made it virtually impossible to deal with these people. They refused to put any agreement in writing, they took good faith payments with no documentation provided, we "thought" we finally had it handled. They needed a copy of our homeowner's ins. policy before they would send the new loan doc's. Done.... all parties were called to confirm receipt of policy. On a Wednesday we received a phone call from their loss mitigation dept. and I was told they were NOT going to honor our agreement due to my recent Brain surgery because they didn't see me going back to work any time soon.... They didn't even know what the procedure was for, and since when are they God or a Doctor ! It's called discrimination !!!! annddd they sold our home the next morning.....I will NEVER get over this !!! Hoping this Federal review get's them !!! But seriously these people need to be stopped !                                                                                                                                                                                                                                                                      IS THERE A CLASS ACTION ???  HELP HELP !!!

Franklin credit got my child hood home!

 We have had all the samething happen to us by Franklin Credit. They were going to help us so much and now we have lost our home and credit is so bad we can not buy a pack of gum on it. I just filed a compaint with my states U.S. attorneys office but we file papers in our local courts to stop them before it was to late and they did nothing we will see were this goes. The way I see it Franklin own my family a new home to call our own and more!

Hoping a Class Action against Tribeca is in the works

I too am a victim of Tribeca. In 2005 I did a refi. The terms were so bad that anyone could see that  a person would have to be insane to have agreed. There was some questionable acts on the part of Tribeca and their Notary and the person whom was handling the loan, MR. Ken Vessley.  These acts  I feel, are  nothing short of organized crime.  The scam was in my opinion a common place and well planned unlawful document switching scheme.

 There were signed docs which were filed ,  that had absolutely none of the required signatures, such as a notary signature and disclosure that all parties were indeed present and signed yet my signatures were on a separate page.  None of the docs that displayed any of the payments or percentage rates or the terms had signatures, only the final page which was usually just the signature. The very bottom of the docs were titled as Fannie Mae loan documents. This was as far from a Fannie Mae as one could get. I am unsure if that particular point is of any value in a legal action.  But there is more..

 The predator terms , like the scheduled ARM adjustment,  of the 8 percent increase every 6 months on top of the 11.99% terms would have rendered the loan at 20% after the first 2 years.  There were prepayment fees and prepayment penalties, there were required credit account payoffs which amounted to over $31000, which bulked the loan up quite a bit, considering the credit terms on the accounts were at a much lower percentage rate this would be stupid to turn them into 11.99% ARM  the refi cost me over $10000. And there was a $21000 cash out notated on the filed docs, yet I recieved no money at all. 

The absolute worst of the worst  in all of this which I was sure would be something that could easily allow any of the authorities whom I tried reporting this to recognize as PREDATORY.... My very first loan payment statement came to me  from Franklin Financial.. The loan was writeen in Juno 2005, the first payment due 07/01.2005 came in with a past due amount equal to two months worth of payments. Along with past due fees etc.. my statement  said $12857.21  was past due and payable immediately.  That is a pretty neat trick to add 2 months past due for a loan written and filed less than 30 days prior, 

So I was ready to sue. I had changed numbers, bogus docs, incorrect past due fees and interest rate that was almost doubled of my existing loan and a cashout amount never  paid . I was sure my attorney would say  lets get them. But I was completely floored when he said.. well how much have I lost? I had not paid that first payment yet, so I had not really suffered damages. I had not lost my house  , had not paid them money, and  was stuck with the terms.  I had to pay him over $10000  to get me out of the deal , which did nothing but call off the dogs long enough to get the place sold.

I reported it to every entity I could and never once even got an acknowledgement.  I have just recently reported it to the FBI as they are handling the predatory lender scams and  they are  also involved in a multi agency investigation for the  foreclosure scams.  After this nightmare was over, and not in any way was justice served, the next home which my exfiancee and I purchased, was  yet another scumbag lender , Long Beach Mortgage, and Washington Mutual, and it appears we are in the group which they now are saying on the news may have been involved in robosigner and unlawful foreclosures done by the foreclosure one stop shopping companies who facilitated Chase in pushing through thousands of foreclosures with out proper documentation and unlawful claims of documents in possession.  I would love to particiapte in any lawsuits against Tribeca these people are nothing short of  criminals whom are looking a lot like organized crime.  Perhaps someone can post a link for joining a suit since we are not allowed to leave contact info here. Venting helps but we need a way to utilize the other voctims willing to band together

I AM SOOOOOOOOOOO WANTING TO GET THESE PEOPLE. THEY TOOK OUR LIVES, OUR MEMORIES OUR SANITY AND ALMOST OUR MARRIAGE AND MY LIFE. PLEASE LET ME KNOW WHAT THE PROCESS IS TO GET INFORMATION TO ONE ANOTHER. MAYBE THE PRESIDENT..... LET HIM SEE HOW HIS "HOPE NOW" PROGRAM IS WORKING.....

Unfortunately in this forum I am unable to contact you directly. I have a court date tomorrow and will be thrilled to let my lawyer know that our efforts to inform and include others in this are not going unheard.
