I have been fighting for my home where the 2nd lender illegally obtained a relief of stay from my Chapter 13 Bankruptcy case by filing a fraudulant default of payment claim. My attorney intentionally did not show up causing the default even though I complied toall requirements required by the bk court. This resulted to my home being sold to these scumbags Hphc Properties LLC.
Hphc Properties was able to obtain the 2nd trust deed discounted from $120,000 down to $60,000 and has never paid the first lender during the past 11 months. I have had to fight an unlawful detainer action with no attorney, to no avail. Hphc properties decided to take upom themselves to destroy all of the contents of my home... from oak furniture to pouring oil on my clothing and stealing anything of carry value.
I informed them that I wanted to retieve my personal items as required and allowed by california civil code 265 in which I am allowed to do so under law for 18 days after a unlawful detainer lockout in a foreclosure action.
On the 11th day of the 18 days allowed by law. They sent in their contacted workers and began destroying literally everything I owned in the home I lived in for over 37 years.
This was in retalitation for me defending my home of over 37 years and defending it against the fraud and illegal actions of this company. The reason was to make me so helpless and destitute that I would have nothing left or the will to fight !
They were wrong !
The only thing that stopped them in their tracks was the Police dept.my neighbors and Mayor of the city. This is unbelievable this kind of thing can happen in this country.
This is not the first time they have used these thug tactics and this company needs to be put out of business and I want my home back along with payment and damages for what this company has done to nearly destroy everything in my life.

Attached is an actual photo of the damage to show how bad the responsible parties treated the nearly the entire contents of my home on the February 14, 2011 Valentine Day this happened.
These people are flat out Malicious, with No regard for laws.
How a human being could be this Inhumane to another person is beyond me !

It was previously stated in my complaint that civil code was cc.265. that is a typo error.
*** The California Civil Code is actually California Civil Code 1965.
****California Civil Code1965 states that the Tenant has 18 days after the Unlawful Detainer lockout to reclaim personal belongings when he requests at the time of the lock out the intent to reclaim the personal belongings. Furthermore if the items are presumably abandoned the landlord must attempt to make reasonable effort to contact the former tenant andstore the personal items when the value exceeds over $300.
