I have a serious issue with H & R Block. We had our taxes done at two of their offices in 2015. The first office’s return showed we owed the Federal Government $3500.00 which shocked me no end. Without any help from H&R Block I found there was an error in our insurance coverage which led to major penalties. After almost a year I got the corrected information from our insurance company we went to the second H&R Block office which corrected the insurance error only to inform me that we now owed the IRS over $13,000.00. Upon receiving this information I was scared and went on line and found Federal Tax Resolution and signed a contract for $3500.00 to have them see if there was anything they could help me with as in reduction or a payment plan.

Federal Tax Resolution referred me to a CPA in Tucson who discovered H & R Block had wrongly included a W4 form showing Sheila had earned money from a Company that I had worked for but she had not.  That error was the reason for the huge increase we supposedly owed the IRS. When the independent CPA completed the amended return showing the errors made by H & R Block a refund due us for over $1300.00 from the IRS and over $250.00 from the State of California. Then he took the information back to H & R Block and allowed them to make the corrections for a turnaround of over $14,000.00.

H & R Block refunded me the costs of the two office visits but not the $2650.00 I had to pay Federal Tax Resolution, the third party I had to pay to have H&R Block’s errors corrected. Accordingly, I made a formal complaint to the Arizona State Attorneys General regarding H&B Block’s refusal to reimburse me for the third parties fee. I just received a letter from the State Attorneys General stating that my complaint was “frivolous”. Really? $2650 and over two year’s worth of headaches is frivolous? Now who do I cojntact for help with H&R Block?

When the AG of the state of AZ says your complaint was frivolous, perhaps that should cause you to step back and think about that for a bit.

The AG is going to be concerned if they are doing anything illegal or fraudlent. H&R Block made a mistake..bad yes but illegal or fraudlent...Nothing you have stated here shows that. They refunded the fees they charged you and it appears that once the mistake was discovered they were the ones who refiled the amended return, presumably not charging you for that either.

You ask who you can contact. If you still think you are entitled to a refund of the 3rd party fees then you need to file suit against them if they refuse to pay. For the amount you could handle it in Small Claims court, if you want an attorney to handle it I am sure you could find an attorney as long as you pay them a $3000-$4000 retainer up front.

However, in court the judge is going to ask you what grounds you think you are entitled to a refund. What was the agreement you had with H&R Block? Does the agreement state you are entitled to refund of such fees? Did you give them a chance to "fix" the mistake first? Was it negligence or an intentional mistake? If you can't convince a judge that you are legally entitled to a refund you aren't going to get one.

If it really was just as simple name being switched that caused all of this, I would actually wonder why that cost you over $2600 to find this out.
