Gail Ferenc Failure to refund real estate deposit on property with issues Dunedin Florida

Signed a contract to purchase a home at 131 Woodette Dr Dunedin Florida...wired Mrs Ferenc a $10,000 deposit for said property. Upon inspection, many issues were found...3 rotted decks, two expensive windows were rotted and had deal leaks, multiple electrical issues, central AC unit in disrepair...a very long list totaling over $20,000.

We were told the home was being sold as is and no repairs or cash discount were offered. We understandably backed out within a two week grace period under Florida RE law. Mrs Ferenc refused to refund our deposit stating it was a hard money deposit ( something she concocted) after a lawyer friend tried to reason with her to no avail ..he wasn't a Florida attorney and Mrs Ferenc refused to deal with him....I then was forced to hire an attorney who practiced in Florida.

After weeks of correspondence to no avail, my attorney had to threaten mediation and trial...I believe Mrs Ferenc then sought council who advised her to release the deposit. This unscrupulous woman has put me and my fiance through hell...I'm lucky it's over but I am afraid she might try the same to others since she is desperate to sell her damaged property...I will forward anyone the inspection report if desired.
