I happen to know first hand how they rip you all off. I worked there for some time and the stuff that goes on around there would make your jaw drop. Ever since Jeff Schreiber got sued, he fired his wife and made two of his employee's Ed Dial and William Harris the owners. (Joke) that was an easy way out of the list of compliance rules they where forced to comply with. All telephone call are "recorded" until there is a violation.... deleted.... This is what happens and what is suppose to happen.... Mel Schreiber, Suzanne Schreiber and Bill Kwiatek purchase the paper then they place the paper with Jeff Schreiber (still the real owner of Harris & Dial). Supposidly the 1st notice goes out (doubt they waste the money on the postage) 30 days are suppose to go by until a collector can call you FDCPA... On the first phone call you are suppose to made aware of the Mini Miranda which NO ONE does this
.... This is an attempt to collect a debt any any information obtained .....
Then they try every dirty rule in the book. They threaten you with Litigation... Well hello... they aren't even in the same state as you... can you say SUE THEM !!! If they are in the same state (MASS) it is soooo easy to get out of it.... I believe that all of the "contingent clients" fired them for scamming them out of money. They illegally tack on interest before it even hits the floor then they continue to add additional interest on it. your best bet is to let them sue you because they have to sue for the "original" balance its a joke! When you receive the notice for court, you are required to file an answer. YOU NEED TO DO THIS (2 copies) 1 to the court and a copy to them. In the answer you say that this is not your account and they never gave you a copy of the contract to prove this was yours, this was disputed, and it will help you to send a letter certified mail on the first notice of this !!!
If you show up to court you will win! they buy this debt for .03 cents on the dollar, some even cheaper depending on the statue of limitation, every state is different. say you live in Massachusetts, SOL (statue of limitation) is 6 years. the debt was probably 5 owners later and they have no docs... you can request them until your blue in the face but Chrissy A the liason is fat and lazy too busy stuffing her face. you just keep the copy of your letter requesting the information and you will never get it, instant LOSS for them in court. Problem is noone files the answer!!! auto judgment !! They cannot sue a PO BOX !!! Eric the GM (JOKE) is 5 feet tall and has little mans disease, Thinks he is really a big shot with his waxed eyebrows. His girlfriend, Litigation manager Rachelle H. breaks the most laws. She is going to sue everyone and they aren't even in the same state. LAWSUIT it's good for you that she has no clue what she is doing. FDCPA VIOLATION ! Start writing to the MA attorney general ! they have hired a department to field these complaints. And for Pat L and yes, he has little man's disease too! He's only there for the insurance. The employees are all screwed up on drugs and there is no control over these kids. They all use fake names and charge you 2 times the amount you really owe. Do yourself a favor and hire an attorney to deal with these clowns. You probably won't end up having to pay anything and if you learn the laws in your state, they would end up owing you !!!!
