I purchased a car from Tempo Auto Sales, financed through JMAC Finance. They are one and the same company. JMAC is comprised of six or so women located in a room at one of the lots in Dickson, TN. I purchased this car in April, and made the required weekly payments on time, usually well in advance. As part of the Buyers Guide, they agreed to repair the window and air conditioner. To date, this still hasn't been done.

I recently had some financial difficulty and could not make my insurance payment and as a result my insurance lapsed for a short period of time. After paying my insurance and it being reinstated, Wendy at JMAC finance issued a reposession order. I attempted to straighten this out with JMAC, but every phone conversation with them began with one or more of the women there cursing at me, using a defamatory tone, basically being as uncooperative and insulting as possible.

So now that I have all of my records up to date, insurance paid, payments made, etc., JMAC is unwilling to release my car. Their position is that I defaulted on my contract, therefore everything I have paid until now has been forfeited and the ownership of the vehicle reverts to JMAC. The illegal aspect of this is that there is nothing whatsoever in the contract stating that they will/may reposses the car if I do not have insurance.

They prey on people with poor credit and use the fact that their customers can't afford an attorney to bully them into giving up their vehicle. Which they will then sell to someone else and the cycle begins all over again.

This company failed to fulfill their obligation to repair the car I bought, and instead of doing this, they repossesed the car and will now attempt to nullify any rights I have to the car.

well Jason i know how you feel they have just done the same thing to me. only i got away with the insurance problem cause they couldn't locate my car and well i got insurance out of state for my car and had that problem.
But now its all because i was a few weeks late on my payment and they actually had a tow truck company harass me and my family and follow our every move just to try and locate my car.
They found it and took it will all my belongings in it and will not tell me where they took it to so i can clean all my things out of it. I am seeking advise if you have any let me know.. appreciate it.

Jason,

Here is what I wrote:

"ALL in house financing requires continuous full coverage on the collateral".

I never said they could repo it. However you were in default by not keeping the required insurance.

I'm sure if you read the default section of the contract you will see more info there. Technically, they can LEGALLY repo on any default of any term of the contract, whether they specify repo or not.

After all, default is default. Did they buy insurance for you and charge you for it? Did you refuse to pay this amount?

Here is the actual text of the contract in the section titled "insurance":

"you agree to buy property insurance on the property protecting against loss and physical damage. You will keep insurance in full force and effect until this contract is paid in full.
If you fail to obtain or maintain this insurance, or name us as loss payee, we may obtain insurance to protect our interest in the property. This insurance may include coverages not required of you. We will add the premium for this insurance to the amount you owe us. Any amount we pay will be due immidiately. This amount will earn finance charges.

This is the relevant section and relevant information in the contract. Nowhere does it state that if I do not keep insurance I will be in default, or that they will repo the car if I fail to keep insurance. It only states that if I don't get insurance, that they will and make me pay for it.

Jason,

ALL in house financing requires continuous full coverage on the collateral.

Read it again, or better yet, go there in person and have them show you.

After all, if you are legally entitled to the car, you have keys, right? Go pick it up!
