Great American Finance Company GAFCO This company starts calling and emailing at 1 day past the due date. I know better than to talk to them in the past they would not let me off of the phone until I give them a date that I will pay, though I do not know when I can pay. Chicago Illinois

These folks are sleazy. It was difficult to get the loan at first, and I wondered about that since my credit score was OK. I found out later they target low-income people with not much education who cannot fight back. I got the loan with them from a furniture company with cheap furniture. Everyone was acting very strangely that day, now I know why.

As of this writing, my loan payment is  25 days past due, and they started the process of wage garnishment already. Yes, you read it right--garnishment. Normally, wage garnishment is done only after a judgment, so when I read the fine print just now, I see that  they had me sign a judgment when I got their dirty loan! I remind you that the payment was 25 days out, 25 days past the due date. That is why I am writing to you, so someone will read this and learn and go somewhere else. These folks want you to default--to forget, or otherwise not be able to pay.

I attempted to pay them on their "website," but could not pay without an $8.00 fee. Their in person fee is also $8.00. I did not try to tell them that poor people cannot afford that fee, because they obviously know that.

I am saying here that, if you think you want to borrow money from these folks, think twice. They are looking for people to exploit. They are most likely psychopaths and have their fun this way. Caveat Emptor.

This rebuttal was obviously written by GAFCO. I do not know the law well enough to answer this definitively, but they either broke the law by pretending to garnish my wages and giving me a fake garnishment form, or there is a law that says I can sign these rights away and they were acting lawfully.. I have their excuse of a contract in front of me, also, and I had to sign off my rights of due process to get the loan. This is why I am warning people who may be poor or cannot get a lawyer, or just think that GAFCO abuse is deserved.

The whole problem is that the loan was not even 30 days past due. They have 6 months before they have to stop trying to collect themselves. They set me up and took this opportunity, and now they are attempting to deflect their true motives.

Of course, I would never use them again, and I am going to report them to any place that will take my report.

For ANY creditor to garnish wages, they must FIRST sue the borrower in court and obtain a judgement.  This judgement contains the ability to garnish wages, attach bank accounts and impose other sanctions.  NO CREDITOR can just go to any employer and demand they be allowed to syphon off the employee's wages without DUE PROCESS!  Either you have ZERO UNDERSTANDING of what is said in the contract...or...you are simply here to make up a bunch of BS because you don't like their collections efforts...collection efforts YOU caused because it was YOU who failed to live up to your obligation.  If the furniture YOU decided to buy is so cheap and terrible, why did you agree to buy it?  Oh I see, it was great furniture when they agreed to sell it to you, before YOU decided to not pay YOUR bills.  Finally, if you are so poor and so uneducated, then perhaps you should be seeking handouts and free furniture.  Bottom line is YOU failed to live up to YOUR promise to make YOUR payments on time and now that they are going after you, YOUR next tactic is to come here and attempt to discredit them with what is nothing more thsn industrial strength BS and a smokescreen to attempt to deflect YOUR deadbeat ways.
