The fury catamaran key west is a large water sports adventure company with several locations. The fury was partially responsible for the going under of my wife and i business. In key west some businesses control the island by their many promotion booths(which nobody else can get) or their monopoly of concierge staff around island. After getting us out of the slip they wanted the fury knowing they couldnt get an occupational license for a boat the size they brought in decided to sneak the boat into our old slip(0 duval) on a sunday when nibody was around. After filing complaint with city over business running without a license i was totally ignored. after a little research one of its owners an attorney in town witn connections has his friends in the city who choose to support his illegal operating without a license. its such a pitty companys are allowed to practice business but key west is a place with a long history of corruption so nothing surprises me. i understand a local paper is going to expose this illegal operating without license which i will post. it will be interesting after its exposed if city officials will enforce its removal at this location. I also understand the city code enforcement officer john jones who i also reported it to was arrested in key west friday for getting one business owner a co license to open his business before all inspections were complete. hes also not authorised to hand they out anyway.

With all these claims about Fury, you would think something could be found on the internet other than Robert Krutko's diatribes.

I Google searched Robert's claims and all I could find were the poorly written, almost unintelligable, reports that Robert wrote.

I logged on to the Monroe County, FL Clerk of Courts website and did a search for Fury under both Civil and Criminal actions.  Not to my surpirse, there were no such filings against Fury. 

What say you Robert?  Are we trying to discredit you?  Are we the liars?  Are we all friends here and are trying to cover up the truth?  If any of that is true, please explain why public record is absent of the so-called charges you say are filed against Fury?  Good luck explaining that one.

Do you mind explaining exactly what they were "busted" for?  All I see is a city issue with parking spaces.  Wow!  Give the owner the chair!

Tell us why you FAILED to update the Coast Guard Documentation Center after you purchased your boat? You remember that boat don't you? The one where you owed over $65 THOUSAND in dockage and service fees.

You know, the boat that was not anchored properly and was drifting towards someone's private dock? The one that when authorities contacted the USCC to determine the OWNER of the vessel the CC reported the outfit you purchased it from?

It's all in the OFFICIAL COURT filings from Federal District Court in the lawsuit you LOST-awarding Ocean Keys Resort over $65 thousand.

Gee, maybe you'd like to explain why Judge Martinez called some of your evidentiary documents "highly suspicious" and WARNED YOU about the rules of the court?

I'm only going to say this once and then I'm outta here. You're not worth my time. I'm only responding because you were so childish as to call me an idiot.

Fury has succeeded for MANY years. You FAILED! Bottom line. No permit issue at one dock in one hotel could be the reason for the success of a company that exists in several countries. A company succeeds because of it's reputation, clean boats, and favorable reviews. So yes, it IS about the boat ride. It doesn't take the head cashier at Wal Mart to figure that out.

In case that still doesn't make sense to you, my group alone had 12 people who will recommend Fury to anyone visiting Key West. Customers don't give a crap about city permits, which by the way, Fury DOES have. It's called Business 101. Perhaps you should take a few classes.

I know very little about your failed business, and I really don't care, but your downright childish behavior and name calling probably explains EXACTLY why you are a failure.

Good job Fury on producing a good product! I'm sure Key West is a better place with this Robert clown.

As everyone can see this isnt about if the boat ride was good or not and yes we know that was an employee response. As per the comment made most business owners and people in general who have to obey laws and are not above the law and able to operate illegally wont support a business like this. This clown has city officials in his back pocket and as ive said he couldnt be successful if it wasnt for his partner Halpern and being able to operate illegally. Lets face it how many people are stupid enough to tell a state agency their illegal florating docks are registered vessels and expect them to believe it? Next time he might want to check with his partner before making a stupid comment like that.

