Jay Enterprises, Inc Dirty company fails to honor refund false statements

I bid for a Honda Prelude that was to be sold by Jay Enterprises of Oxford, MS. I lost the bid war at the last minute, and contacted Mr. Fuad at Jay Enterprises to express my interest in buying the car if the winning bidder fell through. Fuad informed me that the winning bidder had until the next afternoon (April 13, 2001) to get them 100% payment, or the car would be sold to me. April 13 came, and with no word from the other bidder, Fuad told me I could buy the car.

The following Monday, Fuad contacted me again and confirmed that I could buy the car, and advised me to get a loan and next-day mail them the check. I got off work early and did just that. Only about 30 minutes after mailing the check, Jay (the owner of Jay Enterprises) called me and said the original bidder was on his way to pick up the car. I told Jay that since the bidder didn't meet the set deadline and I had already sent payment, the car should be mine. He said ok.
The next day Fuad called me and told me they sold the other bidder the car. I was nice about it and asked only for them to share in my expenses of getting the loan, and next-day mailing the cashier's check. Both Fuad and Jay agreed. Jay also told my loan officer that they would mail me a check since it was their mistake. They since have refused to do so. I filed a complaint with the BBB, but Jay Enterprises made many false statements that seem to be dragging the process out. I just want them to honor their promise.
