I have been on the no call list since just after the first subscription, I checked, we're still on it. (updated as well)
On the 26th of November 2008 I received a phone call for a magazine subscription, Since I was in fact receiving magazines from another company I took no notice of the call, thinking that it was time to renew anyway.
I was never informed that this call was a sales call.
I thought that it was the company that I was getting magazine from, so I told the lady that I just wanted to cancel my subscriptions because the only magazines that I was interested in were 'Dirt rider', 'Field and Stream', and 'Outdoor life' (remember these for later). She went on saying nothing about not being the company that I was already using.
Curious... I should have caught on right away, but me being somewhat slow witted late in the evening, I didn't.
So, being the 'friendly' sales person she asked for my credit card information, and I kindly told her that I didn't give out that info over an unsecured phone line, and she told me that that was to just confirm the numbers that she already had??? (I'm still thinking that this is the first subscription company), and I thought that this was to confirm that it was actually me and that I really wanted to cancel my service. It was the wrong account information for an automatic withdrawal from my checking account. I didn't care that the numbers she just told me were wrong. I was canceling my service anyway.

I'm thinking "good that's taken care of". I was wrong.

On the 26th of December I get a call from Heartland inc. magazine service asking when I would be paying my first installment? At this point I'm still thinking that this is the first subscription company, and I informed the caller that I had canceled my service due to hardships in the family. This is when they started being jerks... I was told in no uncertain terms that if I didn't pay they would send the bill to collections. Fine by me, I canceled my service, and hung up. 30 seconds later the phone rings again... Heartland inc. demanding payment. Again I told them that I canceled my service in November. Yes, I hung up again. 30 seconds later Heartland inc. This time someone different "This is Heartland inc." She says. I said look you are the 2nd person to call in the last few minutes this is getting old I have canceled my account. And hung up again.
Many, many phone calls And hang ups later I get this guy on the phone that thinks he's one of the transformers, or some such thing. Thinking he's being funny... He listened to the T.V. program I was watching (phone by the speaker) for about 15 minutes. He hung up this time, so I didn't have to.
I was told later in one of the conversations that the account number that 'sales person' gave me over the phone was wrong, and they wanted the correct numbers.
How is this my fault?
Where did the numbers come from in the first place?
Is this in fact fraud?

At the beginning of the month of January I asked for the 'Letter' that they supposedly sent out that would give me 10 days to cancel (never received a first letter). I got the letter with the magazines that I ordered over the phone on the 28th of November??? That call never happened. Remember the 3 from the beginning of this letter. Yeah, those. Those 3 are the only magazines on the list that I would have ordered. The others, 'Garden design', INC magazine', 'Garden design' (twice?), Outside magazine', and Maxim. 5 magazines that I wouldn't browse through in the store waiting on a prescription, But yet I supposedly ordered them over the phone 2 days after I authorized the automatic withdrawal?
Anyway, throughout January I received at a minimum 3 calls per day everyday. I told Heartland inc. that this many call per day constitutes harassment. I was told that they could call a maximum of 5 time per day every day.

I have asked to listen to the 'tape of me saying that I:
First, authorized the use of my checking account.
Second, me saying that I wanted the other 5 magazines.
No response from Heartland inc.
I also requested that a copy of the tape be sent to me so that I can have it analyzed.
Even if the tapes are sent, I don't believe that either of them will be the whole tape.

I do expect an answer within 30 days.

I'm making copies of this letter and taking one to the lawyers office, sending one to the BBB, one to Ripoffreport.com, and I don't know but I think there are a couple of Senators and Congressmen here in Colorado that might enjoy reading how your company is taking advantage of their constituents by using false and/or misleading information.

The Hobbs act title 18-USC 1951. Heartland inc. is trying to extort monies from me through interstate commerce.