As ive said before its not about the boat ride its about being able to operate a business in location thats illegal for any other businesses except theirs. Oh yes and an idiot who tries to make a statement that floating docks are registered vessels owns an accounting firm, could you immagine that. Then he tries to build buildings in the same location which he was busted for no permits, I almost forgot all the extra vessels he also brought in were illegal and yes the state cought him on that also. Sounds like a great company to support.

what else will Scott Saunders try next maybe an amusement park on the pier with no permits?


and while all this was going on, the hotel and fury tried to tell the state no extra vessels or violations were there and i was making complaints that didnt exist, to bad the investigators cought them in action. Oh yes and the platform they tried to say was being used for repairs on the pier that was just replaced by hurricane dammage, good try again state officials saw it being used for loading boats. Wake up scott the state officials are not the same idiot local officials your used to dealing with in key west.


Lets not forget the fines and violations hotel marina were written up for...

Loved Fury

As I reported a few months ago, I was booked, along with a party of 12 friends and family, on the Fury. I very highly recommend Fury to anyone considering a water excursion. The crew was professional and knowledgable, and the boat was beautiful. We had a great time.

I highly doubt a permitting issue had anything to do with Fury's success. They have been around for a long time. In fact, I sailed with them many years ago in Cozumel, Mexico.

In response to the authors last update, I truely believe he has a personal issue with Fury stemming from his failed business endeavor. It's become apparant he is not a ripped-off customer of Fury's, but a beaten competitor. Failing at your business is hardly a legitimate reason to file rip-offs on competitors, and the rest of Key West for that matter. I've noticed countless exaggerated reports originating from Robert in Columbus, OH.

Good try scott but everyone can see the only way your company got big was because city officials allow you to break laws and operate where others cannot go. for those reading the city officials have allowed certain businesses different sets of laws than others. scott saunders is one of those businesses. i had a 49 passenger tour boat in the exact same slip he is in now. the city stopped me by saying i was allowed only 24 passengers due to parking ordinances in the area. scott saunders pulls his boat in the same slip with 3x time passenger ratio and none of the parking ordinance laws changed. So yes if us common people could operate in areas where we were allowed to break the laws and have many more passengers we would all be big. as far as the post above, one of the fury bubbas tried to make me look bad saying the galleon didnt have anything to do with this. Thats true but if you read the story scott saunders partner and man who pulls his puppet strings attorney halpern is the gentleman who represented the galleon. take a look at the article and see what he did for this group that operated years without licenses for rooms. As you see he goes behind closed doors with city officials and you see the results. Also saunders and his company knew the parking rule and it was illegal to bring a boat this size into the slip so what did he do, he snuck his boat in on a sunday and operated a while without a license only to find out us concerned citizens were taking pictures and turned him in, now if anyone else did this the city would be down your throat and make you leave immediately ,not scott they allowed him his license with open arms. then he tried to operate with extra boats under the radar and was cought by state officals doing that. the only sad thing is for a while john jones (city code enforcement) and ocean key resort were lying on record saying no extra boats were there. the sad part is all this time of lying the state and concerned citizens were there documenting and photographing and knew what was going on. After the state called ocean key resort management in (and fined them) they come clean saying extra boats were operating out of there. and yes the numerous jet skis the fury had there were also illegal and were not on occupational license. Oh and lets not forget the storage building they were also cought building without a license. did i forget to mention the platform they built for loading boats, the hotel tried to tell the state it was a platform built to repair and work on the pier. and yes another state agency official was there after that seeing it used for loading their boats. so as you can see, yes who couldnt be big being allowed by city officials (like john jones who was just arrested by state officials for signing business licenses he wasnt allowed to) to operate out of the bounds of the law. As far as the other idiots posting on here they are employees of the fury and are on here because scott is their puppet master pulling their strings. Scott did i forget the stunt you tried to pull with the illegal floating docks, this man thought he was dealing with key west officials when he tried to tell state officials the floating docks were registered vessel with florida fl numbers. the only problem was the investigator hounded him for several days finally demanding the numbers and scott tells him oops you misunderstood me. Then the hotel/marina manager calls the state asking them if the floating docks had to be moved. They were hoping to hear the state say WHY OF COURSE NOT MR SAUNDERS YOU ARE ALLOWED TO BE ABOVE THE LAW IN KEY WEST WE THINK THE SAME SHOULD APPILY WITH US... This guy is way to funny. next he may try bringing in another big catamaran telling them its a farris wheel for his carnival. I understand the state investigators were down in key west two weeks ago and photographed and documented the marina area i will post what happened this week when i find out. oh yes and for scotts ignorant comments about my company oweing money and going under its funny how last week the state of florida has went on record saying the hotels taking of yacht under state statute 328.17 was illegal/theft. yes this clown has been saying i owed money, show me the lease where i owed money scott. Im showing you where the state says what the hotel did was illegal/theft.

