I had fallen behind in my monthly payments on a vehicle loan with HSBC. I had made payment arrangements to bring the account current on 1/12/07 and 2/15/07, by phone with Cecil. I authorized payments to be deducted on these days, but they set up the first payment to be withdrawn from my account on 1/5/07 instead. This caused my account to be charged nine overdrafts. As soon as I discovered what had happened (on 1/8/07), I immediately contacted Cecil and advised him what had taken place.

I also talked with someone who was over him and was told that I was, basically, a liar. I asked if they recorded the conversations, as their recorded message says when you call. They told me that they were randomly selected and would not accomodate my request to see if it was recorded and confirm what I had told Cecil. I was then told that I could ask for the payment and my overdrafts to be returned, in which they would overnight a check to me on 1/11/07, but I had to set up a payment that day. Since 1/15/07 would be a holiday, I asked for the payment to be dated on 1/16/07 to allow for their check to be credited to my account.

They agreed, but asked for an Unauthorized Affidavit and transaction history from my bank. I went to a local brank at US Bank and asked for this information. I, then, discovered that the Unauthorized Affidavit is for internal bank use only and I could only file an ACH dispute, which I did. I faxed a copy of the form completed by the brank for the ACH dispute and the transaction history, as requested. After 1/11/07 came and went, I immediately phoned Laurie McElveen (a manager that I was told to follow up with) and left several messages.

I never received a phone call back and finally just talked with someone esle that answered. I was then given to Kaylun Mosley, who advised that a check was going to be issued, but it was going through the normal processes in the "clerical" department. After many days and many, many phone calls, I was told that a check was issued, but being held for release on 1/23/07 by Kaylun. He told me that they usually do this in case there are more overdrafts and suggested that I send a current transaction history to show that I have a positive balance and no other overdrafts had been charged.

I did so and immediately called Kaylun back to advise what I had done. I called everyday after that, but never received any calls back. On 1/26/07, I received a check from HSBC for the amount of my payment taken early on 1/5/07. On 1/27/07 at approximately 7:30 AM, I awoke to a knock at the door. It was Alcar Reposession, who had already "snatched" the vehicle. He asked for the keys, but never provided any paperwork or business card. His "snatch" truck and my vehicle were sitting in the middle of my street. My husband asked to remove his personal belongings, but the very large man just laughed and said, "Too bad, we are not open until Monday".

My husband asked several times again and the man proceeded to walk into the street laughing hysterically. He, then, jumped into his truck and sped off of my street, hitting the curb on his way out. The vehicle was not put on the truck straight, so the front wheels were being dragged and squealing. I immediately called HSBC to advise there had been a horrible mistake and they basically told me I was wrong and out of luck. Upon leaving my house for my son's basketball game, I discovered that the "repo man" had scratched my other brand new vehicle sitting close to the vehicled repoed. I also found the location of Alcar and discovered that he had wrecked the front driver side of the vehicle repoed.

I plan to go to Alcar on Monday and take care of business. My work has just begun!!
