My husband and myself quit Gold's Gym in 2009. They stopped taking money out of my account like they were supposed to and never heard from them again. I was checking my account to make sure it is all ok and I notice I have $1.00 in it. Gold's gym took $332.89 out of my account 3 years after we had quit.

I assumed it was a mistake so I called them to have it put back. They said I quit but my husband never did. They said they forgot to bill him after all this time. They didn't forget they didn't take it out because we quit the gym. They said I have to prove that he quit and was extremely rude. I unfortunatley only keep that kind of stuff a couple years and do not have that paperwork to prove it. That is exactly what they are counting on, you don't have your paperwork.

How can they reach into your checking account especially after that long without permision and not give you notice or a letter. We know for a fact we quit and the proof is that they quit billing us. If anyone wants to get a class action lawsuit together count me in. I have disputed it with my bank but it will be a while before I know anything.

I have no way of knowing the person who wrote this complaint, but I would like to contact you. I just filed a similar complaint about the same O'Fallon gym. I had thought of writing to my congressman about them, and it would be nice if you would join me in that. When I was in the Army many years ago I saw Generals turn positively blue in the face when they got a letter on their desk saying "Congressional Investigation" on it. I think it's time the manager of Gold's Gym got the same treatment.

Unfortunately the owners of this website have provided no means of us contacting each other and even says specifically not to write our names or email addresses in our messages. What I can do though is to tell you that I own a window cleaning company in Belleville called We Do Windows. If you look the name up in the phone book you can contact me at that number. I'm the only one who will answer.

Thanks.

You need to go higher

If your bank hasn't reversed this transfer yet, you need to press charges, and probably should open a small claims on the bank as well, just to get the ball rolling and establish in the courts the issue.

Contract or not, they have no right to just waltz into your account 3 years down the road and take funds.

Granted, the bank can't know when you've authorized a charge or not, but given the circumstances surrounding this, and the bullcrap Golds itself has documented to you, the bank should be reversing it before New Years.

Contact the state agency overseeing your banks as well. Don't let more time slide with them doing nothing.

Gold's Lost the contract.

I spoke with Gold's gym on 12/29 and the person at their corporate office informed me that they have lost the contract and have no signed copy. They said that I am still obligated to pay them the money I owe them. I asked him isn't it possible that you lost his cancelltion papers as well? He stated that they very well could have, but that means I have no way of proving that I don't owe them. I informed him that actually you have to prove what I owe you more than I have to prove it. You need the contract more than I do after 3 years. Without a signed contract the bank will make their bank refund all of my money. I am not surprised they lost the contract because it proves they had no right to reach their slimy hands into my checking account after all the time. I hope they have to pay someday for the way they steal money from honest hard working people.

They FORGOT to bill him?

What kind of crap is that? They forgot to bill him? Hahahahaha...

YOU need to press fraud charges on them and insist the bank back you up or you'll sue them.

I don't think any civil court will like small claims will find it "reasonable" that the gym "forgot" to bill hubby for almost 3 years and just decided to reach into your bank account using 3 year old authorization.

To me, that's felony theft.

Ripoff Report has info posted somewhere on how to force a bank to give you back money fraudulently removed from your accounts. Follow it.