As per our conversation it is my understanding as a marina if you try and use the statute 328.17 you must hold and be in possession at all times. If the boat you are claiming owes you money leaves for any reason you cannot claim the statute and do a non judicial sale correct? At that point as a marina I would have a civil matter claiming back rent owed? And as you mentioned if the vessel leaves for any reason we as a marina would not be able to go get it and bring it back to our possession under the statute because that would be theft correct? So to sum it up as a marina I would need to hold vessel there to claim statute then follow guidelines to do a non judicial sale? if not we cannot go get yacht then bring it back and sell it under the statute. Thanks again and please let me know if the above is a correct assessment of the law.

You are correct in all that you stated. I apologize for not emailing you yesterday like I said that I would. The only thing is the P.S. is incorrect. If the boat leaves your possession for any reason, that then becomes a civil matter and you would have to get a court to say that you can go get the vessel. this is another example of a company in key west that is allowed to be above the law the only thing is they hired an idiot to go steal yacht. this same idiot told police he owned yacht. he then lied to a US Navy man who was on the scene and wittnessed it also. common sense says if what your doing is legal you wouldnt have to lie about it right????? i would have to ask you scott saunders what part of T-H-E-F-T in the states letter above dont you understand?

Bob from Ohio wastes a lot of the readers time in writing mis-facts and lies about our company. Bob fails to provide the facts about the company he says Fury put out of business. He neglects to inform the reader that he was evicted from the the Marina for non-payment of his dock lease (over 10 months in arrears). In addition numerous complaints where made about his equipment and staff during the short period that he did operate. He just can't accept responsiblility for his failure as a business man, wold rather blame someone else.

I read this with interest because I am booked on Fury for an upcoming trip to Key West. There are 12 of us going. But the more I read it, the more I'm confused on how there is a rip-off here. This sounds like everyday business in any city. There's really no news here and no reason to avoid Fury Catamarans.

Just to be sure, I checked up on Fury. Everything is in order with them and their reviews are great.

The author of this report sounds more like a governmental conspiracy theorist than a victim of any scam. I agree with Michael that this is some sort of a personal issue. Perhaps there are better ways of handling personal vendettas.

The Galleon is a totally separate resort and has nothing to do with Fury. His complaint just totally changed topics. Does Robert have a problem with Fury or the entire Florida Keys? And once again, this story is being run by a local tabloid that locals only read for entertainment, not our newspaper.

one owner of this so called great company is Michael Halpern he is a local attorney with quite a reputation. here is a copy of a story run in the local key west news paper notice the name halpern and what he does...

The Galleon Settlement:
A Case History Of Incompetence and Corruption
WHEN CODE ENFORCEMENT OFFICER JIM YOUNG STARTED GETTING TOO CLOSE TO THE TRUTH, AVAEL FIRED HIM AND TOOK OVER THE CASE HIMSELF. AND, UNDER HIS MANAGEMENT, THE CITY ROLLED OVER AND SPREAD ITS LEGS.

The agreement signed last week by City officials to settle the long-running Code Enforcement action against the Galleon Resort was a classic case of, at least, incompetence on the part of City staff. And there was probably a tad of corruption mixed in there, too. Well, maybe more than a tad.

This was, in essence, a very simple case, with a lot of obfuscation. The management of the Galleon Resort has been licensed since the 1980s to rent out 96 units. But they have been renting out 122. Thats against the law.
But they might never have ever been caught had the contractor who managed the deli and pool bar not tried to sell that contract. In April of 2005, the contractor had a potential buyer, but he had some questions about the liquor license. The license in place required that the resort have at least 120 units.

