GMAC Mortgage purchased our mortgage from another company with whom we had a written agreement to pay our own taxes (in lieu of paying them in escrow). Although we had never been late with a payment the company commenced foreclosure, added several thousand dollars in costs to our mortgage balance, and took the position that if we didn't like their change in our agreement we could bring suit. This has got to be America's most disreputable mortgage company and I recommend mortgagors to do business with them only at substantial risk.

Renee from Atlanta GA - I was wondering how you were doing with your case. Also has anyone heard from Joe? Is his case done? I know it gets tiring, but I was looking for a little help. Perhaps everyone has moved on, given the circumstances.

Did you file suit against them. Go into the Courthouse and request to file a complaint against GMAC. The courtclerk should be able to assist you with the paperwork. If GMAC files foreclosure papers against you, file a counterclaim with your Answer. I would like to know what happened to the female in Virginia giving advice regarding jury trial.

I am experiencing foreclosure with GMAC because they did not acknowledge the monthly payments I was making. I forwarded the money orders front and back but they just filed foreclosure papers.

ok renee i hope you have the $12 gs thats its going to cost to go to court. my case started in 2003 and ended in 2007 with me losing.now i have a bill form the foreclosure attorney asking me for her fees. you can not will against these companys they lie and hide the true facts and i know this as i have the disclosure details that they sent to the court and my attorny the dirt bag hide form me it seems gmac keeps two sets of records one they send you and one they send to the courts all i can say is pass the word to everyone dont do bussiness with gmac or any of their other sub companies ditex,homecommings etc

Hello -

You may have already gotten your Notice of Foreclosure but I have a few questions:


- Where you live is it a non-judicial state or a judicial state...meaning - for them to foreclose on your home...do you have to go to court first...or do they sell it on the court house steps?

- Did you get your deposition notice yet? Meaning did a sherrif come to your door and serve you papers?

I am going to give you both things:

1. If your state is non-judicial...go to court! But you file a compliant/answer at the time you get the court paperwork. Explain that you deny the allegations against you and demand a jury trial....this will stop them from going through with the process temporarily. DEMAND that they produce the original mortgage note and contract...only the holder in due course can enforce the security deed.
The individual must have BOTH the mortgage note and security deed. Most of the times...they don't have it and then you can state to the judge that this may not be the proper party before the bench trying to execute the security deed.

If the person that is MERS (mortgage electronic registration system) is the one that is attempting to execute the security deed and foreclosure...DEFINATELY...tell the judge that MERS has no beneficial interest and CAN NOT enforce the security deed.

2. If you haven't gotten your Notice of Foreclosure from an attorney yet...when it comes...DISPUTE IT when you get the collection letter, demand they disclose the true holder of the note...and tell them to verify the debt showing the RISK/LOSS that the lender alleges they gave as consideration for the security deed (putting the lien on your home)

3. If you are in a state that is non-judicial...and they just sell the home on the courthouse steps...you need to wait for the sherrif to arrive at your home with the deposition notice. YOU HAVE 7 DAYS to answer that notice. It will have a case number to the left at the top....use that number and answer it back...DISPUTING the foreclose. (File that in court). This will stop the sherrif from coming back and kicking you out of your home.

Make sure when you answer it back you but " DEMAND A JURY TRIAL" at the top right as well.

The court will set a court date and you will appear in court...WHATEVER YOU DO...if you are not there in court to start selecting jurors...then you make sure you have:

1- a court reporter in the court room - to type everything you say
2- ALL you say is I object - I requested a jury trial
3- If you do say anything...state that you are not guilty of the allegations and you demand a jury trial.

The minute you start answering the judges questions...he will rule against you through a bench trial. This court system is CORRUPT the judges and attorneys work together...

Why a jury trial...they are people just like you and I and they are going through the same thing you are going through. The attorneys know that it's unlike they will win...when it comes to these predatory mortgage companies.

Don't let them steal your home...fight...but you must fight fire with fire...
