About 3 years ago, I received a ticket from the Hickory Creek Police Department, and politely advised the ticketing officer that I was not guilty of a crime, and that I would not sign the ticket. At the time, I asked the officer to please arrest me, and take me to jail for refusal to sign, if he thought I was guilty. The officer refused, and said he would see me in court. I advised the officer I would not be in court, but to my surprise, he knew something I didn't. The officer knew that the court would abuse it's power to ensure that I pay this fine.

So years later, my drivers license is up for renewal, and to my surprise, there is the Town of Hickory Creek with a hold on my drivers license. So I call the court and ask what is going on. I am advised that I will have to come to court or pay the fine to get this hold removed from my drivers license.

The problem is that I don't have money to pay the ticket, and with two young children, I can't make it to court for a trial. I don't have money for daycare, and to make matters worse, I don't have a drivers license. When advising the court clerk of my situation, she continually tells me that I have no remedy but to see the judge, or pay the fine.

This has gone on for months, and my license has been suspended for 6 months. I try to call and find a resoultion. Although I am not guilty of the crime, I am willing to sit out the fines in jail, but to my amazement, the town of Hickory Creek cannot accomodate.

So, in short, I have a warrant for my arrest, but it is not arrestable, according to the court clerk. The town of Hickory Creek has no jail, but uses the county jail, which is not currently accepting Class C Misdemeanors. Having no jail, the court clerk tells me that my only option is to pay the fine, or keep driving without a license.

So it seems to me that this will go on for as long as the court has the power to abuse their police powers, upheld by the state, as the DPS tells me they can't help me. This is Municipal Court Corruption in Texas in the town of Hickory Creek.

Something is amiss here. I don't know if those reading this report understand the general idea, or if it is simply ignored completely, as such, I will try to respond intelligibly, so that my meaning may be understood. Unfortunately, Stacey, due to a lack of mass transportation, those without cars, and the ability to drive, are indigent. As such, you infer that I may not work, which is a laugh, because I wouldn't have a car if I didn't. Then you have this junk about no license, no insurance. I have insurance. Insurance companies insure unlicensed drivers all the time. They don't even raise my rates.

My spouse cares for my children while I work. A fact for you: There are 168 hours in a week. 40 hours is less than one quarter of that. My spouse and I schedule our work days, so as to be able to be home with our children. On the weekends, family can help watch the children. On the last of it? Negligence and abuse? Do you realize the ignorance in your statement? How am I putting my children in danger? Please do respond. Whatsmore, if I were a danger, the police would arrest me. Your comment, unfortunately, sucks. 

Ramjet, you just didn't read my post. First of all, you should see a judge or DA have to dismiss a ticket... They HATE it. Judges don't dismiss tickets, unless there is video evidence of innocence. Not showing up in court, only results in judgement against the defendant in a civil case. This is a speeding ticket, and it should be a civil case, but then it would not generate as much revenue, because the state would have a hard time convincing people of any wrong doing, in a need to prove damages. Actually, the reason that this is a criminal case, is so that this is a fine, not a judgment as you stated, and misspelled. 

The consequences for me refusing to make a court date, that I never agreed to in the first place, should be dismissal, as the officer had his chance to arrest me. As for no one being held accountable, there is a difference between agreeing to be in court, and not showing up, and advising not to show up. A promise to appear is a bond, in lieu of arrest, this is why you are asked to sign a ticket. By agreeing to appear at a later date, you are allowed to leave the premises and return to court at a later date, thus refusal to sign ends with arrest or nothing.

Clearly you STILL don't get it.

If you you get a ticket, you can just plead guilty and pay the fine - usually by mail -OR- if you believe you are innocent, you can go to court and plead your case to a judge.  This does NOT cost you anything except your transportation cost to get there.  If you are as innocent as you say, you can convince the judge who will dismiss the case and you can be on your way with no cost to you. 

If you do not show up (a bad decision) they will still call you in court and if you do not show up, you will have a judgement against you (of course - you were not there to plead your case).  This is reasonable.

When they have a judgement against you, you are well aware of some of the consequences and there will probably be more.

If everyone who thought they were innocent could just ignore their charges, no one would ever be held accountable.  You never said here what you got the ticket for.

You are a fool!

 You have small children to take care of but cannot afford day care?? Yet you can afford a car, insurance, internet services and an attitude.  You stated you would serve your time in jail but alas who is going to care for your children if you cannot afford day care?? Who takes care of your children while you are at work if you do indeed WORK?

So I can only guess you are driving around with your children in the car with NO license, NO insurance (because you cannot have insurance without a license), putting your CHILDREN in danger just to proof an ignorant, if not, idiotic point.  IN Denton country no less.  If I knew you name I would, for one, be calling CPS and the Denton County Police to have your pathetic a*s arrested and your children removed from your custody for neglect and abuse.

