Investment Retrievers is in violation of the Fair Debt Collections Practices Act. I do not owe any debt to them. Yet, I have been receiving phone calls and letters addressed to another person at my home and cell phones. The letters have the name of the debtor but at my address. My cell phone is being called but asking for the debtor, who is not me.

While I have now been pleasant and requested such behavior cease and desist, I have tape recorded Ms. Keisha Williams and others hang up on me and be irrrational debt harrassing employees.

Today I filled complaints with my state (NY) attorney general's office; LA State Attorney General, CA State Attorney General; with the FTC (FTC.gov); the better business bureaus of the three states and written formal letters complaining of their violations of the FDCPA addressed to both the PO Box in Lousisana and their corporate offices in California.

I have advised them that pursuant to the Federal law (FDCPA) each violation, for mine it is 3 and counting, they may be liable for $1,000 per violation. Apparently, after speaking with the debtor they are harrassing her as well now at her home and again each violation $1,000.

Later this week, I intend to see which Small Claims Court I can bring an action in to recover this money resulting in their violations.

Hi. My name is Sandy. I am currently an EMT student from Texas, and like yourself, I have received some calls in the past for debtors looking for money that I did NOT owe them. Or for debts that I had already paid, and the phone reps were calling to get me to pay the same bill twice ! WOW ! ! I am on a somewhat restricted income, because of my tuition, and that of my migraine medicine, whice is NOT cheap by any means. I have learned a few tricks of the trade so to speak of, and I have also learned to "find out for myself" which also gives me the power to know before anyone tells me any lies. Whicj several people have. For instance... health insurance companies will keep you quite comfy and cozy until the day comes that you lose your job (through no foult of your own) and then the insurance company becomes an entangled conversational web to which you cannot get even one simple "yes" or "no" answer from anyone.
My point is this. Know how to back yourself up (your resources) before you ever have a need to use them. Most of my debts are medical. I won't be able to pay any of it off until I finish school. But there are books that I want to mention here.

Sorry but you're mistaken. The FDCPA allows for a statutory maximum of $1000 damages-PER LAWSUIT, not per FDCPA violation. However, you are intitled to real damages; insomnia, ulcers from stress, lower credit scores, and the like.

I hope you sent the letter to them certified, return receipt requested so that you can PROVE they received it. If you didn't, I suggest you send another letter to them, but this time, certified return receipt requested. If they contact you again after they receive the letter, you have them and should sue them.

And how would you know this? Do you know the debtor? That might explain why they are buggin you. This doesn't make their action harmless, but it would explain why they're bothering you.

And again, each violation is NOT $1000. Read the FDCPA for yourself.

I would suggest you sue them in District Court because the FDCPA does allow you to get reasonable attorney fees in addition to actual and statutory damages. Small claims court cannot grant attorney fees and the recovery limit is only $5000.