But, reportedly, something seemed funny to the attorney representing the potential buyer, so he asked the State bureau of Alcohol, Beverage and Tobacco (ABT) to assure him that everything was on the up-and-up. To do that, ABT investigators came down to do a room count.
As part of that investigation, the ABT people contacted Jim Young, who, at that time, headed the Citys Code Enforcement operation. Uh-oh. Young met with the Galleon manager, who readily told him that the resort had 122 units and even gave Young a brochure that said the Galleon had 122 rooms. Apparently, they had been renting the illegal rooms so long that the manager had probably forgotten that they were illegal.
Young cited the Galleon for renting 20 units without a license. In addition, it was determined that the Galleon had several illegal cave units small rooms, without windows, that had apparently been converted from storage closets. These rooms were reportedly being rented to employees.

Several hearings were scheduled before Special Master Jeff Overby. It was not going to be pretty. After all, these people had allegedly been renting some of these unlicensed rooms for 20 years!

But Michael Halpern, the Galleons longtime attorney, was able to have hearings repeatedly continued. Finally, Overby set a hearing for October 18, 2006, and put Halpern on notice that there would be no more continuances.
In the meantime, Young and Assistant City Attorney Kevin Hoyes had reportedly put together a well-documented case. Perhaps too well-documented for Attorney Halperns taste.

Something obviously had to be done to get Code Enforcement off the backs of Galleon management.
So, it was just about this time, probably by pure coincidence, that City Commissioners Harry Bethel and Danny Kolhage decided it was time to speak out at a City Commission meeting. They said they had received stacks of complaints about the gestapo tactics of Code Enforcement although, when asked, neither Bethel nor Kolhage could produce even one complaint. Well, actually, Bethel could produce one. Young had dared to cite one of Bethels sons projects.
Then, Halpern threatened to sue the City for $5 million. That set the stage for City Manager Julio Avael to send a one-sentence email to Joe April, the Citys Building Official, on October 5, 2006. At that time, April was also Youngs boss.
Heres what the email said: Lets postpone the Galleon case until I can mediate this situation.

In essence, what Avael did on the eve of the big hearing before Overby was to stop cold all action on the Code Enforcement case against the Galleon. But he did more than that. He took over the case personally, removing Jim Young and Joe April from any further involvement.

Eight days later, Avael fired Young and moved April over to the Engineering Department. Keep in mind that, earlier in the year, when the Mayor and some City Commissioners seemed to ready to fire Julio, it was Halpern who had stepped in to represent Julio at no charge. Julio was obligated to Halpern.

Keep in mind, too, that Julio was already unhappy with Joe April. April was the guy who, back in February of 2006, had refused to sign the certificate of occupancy for the new Rum Barrel Restaurant because, he said, there were still problems with the elevator and the electrical system. So Assistant City Manager John Jones signed it.

Two weeks ago, Jones was arrested for impersonating a licensed building inspector. But investigators from the State Department of Business & Professional Regulation (DBPR) think that City Manager Avael coerced Jones into signing the document. After all, it is well known that Julio and Pat Croce, one of the owners of the Rum Barrel, are personal friends.
When Croce was trying to get Code Enforcement to back off on trying to make him comply to the Citys sign ordinance (he had too many signs), he sent Julio an email asking him to intercede. In that email, he addressed Julio as El Jefe.
Subsequently, Code Enforcement got the word: Back off of the Rum Barrel. Go figure. Last December, DBPR investigators actually cited Avael for alleged coercion. He has not been arrested, but the investigation remains ongoing, according to a spokesman in the State Attorneys Office.
Based on what you now know, are you surprised that the Citys settlement basically, Avaels settlement; the City Commission cant vote on it is a softball settlement? Galleon management did not have to admit any wrongdoing or pay any fines. And 20 of the previously-illegal units were legalized under the settlement.

Under Julio Avaels management of this case, the City just rolled over and spread its legs. We dont know whether or not Julio attended the mediation meetings, the meetings where the settlement deal was negotiated. But if he did, we suspect that he probably sat over on the Galleon side of the table, next to Halpern.
Galleon management did agree to remove 12 units and pay $300,000 into an affordable housing trust fund. Those 12 units were reportedly built below the flood plain and, sooner or later, would have probably been discovered by FEMA anyway.

