Made a reservation for a one way trip from dulles to atlanta for me and my business partner. The reservation was for 59 dollars a day with unlimited free milage. When we got to hertz office we needed to change the reservaton into his name since he would be the primary driver. I showed my license and the agent said she would change existing reservation into his name with no changes.

He gets to atlanta turns the car in and they charge .25 a mile for the trip, an extra 300 dollars. We complain to Hertz they say tough s**t you changed the reservation and did not notice that we added a milage charge to the car thats tough sorry you feel it is unfair but thats the way it is.

Yes I feel it is unfair. I also feel it constitutes fraud and deceptive trade practices and am going to contact a lawyer and sue the bastards on monday. That 300 is going to cost them thousands by the time I am done suing them just in lawyer fees if nothing else. Not to mention the endless beating they are going to take from me telling this story on every web site on the internet. Starting my own web site with the story and paying google to keep it at the top of all searchs for Hertz.

LOL! But apparently I'm not "to" stupid to read the rental agreement before signing it. No, that would be you.

And now Perry Mason is going to "sue the bastards!" This just in.... scientists now believe that the recent earthquakes were actually caused by the Hertz corporation shaking in its boots.

Please, get a life! And your secret agent buddies as well for that matter. I do agree with one comment however, I can't wait for this to come to trial either. (Hint: that's never going to happen - but it's your time and money)

One last question: did you and your agents check the local laws about secretly taping conversations before you left on your mission? You're in Florida, right? And none of you

Florida's statute makes it illegal to intentionally intercept, attempt to intercept or have someone else intercept on your behalf any wire, electronic or ORAL communication through the use of a device. It is also illegal to intentionally use, attempt to use OR HAVE SOMEONE ELSE USE "any electronic, mechanical, or other device" to intercept an oral communication.

Interception is not illegal if one has the prior consent of ALL parties, unless it is done for the purpose of committing a criminal act.

It is illegal to intentionally use, disclose, or attempt to use or disclose the contents (any information concerning the substance, purport or meaning) of a communication if one knows or has reason to know that the information was obtained through unlawful interception." (Hint: and you obviously know - you just admitted it here in writing no less)

The statute requires a reasonable expectation of privacy for oral communications. To be protected, an oral communication must be uttered by a person exhibiting an expectation that the communication is not subject to interception, under circumstances that justify that expectation."

Whoops..... Please let us know how the "other" court case comes out. The one where criminal charges are brought against you and the other honor grads from the clown college.

Understand Your Pain. Hertz is not the only company that uses the same formulas. Budget, National, Avis.

At the time of the call they take your information and based upon that information the see what is being offered for THAT TIME only. They offer you the information and will only at THAT TIME lock in the deal.

Any changes to a reservation and or to an actual contract will be subject to what is being offered at THAT EXACT TIME. Most of said companies will try to overide the current offerings to keep the same as originally offered. The counter staff have more overide privledges than a call center would.

From an agens standpoint knowing the way things work you should have left the reservation as is and signed the other guy on as an aditional driver. That will not change the original agreement and only cost the base extra driver fee. OOps just remembered you were businees people on a business trip. Most companies have no fees for fellow employees as extra drivers when on business. The extra drivers have all the same privledges as the renter. Renter not required to be there for the return ect ect.

Rental vehicles are still the most suply and demand oriented business structure out there. When cars are plentiful you will be offerd a better offer than if you wait till the last minute when cars are more scarce. Ever walk in and see a managers special on bigger sized cars? That is because a car sitting still makes no profit at all and getting someone to upgrade for a few more dollars will do two things 1] make a profit though less than optimum of the large size. 2] Open up another small sized car for someone who just cant drive the bigger cars with comfort who would go rent elsewhere before taking a big car. Someone like my poor 4 foot 9 inch Mom

From a more legal standpoint was these different occasions all handled by the same agent? They tend to ""um shady saying"" steal the commision from the original agent when changing at last moment. Can you prove that this is actual company policy and not an unscrupulous agent padding thier paycheck. Putting your John Hancock to a legal binding document as a car rental agreement without first verifying it yourself as to what the agent said verbally was in my own opinion just plain stupid. That would be like taking you restraunt check giving them your credit card and not looking at the dollar amount before signing it. Personal turnover rate is high in this business as it is hard to find and keep a really good agent for the low end pay offered for it.

As for the 9/11 comeback. All the car companies went all out to do the same exact thing as Hertz. Many companies lost untold dollar amounts in after things settled down coordinating getting the cars back to thier correct lots. Did Avis say forget that! We just had a rental agency crushed we got to recoup those losses so sorry for you inconvenience but we need the money? Am I saying Avis was better than Hertz? or Budget or any of the others who in an unprecedented time of crises showed they do have a human side to the corporations? No

So yesterday in preparation for my lawsuit against hertz I had a couple of friends do the exact same scenario with Hertz. They pulled the same scheme on them, but the best part is that I was there and covertly got the whole thing on audio video tap. Can't wait to see the bastads squirm in from of the Judge jury explaining there behavior repeated fraudlent behavior captured on tap. LMAO !!!!! So anyone else love these bastards?

Let me tell you about Hertz

On 09/11/01 I found myself stranded in Raleigh NC, having been forced to land there. I had a Hertz car waiting for me, and was allowed to take it and leave the airport. After several days, it was obvious that that RDU was not going to reopen soon, so I tried to call Hertz to see what to do. Naturally, their lines were jammed, but I got a recorded message that basically said: "We have your credit card on record. We have your contract number on record. Keep the car as long as you need it. Do whatever you need to do to get home safely. There will be NO mileage charges. There will be NO drop off charges. Turn it in at the nearest Hertz location to your home". And furthermore, they opened their entire fleet up at midsized rates. Towncars, SUVs, whatever - went for the midsize daily rate.

When I turned my car in, I was charged for 4 days @ $34 a day. Better still, the lady in front of me had driven from DFW and the guy in front of her had road tripped from SLC (Salt Lake City for the traveling impaired). Same thing, daily rate, thanks for choosing Hertz.

But the story doesn't end there. When the airlines started operating again, Hertz had to fly their own employees all over the US to pick up their cars and redistribute them. All because they did the right thing on 09/11. How dare those money hungry bastards do such a thing?

Yes, I'm a President's Circle member at Hertz. They have my car waiting under a canopy, warmed up in the winter, A/C on in the summer, just as they do for any Gold Club member and above. So, yes I like Hertz alot, and I admit it. But nonetheless, in this case the problem is strictly with you my friend. You knowingly canceled an existing contract, initiated a new one, didn't take time to read and understand the details, signed it and drove off. Oh well.....now you know.
