I recently brought suit against HomEq in the U.S. District Court of Vermont for unfair debt collection practices. I was able to do this because my state law mirrors the Fair Debt Collection Practices Act (under which they are exempt for their unfair debt collection practices), but my state law does not exempt creditors and holds them accountable for unfair debt collection practices. HomEq realized the futility of fighting this action and they settled with me. While I won't disclose the exact amount here I will say that I no longer have a mortgage.

So if you are tired of HomEq calling you repeatedly about payments that are only a few days overdue; if you are tired of them threatening you with legal action they cannot legally take; if you are tired of being called at work after telling them not to call you there; if you are tired of being harassed then you need to find out what your state law says regarding debt collection. If your state is like mine in that it does not exempt creditors from having to comply with the law (and many are) then you should talk to an attorney.

I'm sure the rebuttal responses will try to defend HomEq's practices (which their lawyers couldn't do!) but even if you're months late on a bill you shouldn't have to worry about being harrassed and this is the very reason these consumer protection laws were passed.

I have to agree, There are constant issues of FDCPA violations..

As a person who works for the company of Homeq, I have to agree with the comments posted. There are constant issues of FDCPA violations of customers being called twice, being overcharged for unexplicable reasons and employees left out in the dark about the issues. Employees are faced with giving information they are not sure about and even the management cannot explain. Customers are often charged for things and accounts are incorrect notated which leads customers to accrue often times more charges that are very difficult to get off. Customers are often threated by collection agents to make payments because they have to meet set quota amounts. As an employee I have observed several inconsistencies with the company, the law and its administration of the policies. Yes, there is a breaking of the law. Yes, you are correct. It should be investigated.
