I too live in San Antonio and have had my belongings thrown onto the street based on a wrongful foreclosure that even the judicial system here won't respond to. I have filed complaints to the Texas Attorney General's office, FTC, HUD, and Fannie Mae and no one seems to be interested enough to investigate the wrongful acts these business men are allowed to make money by doing. I have filed many lawsuits, paid many dollars to several attorneys and still can not find one Judge in Bexar County to listen to a valid complaint. Homecomings and Bank One have a system of taking the equity from your home and charging you for it... We have had a pre-approved refinance beginning in 2001 and are told that Homecomings does not have to respond to a payoff request. From my understanding it is a federal respa law that they infact do have to not only respond but respond within a specific time frame. They badger you into owing $$$ you do not owe and the best part is that it is reporting to the credit bureau as a paid in full as agreed debt. Go figure, I could just go and buy a brand new house and not worry about them, but I think I will pursue a fight! The Wolf & Popper Law Firm in New York have built a great case against this company (who is not responding to them either. Don't depend on only that. The restitution is minimal. You have to band and file your own lawsuit against these criminals and make sure to include your local TV troublshooter on it too. I have a call into them regarding this issue and am planning to sit with them for an interview! These companies have to be made an example of for the public to view. GMAC owns Homecomings Financial... this is no small mom and pop shop... GMAC is responsible for losing quite a bit of $$$ over other business ventures and have found a way to make up those $$$ by screwing over hard working homeowners that never signed contracts with them anyway! Good luck to you all and I will continue my efforts to shout as loud as I can. Power in numbers whoever else in Texas that has been infected by this worm please respond and maybe we can number up to fight these bastards! Keep in Touch!

Homecomings Financial ETC basically win...give it up!

The New York Law Firm Wolf & Popper, that was handling the class action against this monster did not win. The case was dismissed...I do not know of any other firm willing to take this on. It is amazing that there is not a single soul out there who can help the victims...after all, you see what the industry is like today. Countrywide shutting down along with many other predatory lenders.

It is only going to get worse. I have been fighting for over 7 years. They got my home but I got a better and bigger one (brand new on a golf course) cause those idiots did not know what they were doing and thought they messed me up totally. To prove they are liars my credit was not affected by this error. So go figure were my payments really behind then? I think not but it's ok they too will meet their maker.

I have tried to see how to reach you and can not. please contact me at my email . this company is so tired and so yesterday in my life but it has destroyed a big part of my life. i would like to talk to you and pick your brain. i am on a personal mission to bring this entity down...even though they have taken my home, i am in one 2x its size, on a golf course...needless to say...who was wrong. bit my family is broken and lost. i tried to buy the house back even though they wanted over $240K for me to refinance it, the balance was only $150k and they only got $190K for it. it looks like it is abandoned right now...i need to post pics of what the house looked like while i lived in it and was fighting for it vs the wonderful hand picked owners homecomings put in it now...wow talk about depreciating a valuable neighborhood...please reach out to me asap!!!

Most are missing the boat on this company

You all must look beyond the "predatory lending" and other surface issues and look to the company's structure. Within the structure of the company you will find most of your answers and I suspect resolutions will be forthcoming.

This company holds itself out to be something it is not. You need to look at how the company is chartered and challenge what they tell you. There are rules and regulations that must be abided by in each state pursuant to the state banking laws. This company tries to sidestep these rules and has in fact been successful in many instances. If this company tries to tell you that they are federally chartered and as such are exempt from the banking laws and regs in your state, challenge them and make them prove it. Go to the state banking department and see what they have to say about this company's charter and the charter of any subsidiary they try running up the flag pole. The Federal Banking Commision is contacted very easily and is very helpful as well. I challenged them and got a $13,000 early payment penalty taken care of. Not by me either, it was an organization that was working with Homecomings that agreed to pay the penalty. Somehow I suspect that this was directed by Homecomings, but I did not care, they paid it and I did not. I promised an investigation by State Attorney Generals Office and that resulted in a resolution within 24 hours.

Be smart, do your homework and you too will be in a position to prevail against this organization when they are wrong. Keep in mind too that this organization cannot "carry" every person who runs into trouble. They are in this business to make money, perhaps their tactics are suspect sometimes, but they cannot be expected to not pursue foreclosures when there is no other alternative that is financially reasonable for them.

GMAC-RFC and Homecomings Financial to Donate Up To $1,000,000 to Hurricane Katrina Relief Effort

Residential Funding Corporation (GMAC-RFC) plans to assist the victims of Hurricane Katrina with up to $1,000,000 in financial assistance.

The company will match all donations made by its 4,700 employees, for a total contribution of up to $1,000,000. GMAC-RFC associates, including those of its subsidiary, Homecomings Financial(SM), may direct their donations to thirteen Federal Emergency Management Agency (FEMA)-recommended nonprofit organizations. These donations complement those contributions by GMAC-RFC's sister companies owned by Residential Capital Corporation (ResCap), and contributions made by GMAC Financial Services and General Motors Corporation.

"The scale of suffering is enormous; thousands of our neighbors have lost everything," says Bruce Paradis, president and CEO, GMAC-RFC. "In times of need, our associate family has always responded from the heart. We are encouraging our associates to help by donating to designated relief organizations."

In addition, GMAC-RFC's subsidiary, Homecomings Financial(SM), which services the home mortgages of more than 730,000 customers nationwide, is offering mortgage relief, counseling and other assistance to the more than 14,000 households it serves in the 53 counties and parishes that have been declared disaster relief areas throughout Mississippi, Louisiana, and Alabama by FEMA following the overwhelming devastation left in Hurricane Katrina's path.

Here is my comment to Forbes.com editor:

It is completely amazing to me that this company you so apparently represent as a positive can really care about the victims of Katrina and offering assistance for foreclosure prevention when they themselves are creating foreclosure situations for their customers. Visit www.ripoffreport.com for more information. You may want to investigate this company regarding the class action suit and the WV Attorney General's office findings when dealing with this company. They are in the spotlight when it comes to foreclosures...wrongful foreclosures. $11 Million Dollars was the amount that Homecomings had to release in loans for 279 homeowners who were wrongfully foreclosed on in West Virginia along with $770 thousand in restitution. A mere $1 million seems extremely petty for a company who had a profit of $2.9 billion in 2004. I highly suggest more investigative reporting and less impressions by the number of zeros following the dollar sign when so called donations are given. They are robbing Peter to pay Paul.
