Frederick J Hanna & Associates is killing me!  I have an old credit card that I had an outstanding balance due of roughly $6200.  The account was referred to Frederick J Hanna & Associates and in 2007 I began making monthly payments of $100 on the debt.  To date I have paid over $8000 on the debt and STILL have a balance due of $5100.  I recently lost my job, and although I am unemployed I have continued to make my monthly payments of $100. 

I recently received notice from a potential employer that I was not selected for a vacant position because of the judgment that's on my credit.  With this knowledge I reached out to Hanna's office (3 weeks ago) and requested a settlement (I've previously requested a settlement several times to no avail).  I figured that I could borrow the money to pay the debt off so that it would not block potential employment opportunities.  I called and was told that I could not get a settlement.  I then called back and began to ask questions about my account.  How long have I been paying?  What is my outstanding balance due?  What interest rate am I paying?  I found out that I'm paying 11% interest DAILY.  I requested an itemized history of my account....to date I have not received it.  I've called several times requesting to speak with a manager and the managers are never on duty and no one ever calls you back.  Even if you leave messages in their voicemails.  I need help!! Hanna & Associates is making it difficult for me to survive.  I know that I should have paid the account off before a judgment was placed on it, however I have been dutifully paying on the account for the past 7 years and the end is not in site.  Meanwhile I am continuing to wait for a call from management and my account is still accruing 11% daily interest...uuugghhh...  HELP!!

 There are several details missing and the ones you do have don't make sense.

The FIRST thing you need to do before you do anything else is get a copy of the judgement.  This will have the Judgement Amount.  Your credit report hopefully will list the court it is in and you can contact the Clerk of the Court.  However, I can just about guarantee is not just the $6200 debt, there is probably several hundred dollars of legal and court fees that you are responsible for as well, so you would probably be looking at more like $7,500+.  It will also contain your Interest Rate.

Next, there are specific laws governing the amount of interest they can charge.  Usually it is the Statutory rate but sometimes it can be more.  However, I can not see any judge allowing 11% per day..per year okay, even per month would be an outside chance..but per day no.  Because if you truly did have an 11% rate per day as a rough estimate you would have well over 20,000/month in Interest.

Then get a record of all of your payments(hopefully you have proof in the forms of a canceled check).  Then look for an Amortization Calculator.  This should give you a breakdown based on the initial amount and what you have paid how much you should have left.  If the numbers don't match up it may be time to talk to an attorney to help you fight these people.

If by chance you don't have any proof of payment, it may again take a lawyer for them to give you what they have...but you better hope that they have correct records of you may be out of luck.

You need to get an attorney right away to help you communicate with these debt collectors. There is no way you are paying 11% interest daily. It is more probably 11% per year (per annum) but the interest accrues on the balance daily. That is a whole different thing from paying 11% daily.

If in fact you are paying that much interest, then you would be entitled to some sort of refund. But you will have to fight for it legally with an attorney that represents you. Get a consumer attorney (not a creditors attorney) to help you.

Before you get an attorney, look up the original judgment that was filed against you and get whatever payment records you have for each payment you have made on the debt. Then look up what the statutory rate of interest is in your state for interest on judgments. Creditors can't just charge what they feel like charging, it is a mandated rate by each state. The more facts you have with you when you retain an attorney to help you, the more productive your meeting will be with your attorney.

By the way, most judgments last 20 years or ten years with the right to renew for another ten years. So take care of this sooner rather than later. It will be much better for you in the long run.
