Gunbroker.com Gunbroker seems to have conspired with the Seller and the FFL here in the state of California to take my money from me.

I won an auction on Gunbroker.com from an out-of-state Seller (Sportsman Supply, Butler, PA) and proceeded to arrange for a California based Federal Firearms License holder (Mr. Alex Delgadillo at Firearms Academy, Montebello, CA-who was listed on Gunbroker.com approved list of FFL's in the State of California) to broker the Sale to me.

I thought what happened next was specific to me alone but I've seen the same set of facts in other Rip-Off Reports.

The Seller, knowing that the gun was not California Compliant, shipped it to Mr. Delgadillo at Firearms Academy without updating their shipping information on Gunbroker.com. As far as I knew it had not yet been shipped. It actually arrived on 12/28/2018. The Seller did state on the Listing that the responsibility rested with the Buyer but it also stated that they would NOT ship Non-Compliant guns to states that do not allow their sale.

After several weeks of waiting, I called Mr. Alex Delgadillo at Firearms Academy and was told for several days that he was not in. I finally went down to his place of business three weeks into 01/2019 and discovered that they had received the gun on 12/28/2018.

When I saw that my phone number was listed plainly on the paperwork, I then asked Mr. Delgadillo why he didn't call me.

He said he had no obligation to call me or to do anything with the gun, even though he had accepted the responsibilty for the brokerage by giving me a copy of his FFL license. He was to be paid a Fee for this. I had a contractual right to expect that he would contact me when the gun arrived.

He knew right when the gun arrived on 12/28/2018 that this was NOT a gun that could be brokered in the State of California. He also said I was stupid for ordering an Out-of-State gun. I told him that because he never called me I probably could not not return it for the stated policy of the price paid less a restock charge of 10% because it was not returned in time.

After I left his shop I sent him a nice email through his website asking him to please, please send the gun back to Sportsman Supply so I could try for any kind of a refund. He did not respond to me until I sent him a Demand Letter asking him to pay the amount that I lost because of his actions. He again told me that he had no obligations whatsoever in regards to this transaction.

From reading other Rip-Off Reports it appears to me that the Seller, Gunbroker.com, and Firearms Academy were operating together to lure me to order the wrong gun and then making it impossible to return it in the return time limit.

An indication that this might be happening is that the Seller, Gunbroker.com, and Firearms Academy will NOT RESPOND to any of my emails or phone calls.

TO SUM UP:

Did Sportsman Supply get my purchase money? YES!

Did Gunbroker.com get their commission? YES!

Does Mr. Delgadillo get a gun that's NOT registered in my name? YES!

Can he, legally free and clear, sell it to someone out of state?

I think the saying "Buyer Beware" really applies to these businesses, and people should consider giving their business to Sellers and FFL's with more integrity.
