I am dealing with Kramer & Frank at this very moment. It is because of a credit card from Capitol One. When I was working paying the capitol one bill was not an issue. I lost my job back in March 2008. So as most of you know who is reporting this company. When your finances change so does your ability to pay your credit card bills.
In July of 2009 I was contacted by Kramer and Frank, told me my account has been turned over to them for collections. I talked to Meridith on the phone and told her I can make 50.00 payments starting in Aug. ( plan was set up with 100% good intent to pay) In September I got sick and had extra medical bills and presciption cost so there was no way I could come up with another 50.00 to pay Kramer & Frank. I was having a hard time just feeding my children.
Oct comes and I get served to appear in court. With out a warning because I missed Septembers payment. wow you got to be kidding me. I called them right after I got the papers and tryed to explain my situation and why I wasn't able to pay. Meridith wasn't in the office so I spoke with a few other people. The first person I spoke too was a rude girl name Heather. Who didn't tell me her name btw. I tried to explain my situation and why I wasn't able to pay. ( I had H1N1 and phamonia, and my kids also got sick... This was when everyone was getting sick ) She didn't seem to care.. I asked about a settlement cost.. She offered me one but there was no way I could pay it all at once. I told her that.. She told me to get alone. The she brings up a personal fact, why did she have this information? The call ended and not on a good note. I then called back to get her name. This next guy is a joke. Rude with a capital R... Jake.. He wouldn't give me her name, and was going on about my account, our conversation ended when I asked to speak to a manager. He hung up on me. I called right back,. click.. disconnected as soon as it answered. ( he hung up again ) I called back again.. Jake again. I asked to speak to a manager again. He was carring on about my account.. I asked several times to speak to a manager, while he was carring on about my account.. I had to yell!! Let me speak to a manager.. He finally connects me to a manager. D. Lawson. She informs me that they told her I was swearing at them. False!! I never did. I asked her for the ladies name that I was talking to a few conversations ago. She did tell me her name. I explained my situation to D. Lawson and was wanting to settle this without going to court. I asked her how Heather got her information. D Lawson didn't know. I also found out that the amount I agreed to pay was different in the system that what I told Meredith I would pay.
A few days later I called back to speak with Meredith... Hoping there can be something done about what had happened on the phone and if something could be done so we didn't have to go to court. Nope; Nothing could be done... I also asked for a validation of debt and she refused to send me one. Stating I need to ask for one in court.
I do not even know if they are a true law firm. So we went to court today and I am now working on a counter claim for the Fair debt collection act.
