After hours of reading all these reports I have decided to respond. My husband and I are going through forclosure right now. We have tried to work this out with Homeq. They refuse to work anything out with us. We are 3 months behind on our payments, we have offered them the amount for these payments, but cannot come up with the attorney fees they have tacked on!
Futhermore thye are telling us to sell our house, stating we cannot afford it!This is not an option for us, we have contacted several HUD agencies for help. They have taken us through credit couseling, and are recommending a that we can afford it and just need a loan modification.We have contacted Homeq with this information, and still they refuse, stating they cannot make any modification to our loan, they do not offer this option. We have asked who our lender is in hopes we could contact them for a loan modification. They refuse to give us this information. We have tried to refinance, but do to our poor credit are having no luck! Are they any leanders out they that will help?

We are soooooo tired of hearing that lenders do not want to foreclose on you!!!!

Further more during the forclosure process we have found out the the loan papers have been srewed up from the beginning! Homeq's foreclosure attorneys are stating that the legal decription on the property was not correct from the beginning , theyfore they need to correct it! Also stating that we have not owned the entire property from the beginng.

They have ammmended the summons naming the previous owners as defendants because of this!
At this point we do not know what to do!!! Time is of the essence, as we want to stop the forclosure procedings before they go any further!!!!!
Any help or information ANYONE can give would be much apprieciated!!!!

WE ARE TRYING TO SAVE OUR HOME!!!!!
We too agree HOMEQ should be STOPPED!!!!!!!

It's a battle of wits with an unarmed person when it comes to you, sorry about your woes and all but I'm beginning to feel like a bully.

I hope you learn from the mistakes made and YES a 14 year old car can last forever...anyhthing will IF you take care of it, so I look forward to many many more years with it!

Live and learn....I'm going to go snuggle up with my cat and watch t.v.

OK Whut? You just don't get it do you. You state that you do not pay your mortgage to HomEq. Why are you on this site? You don't belong here if you are not a victim of HomEq. Furthermore if you do not pay your mortgage to a company such as HomEq then you have no idea what we are talking about. YOU have no idea how they lie cheat and steal homes. Therefore you have no business commenting about that which you know nothing about. Many of us on this site DID NOT miss a payment. HomEq lied and stoled from us. We would have had our payments caught up if it would not have been for their lies and failure to submitt our payments. Just because you know someone that spends their money on foolish things and not pay their mortgage does NOT mean that anyone of us does this. Many of us had the money to pay our mortgages to HomEq. The money was in my account when I submitted my payments. They are LIARS and THEIVES. So you need to get off this site if you have not had to deal with the likes of them. I still firmly believe that you DO work for HomEq, but just by the off chance that you don't then you would not know what we have been through with the morons that work for them. Most of us know the right thing to do. What to send them, where to send them, how to send them. It makes no difference what we do right they are going to find a deceitful way to make sure that they can charge us late fees and/or take our homes. So miss/mr know it all, WE do not wish to hear about your 14 year old car or you years worth of mortgage payments that you say you have saved. We are NOT irresponsible. We are dealing with a company that is irresponsible. So if you know nothing about HomEq then WE all suggest that you go elsewhere and do not give us your speeches any longer about the "responsible" thing to do. Many of us here have been doing the "responsible" things for more years than you are old. While you are judging US and criticizing US and you say you do not work for HomEq or do not make your mortgage payments to HomEq then you know NOTHING about this. You know that 14 year old car will not last forever. At some point you will have to replace it. So all I can say is that we have no need for you here. You had just better hope that no one such as the likes of HomEq ever does get a hold of your mortgage. I hear CNN has caught on.

1) You had the same opportunities as everyone else to research what would happen with missed payments on a mortgage loan, or any loan for that matter it is a disaster waiting to happen, part of my learning was from watching friends that skipped payments to buy something else just "knowing they could catch up"

2) Time and patience go a long way, there were a million other homes I WANTED but waited until I WAS SECURE enough to buy something I knew I could always afford, which IS NOT the same as what I wanted....but livable

3) Yes I would be angry if I had repairs done on my car and it broke down after, but I do not wait until something is broke to fix it, I maintain it by nickle and diming parts that COULD go bad to keep it in good running condition the same as I do my home

4) I do not work for a mortgage company, lender or any form of home sales servicing in any way shape or form and do make my monthly payments to HomEq

5) I do however follow the terms of my FIXED RATE loan I shopped for and held out to get

6) I too could be in the same shoes as many of you that may have lost a job, gotten ill and could not afford payments and I do feel bad for anyone that has, but should I ever lose my job I would shovel crap for a living to save my home and not blame the company I owe money to for my woes

