Hayt, Hayt & Landau practice Unfair Collection Practies. I can't even get proof of the debt. They took me to small claims court after telling them I did not know anything about this credit card from Capital One bank that they had the wrong person.

I went to court showed them my drivers licence and social security card they took a copy we then went into the court room the lawyer told the judge that I showed proof I was not this person. The judge told me I could go.

Meantime these crooks have changed the name to my name.
sent me letters showing the judge signed them but they do not look leagle.

they want me to fill out a FORM7.343 FACT INFORMATION SHEET with all my personal information. Then mail it to the Plantiff. Also says not to file the form in public records. They also changed the credit card name from Capital One Bank to Capital One Bank (USA) NA

This was dismissed on November 20, 2008
Then I get this final judgement paper mailed from Hayt, Hayt & Landau, not from the court supposed to have been ordered on November 26, 2008.

No court seal

can they do this?

You can find out if the judgement is real by checking with the county clerk in the county you live

I have dealt with this company. They will pull every trick you can imagine to squeeze money out of you.
What you described is definitely not legal. But that does not stop them.
Google Clerk of (Name the county) court. Search public records. Type in your last, first and middle initial. If there is a judgement on file you should be able to locate it. If not, call the clerk of the court and, I assume it is small claims cout, and have the clerk look it up.
If you have an actual judgement against you and it was obtained under the circumstances you have described, you should be able to file a suit against them. I assume you cannot afford an attorney. I know an excellent attorney who would be willing to review your case free. Have all of your paperwork together. If he feels he can help you he will most likely take you case free. No gimmick here, I promise you that! I do not get anything out of it either.
I am just trying to help people who are being ripped off by these people.
If they did indeed switch names, you should report them to the Fl Bar in Talahassee, and the state attorney general. But this will not get your money back. You need an experienced attorney who will fight for you.

Also, check out www.budhibbs.com. Email them with your problem. They can direct you to a website for a listing of attorneys, but I have no personal knowledge of them. Good luck!
