Be careful when you are contacted by JOHNSON & PHAM, LLP

Their business model is based on legal intimidation and the fact that if you are sued by them and completely ignore their letters or their intimidation attempts via telephone or email, you are still liable to pay what they sue you for. DON'T ignore them or else they will sue you and in your abscense, you will lose and be liable for whatever they ask for in court. 

They will allege that something you have sold or are actively selling is counterfeit. They have to prove this in court. If you are selling a product they represent, they might send these to all the sellers selling the products in order to stop the sellers from selling them and gaining share of the market. Most, if not all, of these sellers sell original, branded and legitimate products, but are scared off by letters threatening major costs, legal fees and such. It is a very effective tactic used against people who fear the legal system. Yes, the legal system can be misused, but it is also there to protect you, especially if you have done nothing wrong. 

Their one major win was against a seller who imported Chinese counterfeit items and sold them by the thousands. After that, they target sellers who sell the legitimate items at discounted prices, bought from online or physical retailers such as Walmart, Target and such. If you are one of these sellers, do not panic. If you are selling legitimate, non-counterfeit items you are protected by law to do so. There is no law that protects these fear tactics. 

Before you are tempted to provide them with all they ask for and pay their outrageous claims, consider this: if you are selling non-counterfeit items that you bought legitimately, you are protected by law. Don't be fooled by their claims. You are protected by law. 

However, due to a loophole, if they sue you and you do nothing about it, you are liable for what you are sued about. Be confident, this law firm does this to enlarge their wallets and gain favor with their clients. They are not doing this out of a legitimate concern for a fair and LEGAL marketplace.

 

I am writing this out of my own experience dealing with them. SEEK HELP and don't give in. The law will protect you.
