worked for K&B for less then two weeks had three late loads but proved that two ov then where not my falt. cant drive with out the hours. on 07/27/06 my hours where 71.50 and they said i better delever on time or i would be fired ,so i delevered on time and was still fired .

lied to when i said i wouldnt be charged on a late load and then was Ross thanks he knows everything .oh yea as a company drive isnt illagel for then to charge a drive for fule that they did said feom chanttoga to knoxville was 240 miles. last time i looked it was only 98 miles oh and i have the log books to prove everything.

Some hints for Donald to protect yourself now and in the future

Donald,

I have faced the things you speak of numerous times, and due to that, I have been forced to learn and manipulate both the laws and company policies so they work in my favor.

NEVER operate illegally under threat of being fired. Always make them send it on the qualcomm/mobilemax if you have one, as this is a record that can be subpoena'd. Always just tell that DM/Dispatcher that you will call him/her back when you have the DOT on 3-way so they can repeat that illegal statement.

BTW, it is YOU who gets the ticket for illegal operation, NOT the company or the dispatcher. Flat out refuse at all cost. If you are out of hours and have an accident, and someone dies even if it was not your fault, you have an AUTOMATIC manslaughter charge on you just because you were out of hours when it happened. AND, you lose your CDL.

First of all, get a copy of your DAC/USIS report. You are entitled to place a 100 word statement on it and also to dispute any innacurate record, just like a credit report. You are entitled to 1 free copy each year and/or whenever you are denied employment because of the report.

Second, whenever you are working for anyone in the trucking business OTR, record EVERYTHING on your log. If someone tells you to operate illegally/out of hours, etc. Put the name of that person and time of the request on your log. File an immediate FMCSA complaint against them especially if you lose your job over refusing to operate illegally.

Log books are a semi-permanent record. They must be maintained at your company for 3 years and you can keep your copy indefinitely, as I do.

Also file this complaint with your state labor board, and with unemployment compensation if you were denied.

ok this is an update i worked for K&B for two weeks was let go and now sence i put a report on here there black balling me cause i did is that leggiel to do that i have lost the past three jobs cause of them and i dont thank its right