Your bias and ignorance are showing. It's entertaining really. Here are the Facts in a simple bullet form for you:

-The court will not allow me to see the judge, without first paying them money I don't possess.

-The court will not allow me to go to jail, nor will they arrest me, on their supposed bench warrant.

(This means that the only way to resolve this is with money, according to the court)

So here is the simple response to your rebuttal: I can't see my day in court, they won't allow it, unless I pay them, which I will never do, because I am innocent from day 1. I did not agree to appear in court and they cannot charge me with a failure to appear, because they have no legal basis, but they still put it on on texasfailuretoappear.com. This is corruption.

They get away with this because there is no oversight of the court, except for other courts. DPS stated that the court is wrong, but that they(the DPS) are powerless to do anything about it. They have repeatedly told me that I have to take it up with the court. The court clerks won't even talk to me, or offer any other solution. The only thing that the court is concerned with is money.

You say my insurance premiums will go up. That is a scare tactic used by prosecutors, they say it at every pretrial, every opportunity they get and they try to convince people to take deferred or defensive driving. The fact is that they are in it to make money. If they were truly just, they would ask people who are innocent to fight their tickets, but instead they try to convince everyone not to fight by offering up a lower fine, and no report to your record, but if you fight it and lose, then it sticks and you pay in full.

You mention that I have seen temporary decreases in my insurance rate. Actually, I got a new insurance policy after my license was suspended. Once again you don't know what you're talking about. 

You talk about me being pulled over and ticketed for driving while license invalid. If this occurs, it is the fault of a corrupt court. 

The fact you seem to miss in all of this is that the court does not have unending power, that the checks and balances have been lost, and that they are currently abusing their powers for profit. It costs too much money for people without the resources, to fight these corrupt courts. In my case, I would sue them if I had the money, as what they are doing is illegal. Unfortunately I don't have the resources to fight them, and therefore, I cannot win. 

The reason I posted this, is in hopes of finding an alternative to the only one the court will offer. Shame on Hickory Creek Municipal Court. This should have been dropped a long time ago. And shame on you for defending their disgusting behavior. Of course power to the people, we live in a democracy, but every day we lose a little more of it, to fascists and socialists. 

There was a time when our laws were determined by court decisions, but today the majority of our laws are civil, meaning they are decided by a small oligarchy(legislative bodies), rather than the people through the courtroom decisions of our peers.

You don't even know enough about all of this to offer a rebuttal. All you know is to call me names and pretend to know the law. Please find someone who knows the law and ask them to post on your behalf, so you avoid sounding stupid.

Since you obviously say this is all true then you must be the world's biggest a**h***.

The fact is that when you are put in jail you don't get to decide when or for how long.  With this attitude you appear to posess, the judge may decide you need a bit more of a lesson and decide to put you in jail for say 72 hours, perhaps 1 week. 

Since you are taking this "I am innocent and not going to deal with it" attitude, you eventually will be pulled over and you will be given another ticket for driving on a suspended license.  Now, I am sure you won't go to court on that one because after all you are innoccent right?  So while it may take a while you will be pulled over again, only this time because you are a repeat offender you could now be charged with a Class "B", and unlike a Class "C", you are now subject to jail time of up to 180 days in jail.  Now, I am not saying this will happen today, this month, or even this year.  But it will happen.

FYI, as for your insurance.  The reduction you are seeing is temporary.  Once they find out your license is suspended at the very least you can expect a huge increase in rates, at most you may find your insurance cancelled as well.

If you really wanted to make a statement, why not go to court?  But before you go notify all of the local and national news media on your fight on corruption.  Give them your entire background as to how the courts and State are corrupt.  I am sure they will line up and fill the court room ready and willing to document your fight against the machine.

I can't wait until you provide updates on your "fight".  Power to the People..right?

I understand your statement that it is not an admission of guilt, to sign the ticket. I knew that at the time. It is however, an agreement to appear, and I did not agree. I did not commit the crime stated by the officer, and therefore was not willing to appear in court, I had no reason to waste my time and resources. Now, being innocent, I will not pay the ticket. I will not allow the Municipal Court to turn a profit, by extorting me. 

I will however, allow the Municipal Court in Hickory Creek to put me in jail, at it's expense, for a crime I did not commit. Atleast it would cost the court money for its crime. My spouse would watch my children over the weekend I would spend in jail, as we are both free at that time. So, at this time, the Municipal Court of Hickory Creek is holding my license for profit. If I recieve a ticket for Driving while License Invalid, it will be due to their inaction, and they may have a lawsuit on their hands, as this is a clear case of corruption and abuse of police powers. 

