K Hovnanian's Four Seasons deceptive acts to seniors buying in this community Beaumont California

My husband and I are purchasing a home from this builder. We went with their financing since they offered an $18,000 incentive towards extras. We were not shown the actual lot (except from afar) when we signed the contract.

We went out to visit the property last month and my husband asked for the schematic (which we had not been given prior to this date). We took that over to the home and thought the yard looked rather small. We only had an original lot size of 12' from the back of the home, upon measuring the back property, they cut off 2' of our yard (which at this small size is 15% of the yard). There is nothing behind us, so they could have easily placed the fence in the proper location and there would not be an issue.

We wanted this location due to the view from the yard overlooking a beautiful mountain and paid a premium for this lot. Also, all other properties in the Landmark developments (name of our model) have adequate rear yards, it seems like they cut back the size of the lot from the previous phase to our phase but still charged us for the land we do not have.

This is one issue. The second issue is the front of the home. There is a deformity on the front lawn from the swale they installed for drainage. It is the most unsightly thing and not another property in the entire complex has such a god awful eyesore. It runs on an angle from the side to the direct center of the front lawn.

The third issue is the fact that we purchased a home that has a casita and a main house. Both on the model and the schematic (which reflects only our home) it shows a plain concrete slab between the main house and the casita making a courtyard. We expected this concrete to be there, instead we have a 3' walk from the main door to the inside door and dirt. They say that "special brick and patios as shown in the models are not included" Which is fine. We saw the model, the rear yard has a brick and concrete special patio, you could tell it was designed special. We do not think the concrete, which is shown on the schematic is special and we think we are being ripped off.

Finally, with the closing the Hovnanian mortgage has not shown us all of our deposits given to K. Hovnanian at Beaumont, LLC, nor do they show the $18,000 incentive on any paperwork as we are preparing to close. I have asked several times for something in black and white showing the additional deposits made equal to about $14,000, as well as the incentive rebate, and they do not reply. After all of the runaround we are very discouraged and disappointed with this builder.

We are warning other people about this experience as it is UNFAIR TO DO THIS TO OUR SENIOR POPULATION. We are demanding these items be repaired and our sales person is unresponsive. They also put a clause into their contract that if closing is held up on the buyer's part we will be charged $250 per day. I don't think the above constitutes our hold-up if the property is in unacceptable condition.
