In May 2008, Mark Hemenway gave me an estimate of $1,000 to replace and extend a septic tank line in Bourbon County. I signed a contract with a warranty agreement. Mark said he would bring it to me. On the day of the work, I received a call from my brother who watched the process througout the day that Mark did not dig the ditch out deep enough. I spoke to Mark who assured me that it was deep enough.

Later that same day, Mark came to Lexington for me to pay him for the work. I did and asked for a copy of the contract I had signed and a receipt for full payment. He was to mail both items back to me. The invoiced arrived by e-mail, but the contract never was received.

A few weeks later, I received a complaint from a neighbor that the septic water and waste was on top of the ground. I called Mark. He refused to go back and correct the problem. He has been very nasty and arrogant. I called Mark several times again. I sent e-mails to him. I continued to receive complaints from the neighbor. Also the neighbor complains each time to me and my brother when we are at church.

In November 2008, I made a visit to Mark's company to get a copy of the contract ( I took a witness with me). Mark said it would take time for him to find the contract, he put some time of note on the invoice I had that noted I had paid in full. In November 17, 2008, I sent him a certified letter. He would not take it. In January 2009, I sent another certified letter to his home. It has not been received to date.

In January 2009 I sent another certified letter to his home. My next step will be Small Claim Court. This man is no better than a highway robber. If you have had a similar experience with this company, please make a report.

On February 4, 2009, I posted a complaint against Mr. Hemenway, Hemenway Concrete and Construction Company. On May 12, 2009, we met with others who assisted in mediating the matter on the proposed septic tank issue. This may sound too simple; however, after much discussion, the problem was COMMUNICATIONS. After our conversation, I reviewed what I could have done differently to communicate the problem clearly and precisely. Mr. Hemenway thought he understood what I wanted and what I needed. This is a basic contract problem, unfortunately.

At the end of the day, a contract is no better than the people who sign the contract. When we met face to face I was very pleased with Mr. Hemenway's professionalism. Mr. Hemenway felt he had done what I asked him to do and did not understand why I was insisting that he had not. I felt he had not done what he was asked to do and did not understand why he was not willing to correct the problem. We have worked out an agreement that resolves the issues as it related to us. I am satisfied with his honestly and willingness to talk to me, although it was evident he is extremely busy.

The next time I contract with anyone, in order to communicate clearly and precisely, I will have a diagram with written instructions of at least the problem. Once I have discussed the issue orally, I will ask questions to insure understanding. I will not sign a contract for work without an immediate copy for my review and a complete understanding of what I am signing. Although we live in a fast-paced world, I would hope that companies performing services would listen carefully to clients' concerns and respond quickly; even when the company feels it has done the work as requested.

I would RECOMMEND Mr. Hemenway and his company without hesitation. I went into the meeting with the thought that I was the only wronged party. I am sure he had the same thought. I am pleased with the outcome with regrets that this matter lingered as long as it did.
