We were approached by our Mortgage giant Indy Mac in July of 2008 with a loan modification. My wife and I currently had this home for sale, but with the loan modification, we chose to pull the home off of the market and sell my wife's home. Since we had 7 children together, this property was larger, and the payment was now affordable, we chose to retain this loan and property with Indy Mac based on the modification agreement that was signed, sent, faxed and documented as received by Indy Mac. In August of 2008, we contacted Indy Mac to see what we should do next and where our formal documents were as they were promised to us after receipt of our sign off.
We were told to make three payments of xxxx amount in order to finalize this new modification arrangment. We did this. We were also told to call again next month and we did this too. After being passed around multiple times and told this was a "new" process, all of the kinks hadn't been worked out yet, I was told the documentation that I had signed and sent, faxed AND federal expressed was never received. We have proof of receipt from the fax as well as the federal express slip. They now stated they were not able to help us as we didn't comply by their deadlines when we had. I had also sent in my three payments (as stated to me was required to finalize this process), so now, if the modification didn't meet timelines, how was this an amount I have paid as I was told?
My wife and I have sent registered, return receipt to The White House, Mr. C. Kent Conine, Mr. Brandon Latman, Attorney General of Texas, Attorney General of Lori Swanson, Mr. Michael Perry, Mr. Richard Wohl, Indy Mac Federal Bank - Austin TX., Indy Mac Federal Bank- Pasadena, CA, FDIC Chairman Sheila Bair, Habitat for Humanity in Minnesota, and multiple Attorneys. We received responses in letter form from the Attorney General's of both Texas and Minnesota both of which stating the modification rebuttal was illegal and that they would be offering assistance. Both of these State Attorney's sent two letters, receiving NO response even when insisting a response was required within 10 days.
This process has been slow and agonizing and now the threat of a Sheriff Sale looms in our presence. Indy Mac has been sold to OneWest bank and we've been told "they (OneWest) do not participate in loan modifications". How can this be? We have signed documentation from IndyMac, is it not illegal to change the rules simply because of a corporate buyout?
We strongly suggest to the people in America in the same situation, to STAY STRONG - DO NOT CAVE to these antics or succomb to their rules. We have all the right to stay in our homes as we have abided by all of their changing rules along the way.
