J.C. Penny JC Penny Won't Honor Insurance Policy on Earrings for My 6-Year Old Daughter Garden City, New York

When my mother took out an insurance policy on the opal earrings she purchased for my 6-year-old daughter for her birthday last year, she believed that the earrings would be fixed or replaced if they were defective or damaged -- at least that's what she was told by the salesman.  Fast forward a year later and one of the earrings got lost due to a defective back.  The other back also fell off, but my daughter didn't lose the earring -- her mother replaced the back.  

JC Penny's refused to honor the return policy, stating that the earring was lost, not damaged.  The point that was lost on the JC Penny's manager was that the earring got lost because it was damaged.  Both backs fell off, which shouldn't happen.  My 6-year-old was distraught over the loss of the earring and cried on and off for hours.  The manager was defensive and blamed my daughter, then her mother, for not sending the earrings back after the first back fell off.  

It would have been very easy for JC Penny's to do the right thing and honor their insurance policy, but they instead refused to budge.  THey did offer to refund the price of the insurance policy, but that's like offering someone their health insurance premiums back after they've had a heart attack.  I'm never shopping there again and they've lost my mother as well.
