We have a leased car from GMAC since 07. We lost our jobs and had money problems so we contacted them for payment arrangements. Lady said you can defer two months of payments. So we said yes and she said I put a notice on your account. We ended up filing chapter 7 and told them we needed to keep the car.

So two months after the deferment process we started paying again. Then we get a call acouple weeks ago asking what we are planning to do. I said we are keeping the car,he goes you are months behind for payments. Nope we defered payments,he goes there is no such thing? Well a lady took care of us and she knew what was going on. This was a month before chapter 7. He sticks to his word. Then goes lets setup payment arrangements. I will give you to monday to think about it and I will call you back. That was on a Friday and monday rolled around and never heard anything. I called his phone line and left a voicemail and it was his name so it was his line only. Detailed message saying I was sending payments he requested.

A week goes by and we hear nothing then this past Tuesday a tow truck is taking the car away. I call him right away and he said I never heard anything from you and I tried to call you. I said I left you a message and first off my mom is home with the baby 24/7 and answering machine works. He still claims he called.. i go then what happen to our money,oh i refused it and sent it back as I thought it was wrong to take your money and your car. Well he never gave me a dead line and it has not even been 60 days.. But yet him and his manager think its no big deal and its funny we can't afford $400.00 plus what they claim we owe to get the car out of the repo. We have called this guy five times and he feeds us BS more and more.

Then all of a sudden he sees we have a deferment notice to the account and goes did you ever send paperwork saying you wanted to keep this car. Yep we did then after 15mins of talking to him he goes okay here's that paperwork. Where's the rest at? There is no paperwork from the deferment process,we were never sent any and were told it was taken care of. He goes I mailed them out? But yet you never heard of this process before and never saw anything under the account until after 5 phone calls.. We never got anything and we have never gotten any lost paperwork in the mail yet,so what are the chances of this being lost? The claims department goes well if you would have paid your bill you would not have this problem. We have been nothing but nice to these people and they are very rude. Then the lady states you can't file a claim on a lease car,well several people in different departments sent me to this number. So we have been wrongfully charged with a repossesion!