One source estimated that this deal cost the City taxpayers about $500,000 in terms of attorneys fees and waived fines. But so what? The Mayor and City Commissioners humiliated Avael by refusing to renew his multi-year contract. But they gave him that stupid him in office for another year to pull this kind of crap! Do you think, at this point, that he gives a rats a*s about City of Key West taxpayer money?

Last Tuesday evening, at the City Commission meeting, the Mayor and Commissioners approved a deal that will remove Julio from office, perhaps as early as mid-June, or as soon as a new City Manager is hired. He will still be on the payroll as a consultant to the new manager until November. But, hopefully, this arrangement will inhibit his ability to inflict much more damage.

It must be noted, however, as Julis separation package was being discussed Tuesday evening, Commissioners Bethel and Kolhage were falling all over themselves to ensure that Julio got as much going away money as City personnel policies would allow. And some not allowed by City personnel policies.
Were not going to bore you with a long history of the Galleon case, but you might be interested in the following tidbits:

Back in September 1983, the Citys Chief Building Official, James Elwood, wrote Attorney Halpern a letter expressing concern that plans for the Galleon showed a footprint considerably over the allowable gross square footage. In his letter, Elwood also referred to the number of units planned: 96, not 122.

Attached to that letter were some notes and calculations attributed to Paul Cates, the former Building Official. Those notes also referred to 96 units, not 122.

But despite this evidence, Halpern told City Attorney Shawn Smith that, if this case ever went to trial, he was prepared to bring in Elwood and Cates as witnesses to swear that the original plans approved by the City showed 122 units, not 96.

Well, in this case, all the City lawyers would have to do is show the judge the original plans, right? Right. Except that there is one small problem: Incredibly, the original plans have gone missing!

Turns out, no big deal!

I did a little research into this. I am no longer speaking on behalf of Fury, but as someone who has knowledge of this. Fury Catamarans does posess all the required licenses and permits required by law. Robert made it sound as though Fury was operating without a license. This was a severe embellishment.

Truth is, Fury did not obtain a license to operate out of that specific location. In other words, they did not obtain a required permit to run out of that dock. This permit has nothing to do with their operating license. And, not obtaining it is no big deal. The fine imposed by the city was a whopping $170.00 and the Fury has since obtained the permit. There was no malice or ill-intent on behalf of Fury.

This did not effect anyone. There has been no rip-off or scam here and this type of complaint is not what this website is for. The manner in which Robert titled his update speaks for itself and enlightens everyone to his character. Robert has a personal vendetta against Ocean Key House and Fury because of his failed business.

First of all that rebuttal is a lie. The city not only allowed the business to sneak in with no license it took several weeks of complaining to get the to do anything about it. Below is a copy of an email by carolyn walker to the city attorney explaining the fury getting caught without a license.

When I was employed there, we endured annual inspections by the City of Key West and the U.S. Coast Guard. I know those inspections have not gone away.

The originator of this complaint attempted to start his own business running a dive boat out of the Ocean Key House in Key West. I fully support free enterprise. But he was going up against well established, and long time Key West businesses such as Fury, Sebago, and Sunset. He lost his boat when he defaulted on a lease with Ocean Key House. Since then he has made it his personal quest to flood the internet with diatribes about (deep breath) Ocean Key House, Noble House, FWC, Sheriff's Office, State's Attorneys, Code Enforcement, State Wildlife, Agriculture, Global Warming, Governor Crist, USCG, Sebago, Fury, etc.

The local paper he speaks of is Key West, The Newspaper. It is a free weekly periodical known for it's half-truths and controversial reporting. The reputable daily paper, The Citizen, has yet to accept any of his stories as truthful or newsworthy.

In truth, the claims he makes against Fury apply more to him. His vessel, I believe it was called Reef Cat, was never properly registered. On paper the vessel belonged to a marina in Key Largo. But, he never registered the vessel with the State or obtained the required licenses to operate the business. Now, when his business has failed, he wants to make frivolous and baseless claims about the larger companies. Furthermore, the failure of his business is, in his mind, the fault of everyone else but his.
