Instance credit auto mart in Fairview heights il My fiance hasn't had his car for 2wks an the transmission has blew up. The belt is going to break. The shocks an struts are on there way breaking. The power steering is messing up. They refuse to give him a replacement car. An they are charging him dang near 20,000 dollars for this car. None of this seems legal could someone please help us! To whom it may concern my fiance bought a used Chevy Impala from instacredit auto mart In ofallon Illinois 10 days ago. Already the transmission blew up on him today. But he went up there a few days after he bought the car because the shocks an struts weren't right. The belt was making a loud noise. An so was the power steering. They told him that they weren't going to fix anything. Also the brakes are bad to. They told him he is on his own. He hasn't he had the car for 2wks. They told him they are not giving him a replacement vehicle. Since the car blew up on him today. But they said he has to pay his car note even though he is not able to drive it. The car has a 110,000 miles on it. An they are charging him dang near 20,000 dollars for it.

No there is a warranty which is why iam so brwildered by how they are treating him. An it is a leased vehicle. That he hasn't even had for 2wks yet. They were eager to take his money. But not eager to fix what is wrong. They clearly knew that there was something wrong with the vehicle befor they leased it out. So they had already breached the contract. An he is not my boyfriend but my fiance. An I have the ring to prove it. An his brain doesn't function as well as u an i does. His understanding is not like ours. It is a little slower. An I believe they knew that an took advantage of the situation. He can't read an comprehend like u or me. So he wouldn't of known what he was signing or reading. They locked him into hellaish deal. An it is not fair. They took advantage of a hardworking person. An this isn't the first time they have done this to people. An if he still has to pay his car note. Then why can't he get a replacement vehicle while they are trying to figure out what is wrong with his car. Since his car blew up an is not driveable. No it was not bought as is. He has a warranty on it. But the sad thing is it hasn't even been 2wks yet. U as a consumer should know better. An why can't he have a replacement vehicle while they figure out what is wrong with the vehicle that he had. They expect him to still give them money while he has no vehicle. Have u ever heard of implied warranties for a used vehicle. An to answer your other questions. Why did he chose that car. Because his understanding is not like u or i. He is off a little a bit. A little slower than the average person. So i don't believe he fully understood what he was doing. An insta credit in O'fallon Illinois took advantage of that. Thank u Deonta in Belleville illinois

Why would he pay $20,000 for a Chevy Impala with 110,000 miles on it? That makes no sense at all.
But to get to your question about paying for the car loan and the repair: yes. Those two items are totally separate. I don't work for this dealership or the lender, but I am familiar with how loans work. When you borrow money to buy a vehicle, the payment is due according to the note he signed. This doesn't change if the vehicle needs maintenance or repairs.
Most of the time used vehicles are sold AS IS. Take a look at the contract. The buyer is responsible for maintaining and repairing the vehicle at his expenses. To expect the lender to accept a late payment or a reduced payment due to vehicle repair expenses is unreasonable. One has nothing to do with the other.
By the way, why would you expect a replacement vehicle just because this vehicle he purchased needs repair? That is totally out of line. When you buy a vehicle, it's yours. Your vehicle, your maintenance, your repairs and your payments. If you don't want it, then pay it off and sell it so you can buy one you want.

If boyfriend bought the car "As Is" there is no free warranty service. At the time of sale, did boyfriend READ the papers he was signing? One of those was the disclosure statement which very clearly told him if a warranty was included or if it was an "As Is" purchase. If it was "As Is", he is responsible for all repairs. Again, this was very clearly noted in the disclosure statement which I suspect he didn't even read. How smart! I certainly hope nobody was hurt during the explosion.