My insurance premiums have gone down since this incident. I don't need or want daycare for my children, my spouse and I coordinate our schedules, so as to be available, one or the other to watch them. What I don't understand is why your post seems to see the courts in such a favorable light. It sounds like propaganda to me, and not very convincing at that. The court won't drop the case, because the city wants my money.

Alas, I am not a cash cow, nor am I any other exploitive you would like to call me. I am a reasonable, responsable, respectful person, just looking for justice. When the system begins to take profit from it's citizens, by making monetary gains from "crime", it becomes a system of injustice, and becomes criminal itself. Now having a financial interest in this ticket, the courts primary objective is to obtain that money.

I know a lot about the law because I study it after, on a few occasions, having been lied to by either ill-informed, or corrupt police officers. This was both on bicycle laws and on license plate laws, by officers who, presumably, wanted to ticket me for my ignorance, although I knew better and informed them so, and this case, for what was my ignorance.

I never would have thought the state would hold my license, because I refused to pay a corrupt court. The fact is, our government slips away from us a little more everyday, and this is just one example that affects me personally, among many. This post is a huge story that the American people cannot afford not to hear.

Thank you for your response I appreciate your input in this matter. I'm sure many will find it as meaningful as I did.

 Either this post is one huge story, or you are the biggest a**h*** in the US.

As to the original citation, the officer was NOT having you sign an admission of guilt.  In fact if you actually read what you were signing it specifically says that.  What you were asked to sign was a promise to appear in court.   It doesn't make the citation go away if you don't sign it, you still have a court date.  If you fail to appear you will be found guilty.  If you fail to pay the fine, your license can be(and apparently was) suspended. 

As to the bench warrant, that is also most likely valid.  But your bigger issue may now be if you are caught driving with a suspended license.  At a minimum it is another Class C violation, however it can easily be moved to a Class B in cases such as you are failing to maintain insurance on your vehicle.   While talking about insurance, having a suspended licence automatically makes you a higher risk and therefore higher premiums.

The biggest crock in this entire report is how you are apparently so willing to serve out your time in jail...time after time.  Yet you won't actually "man up" and take care of business because you say you have kids and can't get daycare.  Okay so answer this Einstein...who is going to watch your kids while you are chillin' out in the local Grey Bar Hotel?

I also wonder how come you are so well versed in the jail situation in Texas?  Can we figure that you have been to a few jails and perhaps are very familar with how the "system" works?

First I would like to address your concern that it isn't illegal not to sign. You are right, however my refusal to sign is my refusal to appear in court. The officer has the right at that time to arrest me and have me see the judge. Unfortunately jail is the fastest way to actually see judge, as you see them the same day or the following.

Second, you remark that if I can find someone to watch my kids while in jail, then I can find someone to watch them while I go to court. This is ridiculous. I could turn myself into the county jail any time I please and sit out a couple days over the weekend, when I have the time. My week however is hectic, and court dates can only be set twice per month on a week day.

This means that my spouse would need to take off work in order to allow me to go to court. It is not right for the court to take money out of my families pockets to make me show up in court so they can rob me. The reason for this is to ensure people pay the fines rather than dispute them. The courts make it so burdonsome for people to fight their tickets, that they simply pay it and move on. 

The court has no evidence to support their claim, but the testimony of a lone, maybe confused, or maybe corrupt, police officer. The fact is that the court system makes a mockary of justice by denying it. As long as it is easy to prosecute innocent people the courts won't stop. In the mean time I need a drivers license and have received no justice. I appreciate your thoughts though, I will try on those big boy pants, and maybe you can do the same.

Grow up you child. Stop defending the system of injustice.

This post has got to be a joke, right?  No one can be this ignorant.

 The officer didn't arrest you for refusing to sign the citation, because it's not against the law.  All your signature means is that the officer explained why you were being cited and that you had the option of paying a fine or, if you felt you were innocent, go to court and plead your case before the judge.  You chose to ignore the whole thing and do nothing.  Because of that, the judge made a summary judgement against you, suspending your license.  He also issued a bench warrant for your arrest for failure to appear.  No ripoff or abuse of power here.  You claim not to have any daycare for your kids, so you can't go to court.  Yet you state you are willing to sit out the fines in jail.  If you can find someone to watch your kids while you're in jail, then you can find someone to watch them while you go to court.  You've been given two options, pay the fine or go to court.  They're no going to drop it and say "Oh, never mind".  I suggest you suck it up, put on your big boy pants, and pay the fine.  Going to court will still probably end in a fine and, possibly, jail time.

 Next time this happens, because I'm positive there will be a next time, go to court or pay your fine.