Modifications

I have the exact situation behind 4 months and being told i cant afford mortgage and do a short sale. I will say i personally spoke to Mr. Becher 2x's and according to him they started offering modifications since August BUT you must be near your adjustment date...You are supposed to receive a nofiication 45 days prior to your adjustment and then the process to modify you to the teaser rate fixed for 30 years is supposed to begin. But you have to be on time with your previous 6 payments, meaning no lates for 6 month prior to adustment. They dont run a credit report just a look at your history with Homeq. The bad news is i was in touch with someone that said they started the process and it can take months to get the modification done, they started in July and as of 2 weeks ago nothing yet. But all the information given i got when i spoke to Mr. Becher. This does me no good since i dont adjust until august and theres no guarantee the process will be done in time....My husband and i have decided to do a short sale. We tried for months to work something amacible out with Homeq but they dont offer any choices. I too asked about who the Note holder is (Wells Fargo) but when i get in touch with them they have nothing on me or my husband. I believe since these loans are in vast pools theres really no way to get anywhere with speaking to a note holder. Homeq really has nothing to lose when you are foreclosed on they only have servicing rights so they lose that business and not much else. The powers that be are worrying more about bailing out the rich then the middle class as usual. Just remember everyone in a short sale or deed in lieu of foreclosure all at which are better than a complete foreclosure, remember if there is a shortfall between what you owe and what the property sells for, you will get 1099'd for that difference. There is a Mortgage Debt Relief Act that passed congress to keep people from having to claim phantom income on line 21 of there taxes, but it still has to pass the senate, which i have not gotten info on when it will go to vote there. But, in conclusion if it doesnt pass in time for most of you here and you want to do a short sale, you can avoid the penaltly if you lived in your home for more than 2 years or declare bankrupty.

we send your inforamtion to the governor office but you also have to do it, and contact and explain him the situation maybe these can be something can help you... nobody can help, HUD, self help, we tried and we also are in the same situation we apply for bankrupcy and we have a attorney we send you opinion to our attorney and let see what happens... but it is the same as us the only way is bankrupcy and paid your payments to the court...Homeq can not do nothing about it your payments go to Fresno so my fair opinion is go to bankcrupcy...

The whole problem is that we all know what to do and when we need to send something to this evil company, the fact is that we all know it does not matter that we do the right thing. The morons at HomEq know exactly what they are doing. The fact is that they are not on the up and up. Even when we do make our payments on time they don't post them on time. Whut?

says she drives a 14 year old car. I'm sure she has to have it worked on from time to time. What if she had problems with her brakes and took it to the mechanic and he told HER he replaced the brakes and charged her for it. The next thing you know she comes to a stop sign and can't stop. GEE!!! Do you think Whut? would be a little upset? Whut? paid for it and didn't get it. Well we all know that we try to do the right thing and yet Whut? will always talk DOWN to us. Whut? saved a whole years payments. You think Whut lives in a shack? One of these days Whut? could be out of a job too and we can all only hope that Whut will think back and realize that it was due to his/her own lies and deceits that got him/her there. We can only hope this will happen. It is deceitful companies like HomEq that are causing the housing market to plumet. Along with the jobs of real estate agents and brokers and many other jobs that are affected by these mortgage servicing frauds and predatory lenders. Keep up the fight and also see msfraud.org. There is a lot of useful information on there.

Just remember that Whut? works for HomEq and she/he is not on our side and don't let them make you feel like it's your fault. We all know the truth. And in the end the truth will prevail. People need to remember buying a house is not a "pass" to a greater life style and credit galore, you have to be able to follow the terms of the loan you agreed to!

I researched every aspect before buying a home and made sure I had at least a years worth of mortgage payments in saved in an account before buying, I do not make a whole lot of money and it took until I was 40 to buy a home, I drive a 14 year old car and have never been "tempted" to borrower against the equity of my home.

Hi I'm also going throught the samething with this company. I have filed

bankruptcy and still looks like I'm going to lose my home.

It looks like no one cares about the way this company is stealing our homes

and running our credit.

I think if you check it out you will find that homeeq is qwn by Well Fargo and since

I filed bankruptcy has change its name to Barclay Reale State.

3 Things everyone on here needs to do

Three things everyone needs to do. First of all STAY OFF THE PHONE! Do not trust anything they say on the phone. Unless you tell them you are recording them do not talk to them by phone. All you get are lies. You need to get everything you can in writing. Which leads to the next thing you need to do. You can ask for any information in the form of a "Qualified Written Request". You can google this to find out the proper format. According to RESPA laws they have 20 business days to acknowledge your letter and 60 business days to answer your demands. In the letter you can demand things such as a history of your payment, or anything else regarding your account. Make sure to send it certified with return receipt request. In fact, you should send all correspondence including your payments certified.
If they offer you a repayment plan you need to get the details in writing. Do NOT trust anything over the phone. You may need the paper trail. That's why you must get EVERYTHING in writing. NEVER do Western Union or any check by phone or internet payments. The Qualified Written Requests are VERY important. Everyone should write to them.
Third, everyone on here needs to file a complaint with their Attorney General. The more everyone complains the more it will be looked into.
The QWR letter is VERY important. If everyone would write one it would certainly give them the run around. They can be fined for not answering them. One person writing to them is not enough. If they get letters from all of us on this site it would be of great benefit for all of us going through the nightmare with HomEq.
Check out msfraud.org. They have a lot of good advice and suggestions.

Just remember: Qualified Written Request, (any correspondence certified) Everything in writing (for paper trail) and write your Attorney General.

As you well know Homeq are nothing but a bunch of liars. In the process of trying to get false reporting to the credit bureau fixed - I ran into all their lies.

I contact the CEO and Chief Financial Officer of Homeq:

Bob.diamond@barclayscapital.com - CEO (the own Homeq)

They can do modifications as of sometime last week. I have been offered one, however have not taken it as I am not behind on my payments.

I would email them and ask them why you are being told that they can not modify your loan. Also post on msfraud.com. You may get some help there also.
