The following is the current activity with Homeq servicing and my mortgage. The first issue is concerning my escrow account. my account was initially sold to them from another Mortgage Company on 6-26-03. Then on 01-15-04 they took $904.00 out of my checking account for a hazard ins. disbursement. I had already paid for my homeowners insurance through my insurance company, so this money was taken out without my authorization.

I first called homeq in regards to this matter and spoke with a rep. She transferred me to the Insurance department where I spoke with another rep. she stated that I would have to notify my insurance agent and have her speak with a homeq supervisor. I notified my insurance agent she faxed this info to homeq. Homeq told me it would take two weeks to cancel the hazard insurance plan and reannualze the account. This should have never happened considering they had received information from my agent before they deducted monies from my account.

The second complaint with this company is that I inquired about an escrow account over the phone when I talked to a rep. she stated she would send me the paper work so I could enroll for escrow. I received these papers dated 10-19-04 I never signed up for escrow but on 11-15-04 they withdrew 780.81 from my checking account. When the payment was only 595.00 once again they have withdraw money from my account without my authorization. When I called in regards to this deduction they stated I had requested to have an escrow. I notified them I had not asked for an escrow and I still have the unsigned papers for the escrow account.

She went on to tell me that, they received information from my county tax office that they were going to attach themselves to my property. And to protect their interest in the home they had to pay the taxes and bill me for it based on some papers I signed. I have never signed any papers with homeq because my loan was sold to them. So I contacted my lawyer and he sent them a letter, they never refunded me my monies and are still billing me for this escrow I never asked for. And homeq has been sending all my information to an unknown address. This address does not exist and my home is 6 hours away from Memphis, TN. I spoke with customer service rep and had him to change this information. No one could tell me why or who this information belonged too.

I have had nothing but trouble with this company since my mortgage was sold to them. Now I have received a letter received stating I was in default on my loan. This letter was issued, due to a mistake by a customer service representative. When I called in to homeq at the beginning of the month, to verify that they had received a payment; I was told by one of their reps that my payment of $800.71 had not been received. I then told the rep that I wanted to make a payment for the month of March. He then stated that I had money in a suspense account that totaled 569.00, and that I would only need to pay 244.00 instead of the full payment of 781.80 for my March payment. So this transaction took place and then I received the foreclosure letter.

When I called homeq collection dept. On 3-26-05 the rep observed the mistake that was made on their behalf and stated that when I called in at the beginning of the month I should have paid 781.80 and 244.00, because the money in suspense was for a payment made in January. I was then instructed to call customer service dept. On 3-28-05 and speak with supervisor. I called on 3-28-05 and spoke with rep, whom might I add was not a supervisor, and would not let me speak to a supervisor. She wanted me to tell her the situation and she would relay message to a supervisor. Once the story was repeated for the umteenth time, I was then transferred to a financial department only to repeat the story again.

The financial advisor wanted to set up a payment plan for 1131.13 a month. I told him there is no way i could afford that payment. The conversation continued and the advisor stated that with my financial budget i would have a surplus of 749.00 a month and I could make the payment. I then stated to him that they basically want me to live off of 300.00 some odd dollars a month. He stated well yes! This is just an outrage and I am tired of suffering from their mistakes. I have filed two complaints with the better business bureau and with the federal trade commission. both are still workig on my complaints, as well as my attorney. I wish they would sell my loan to someone else.
