MILLIONS OF PEOPLE HAVE PURCHASED A GEMSTONE THAT IS A FRAUD

I am writing on behalf of a Nationwide Group that is attempting to alert purchasers, and stop many Retailers and Television Shopping Channels from selling a heavily marketed gemstone. In particular, Jewelry Television.

The misrepresentation involves a gemstone called Andesine, or Andesine-Labradorite. It has been marketing since 2002 as Rare, Natural, and Untreated. Recently, it was proven that the stone is a common variety of the Feldspar Group and it goes through a rigorous coloring process. The exact process is still being investigated. That process is now fading - literally.

These companies have sold millions to date. It has been said many times that they are rare and valuable....this is not the case. The statements have caused many to purchase in hopes of a return on their investment. In additon, many may have purchased beyond their ability due to the constant comparisons to other valuable gemstones (i.e. Tanzanite and Paraiba Tourmaline).

There is quite a bit of information on this issue, and we would appreciate the opportunity to provide it to you.

I am not a kid in a candy store. But am a citizen who expects JTV and other companies to abide by the law and if they don't they should be held accountable.
I purchased numerous andesine LAB from JTV after researching the stone and its value. I believed JTV when they stated that they themselves had tested this stone and found it to be natural even discussing in great detail the make up of the stone and what made it different from regular andesine, sunstone and LAB.
When the stone stopped JTV numerous times and was told that they were unsure as to why it was not being sold. Finally in Nov. 2008 I was told that the stones I purchased may be treated but they are not sure. I was told that I could have a refund only with my reciepts...After 30 days I disposed of the reciepts because you cannot return or exchange after that. I don't like clutter. JTV does send purchase histories upon request so I asked if I could get that and use it for my refund, I was told no. Furthermore, I am surprised that no one has taken a suit against them for not admitting or advertising when their diamonds are commercial grade. I have called and asked if an item contained commercial grade diamonds and on occasion have been told no and other times told that they cannot say because the stones were not graded. It is the law to advertise this information. I made the mistake of buying a bracelet after the host stated that it contained top diamonds. I asked upon ordering and was told that they didn't know because they don't grade them. But the host "graded" them with her statements about them. I took the risk and lost the Shipping and handling to get it and find diamonds that looked like opals they were so milky and chipped with black carbon throughout. I also lost the money to send it back for a refund. My point is that it is their responsibility to inform their customers. I can't lie I have purchased some nice items from them but no great values. Also it was JTV's responsibility to let their customers know when this happened and they did not advertise the problem they even concealed it.

This is the type of business practice can affect the whole jewelry economy in a negative way. Theft in any manner be it through false advertisement a misdemeanor also amounts to a felony here in NC called Recieving goods(money) under false pretense; eventually costs consumers. Furthermore, any type of theft is just wrong, JTV is no better than the man in the parking lot with a gun who takes your money at gunpoint. THEFT IS THEFT...
The shippng cost for them is about 1.00 to 2.00 but they charge much more, so even if you don't keep the item you purchase they have still made money. Imagine 100,000 customers returning their items the for example only, lets say it cost 2.00 to ship and they don't insure the items I have asked, so if you pay 7.95 S/H, for the ease of math let's say 8.00 even. JTV has earned 6.00 for each of those returns. That's 600,000 dollars!!! And they still have their product to resale again and again.

The hosts are also guilty of stating that they have seen similar items selling for example for 6500.00 and their final price is 600.00. By law they are required to tell where they saw this price if they use it as a comparison price!!!

There has also been numerous problems with coupon advertising and hosts not disclosing the full information about coupons and discounts which is by the way also a matter of false advertisement and bait n switch!!!

I could go on and on about their problems but I won't I am going to seek monies from the class action suits because I could not get a refund.

Thank you for your time. I just could not let go of the attitude of some that this is just some consumer mistake of not being mature shoppers. There are laws to protect even the most mature consumer from companies who would otherwise take full advantage of uneducated shoppers and the most informed shopper alike. As JTV did, thank goodness our country is protecting us and making them responsible for their immature actions. The consumers are not to BLAME!

that web site is how im learned about the and/lab.
however after calling jtv they gave me a full refund of my cost for all of the and/lab i bought over a year ago. so i see no reason to recrute people without first telling them to first call jtv and then if jtv wont refund there money then join the suit. but dont tell everyone that they wont get there money back without trying first. i think the lawsuit is nothing more then people trying to get back more money then they paid. basicly trying to get jtv to pay what they thought they would get for the gem later on down the road.
so basicly a bunch of greedy people.
its an investment. not a get rich game. you buy a gem and years down the road you might get more then you payed for it. so invest like a mature adult. not like a child in a candy store.
