I've made three payments now to SallieMae/General Revenue Corporation, but despite this fact, they've attempted to contact my employer, and they've threatened to sue him if he doesn't comply with wage garnishment. Of course, I've tendered my two weeks' notice; I can't continue in a job with that sort of embarrassment looming over my head. But how can I ensure that they won't do this to me at my next job?

The first question I have to ask, is what the current balance is on your loan. Payments on a defaulted student loan have to be deemed reasonable to the size of the loan. This means, that if you have a $50,000 loan, a $25 payment is far from acceptable. If you're not making reasonable payments on the account, they can still garnish up to 15% of your disposable income. Also, what does your previous payment history look like? Payment history speaks volumes regarding the potential for future payment, and quite honestly, they may not believe that you're capable of maintaining a payment agreement.

Your employer is legally required to garnish your wages once an order has been issued. If they fail to comply, they could be held responsible for the balance on your loan. Since you've left your job, you need to be aware that the garnishment will follow you. It will probably take some time, but if you're not paying, the garnishment department has the resources to determine where you're currently employed.

My suggestions to prevent further garnishment, is to obviously contact the company and start paying your loan. You're not a victim here -- this is simply the consequence of a default student loan. Remember, when you signed your promissory note, you agreed that if and when the loan defaulted, the balance would accelerate to being due in full. This means that any payment arrangement GRC offers you is a courtesy -- not a requirement. Your total balance is due. Today.

Ask if you qualify for the loan rehabilitation program. If not, try the William D. Ford consolidation program.

I worked for GRC for a while. If the information on you changes such as address, phone number, or place of employment changes they can find out what it is. I personally spent whole days calling different leads on new possible places of employment for people in the system. By the way, the person that is assigned your file gets a bonus check if they get their required number of "legals" for the month. That is all the files that get accepted for the possibility of litigation. Someone will be working on finding your new place of employment. They can't necessarily contact you personally there, but they can call to verify employment.
