I was sued last year by Howard Lee Schiff, P.C. for an old  Discover credit card bill the bill already passed the status of limitation, but they still took me to court for it. When I went to court they told me to make a monthly payment to them. I made several monthly payment to them already. but I am feeling very unconfortable with their practice, and how they used the court system in Connecticut to sue consumers for old credit card bills.

I am reporting them because  I dont think they should have the right to do this to people. They are repping off people and no one is able to stop them. When I call them they are always so rude and unpleasant on the phone. I need help to collect enough signatured to file a law suit against them. They need to stop rippinoff people.

The Credit card company should have got off its a*s and filed suit earlier. the statute of limitations is there for a reason. You snooze you loose

Asserting that the debt is past the Statute of Limitations for collections is an afffirmative defense

When you went to court last year, did you actually get in front of a judge or did you settle with the attorney before the trial?

If you got in front of a judge, did you tell the judge that the collector was suing you after the SOL had run? If not, then the attorney for the CA isn't going to mention it.

I am not an attorney by any means, but you can research these things on your own before you go to court or hire an attorney to represent you.

Right now it sounds like the debt collector has a judgment against you and judgments run on an entirely different timeline. Check your states statutes for the times that judgments apply - usually 10 years or 20 years (more common) and if unpaid, the judgment can be renewed for another 10 or 20 years depending on your state's statutes.

It would be better for you to first find out about the judgment against you and then find out how long it is valid. Then go in and negotiate a payoff. Making a payment on the judgment every once and a while is not good for you or your credit. Bite the bullet and negotiate the payoff and settle in full. Once the judgment is paid, make sure the creditor records a satisfaction so this debt doesn't come back to bite you down the road.

"They" are ripping people off??? Exactly what do you think YOU did to the credit card company??? They went after you because YOU ripped off their client by being a deadbeat, plain and simple. However, in typical serial deadbeat mentality, it's all their fault, isn't it?
