I was promised a cruise for attending a sales presentation of Goldrush Getaways. I purchased their membership that evening. I went on line to register for the cruise, but nothing happened. I called Goldrush and talked to Michael Hartshorn. He said he would look into it and get back to me. He never did. I called him again, and again he said he would look into it and get back to me. He never did.

At the sales presentation I was told that I could travel and cruises at a much reduced price by using my membership in Goldrush. When I called them to book a cruise I was told that I had to get a CLIA card to get the discount.

I went through a lot of hassle and more expense to get the CLIA card and then called Goldrush again to book a cruise. The woman I talked to said I was supposed to do that myself, but that she would help me just that one time. At the sales presentation I was told that I could book it myself or they would book it for me.

She then told me that to book a cruise at a discount, I had to book four rooms. I was not told that at the meeting nor is it in the contract.

I called later and tried to book a cruise again. This time I was told that the cruise line was not accepting bookings from agents yet. I was told to call again in a month.

I called each month for three months and was told each time that the cruise line wasn't accepting bookings from agents yet. Finally when I got this answer in May I stopped calling because our plans had to be made for an August cruise.

On September 7, 2008, I wrote a letter to Brian Carr, the president of Goldrush Getaways, asking that my money be returned because I had recieved none of the benefits the company said I would get.

Brian Carr answered my letter on September 11 saying that my money would not be refunded. He said that Michael Hartshorn called me and gave me the information I needed to get the free cruise, but he never called me.

NOTICE OF ENTRY OF JUDGEMENT -     This matter came on regularly for hearing on January 15, 2010 at 1:30pm in Department 86 with COMMISSIONER RUSS DETRICK presiding.

Judgement was entered on January 15, 2010, as follows,

The Defendant, MICHAEL HARTSHORN, DBA - GOLDRUSH GETAWAYS was dismissed without prejudice.

The Defendant BRIAN CARR, DBA - GOLDRUSHGETAWAYS does not owe the plaintiff PAM RAMSEY any money/property on Plaintiff's claim.

Ms. Ramsey did in fact receive her free gift for attending our sales presentation where she knowlingly purchased a membership in Goldrush Getaways.

Ms. Ramsey did not follow the directions for obtaining her complimentary cruise. She maintains she did follow the directions and nothing happened. That nothing happened should have been a clue. Ms. Ramsey joined on January 8, 2008. She contacted Mr. Michael Hartshorn on or about March 18, 2008. Mr. Hartshorn offered to assist her and contact the cruise fulfillment company. This free gift is separate from Ms. Ramsey's membership in Goldrush Getaways.

The fulfillment company responded to Mr. Hartshorn to advise him they contacted Ms. Ramsey. The fulfillment company offered to reinstate her request if she could provide evidence of the money order required to satisfy the taxes of the cruise and the certified mail receipt. Both of these items are laid out in the instructions. The procedure for applying for the cruise is also very time sensitive.

Ms. Ramsey agreed to provide the information. To date neither the fulfillment company nor Goldrush Getaways has received evidence that the instructions were followed in order for Ms. Ramsey's request to be fulfilled.

Even after Ms. Ramsey complained about her cruise request not being fulfilled (sans proof) to the LABBB and the local TV station, Mr. Hartshorn offered to reinstate her request and step her through the process. Ms. Ramsey refused the offer of assistance and instead just asked for her money back. That request was made in September of 2008, ten months affter joining Goldrush Getaways. To reiterate, as I did with Ms. Ramsey, the free gift is separate from the membership.

Ms. Ramsey's understanding of the membership and how it works is addressed in our ongoing slate of classes. This is one of the benefits of membership through Goldrush Getaways. Ms. Ramsey's profile reflects she attended no training. Our trainers are very thorough in advising the benefits of membership and how they are best used. There are many ways to save on your travel through the membership. Goldrush Getaways does a commission split with our members on any retail travel booked through the agency. In addition, we have many specially negotiated familiarization trips (FAMs) and Seminars-at-sea. Members have access to wholesale condominium weeks and "Hot Weeks" condominium rentals.

Travel Industry courtesies are at the discretion of the travel vendor. They are not a right of membership. They are a privilege. The criteria is laid out by the individual vendor. For those members that wish to pursue the credentials of a travel professional, Goldrush Getaways provides guidance and assistance to attain that status. In fact, we encourage this productive behavior. As the sales increase for the entire agency, so do the benefits that come with increased sales (better commissions, more industry opportunities for individual agents). It is not a requirement of membership that members possess an industry recognition card to receive the benefits of membership.

In October of 2008, the LABBB closed the matter regarding Ms. Ramsey, satisfied that we had responded in a timely fashion and addressed Ms. Ramsey's concerns.

In addition, the local TV station contacted us and we repsonded to them in a timely fashion. The TV station said they would advise Ms. Ramsey to pursue the matter through small claims court. I advised the TV station that our answer would remain the same. That was in October of 2008 as well.

On January 6, 2009 the agency received a letter from Ms. Ramsey cancelling her membership to avoid incurring any further dues.

As a final "olive branch" Goldrush Getaways will offer Ms. Ramsey a one year waiver of the annual dues and reinstate her so she can take the extra time to learn about the benefits of membership.
