My sister and I went into Ladies Premier Fitness here in Middletown with free 30 day trial flyers on February 18th, 2010. We hesitantly agreed to fill out paperwork for a membership, only because we were told by Autumn, the employee who signed us up, that we had three days to CALL AND CANCEL and our cards would not be charged. After some discussion we chose not to activate the membership; my sister CALLED on February 20th, 2010 and told the employee she spoke to that we had decided against joining the gym. She was told that that was fine, everything was taken care of and that our cards would not be charged. I discovered on March 20th that the gym had withdrawn the monthly fee from my checking account. We have called the gym and the billing company (National Fitness) and they are completely unwilling to help us even though we were lied to by two employees about the correct way to cancel our contract; they have told us that in order to cancel your contract during the three day grace period you have to PROVIDE SOMETHING IN WRITING AND THAT A PHONE CALL WAS NOT ENOUGH TO CANCEL YOUR MEMBERSHIP. We made the effort to call and cancel - if we would have been told that we had to provide something in writing we certainly would have done that too. Now, in order to cancel our contract, we have to pay 85% of our yearly contract which amounts to $819.69. This is incredibly frustrating because both my sister and I are students and we cannot afford to pay $820 - we couldn't even afford the $50 monthly fee which is why we decided not to activate our contract.


I realize that we signed a contract, but the fact is we were verbally told one thing while Autumn sat there and wrote something else on the contract. For example, we were verbally told our contract was for 12 months; our contract says it is for 36 months. We were told verbally that the two of us were going to be on a spousal contract and consequently received a discounted rate; we are actually on two separate contracts and now have to pay two separate cancellation fees totaling over $800 a piece. We were told verbally that all we had to do to cancel the contract was call the gym within the first 3 days; in actuality you must provide something in writing.


These people are not honest and their business practices are not ethical in any way, shape or form. Stay away from Premier Fitness and especially any gym that uses National Fitness as their billing company!


I am interested in filing a Class A lawsuit against this company; if anyone else is interested please respond to my posting.

I, too, was once, or apparently still am, a member of the middletown ohio premier fitness. I was told I was entering a one year membership, only to find out afterwards that I was locked into a three year contract. Upon calling the billing company to cancel, I was told I could pay the entire balance then and there, something like $830, and end the payments or pretty much wait it out and upon the end of the three years, I WOULD BE CONTACTED BY PHONE whether I wanted to renew the membership or cancel it. I didn't have 830 dollars to blow so I opted to wait it out. Three years go by...

Three years after that phone call, now 2010, I have forgotten about receiving that phone call (which never came) and went about my daily life. I happened to see a $15 recurring debit on my bank statement recently, which also provided an 800 number. Not remembering anything in the recent weeks that would cause this withdrawal, I called the 800 number, only to find out that, WITHOUT A PHONE CALL OR MY CONSENT, the membership was AUTOMATICALLY renewed!! For 25 months, the gym has taken out $15 of my checking account, each month, religiously. That's $375 as of this day. And to anyone who wants to say, "Well you signed the contract," evidently, YOU have never been a victim of a dishonest company that tells you one thing, and later on, carries out something beyond your control, after telling you that you would have options. So go comment in a forum about world peace and the world being one big, happy dream where everyone is treated fairly and equally.

I am all for a lawsuit. If anyone else cares about making right what is wrong, I'm with you. Rockinkid87@aol.com

Lied to at Miamisburg Premier Fitness

I also was lied to at the signing of my "contract". There was an older man who i talked to. He said he was the owner and he owned several gyms in the west. Also that I could cancel my contract at any point in time. Now I'm stuck for 3 years. I would also like to join in on the law suit. They have plenty of complaints threw the BBB. Hello.
My wife and I have just had a similar experience with Premier Fitness, and it is a devastating amount of money that they scammed us into being obligated to pay.  They misrepresented the contract while rushing my wife through the process, and now we are working with the help of an attorney to break the contract.  Have you had any success in your quest?  Is there litigation still pending, or did you give up the fight?  Please respond so we know where this path might lead us.

I also went to Premier Ladies Fitness in Middletown, and I was lied to multiple times like you.  I talked to a lady named Alisha who told me that the contract was for one year, but it was actually 36 months.  I also made a point to ask about cancellations because I have an old injury that I do not wish to agitate.  I was told that if I was injured, I could cancel my membership without fees if I simply brought in a letter from my doctor stating that I in fact was injured.  Imagine my surprise when I was told after injuring my back that I had to have a "permanent disability" in order to cancel without fees.  It honestly seems like this company just instructs their employees to lie in order to make a sale.  I would be interested in joining your lawsuit if possible.  Please contact me back.  My email is hockeygurli62@yahoo.com

"Pursuant to Ohio Consumer Protection Law, Chapter 1345 of the Ohio Revised Code, you (Premier Fitness) are obligated to release a party from any sales contract initiated by your business if notice is given to you or your agent within three (3) days of the execution of the contract. This notice can be verbal. You are, therefore, in violation of Ohio law as well as Title 15 of the U.S.C.A. enforced by the Federal Trade Commission.

In addition, your employee, while explaining the terms of your contract, engaged in fraudulent representations regarding the terms of said contract. It is well-established law in Ohio that a business owner, manager or employee can all be held liable for the fraudulent representations made by any agent of the business. Your sales staff and employees are considered agents of your business."

This website is here to help people who have been scammed/wronged by a businesss. Clearly, I am not alone. If you have nothing positive or informative to say, then move on.

The problem with this is you were to stupid and ignorant to read something before you put your signature on it. Do you have any idea how legally binding a paper with your signature on it is. If sign it you are bound to it. Always, always, always READ BEFORE SIGNING!

they are taking my money!

I was a member at Premier Ladies Fitness in Middletown. I paid off my 3 year membership I was talked into back in January.  I got on my bank website to look at my statement and yesterday they decided to charge me $15.  This came out of nowhere.


When I had paid off my membership I told them I did not want to renew.  I want my $15 back and for them to not charge me anymore.  If someone does something about these scammers let me know.

 You left me a comment about teaming up to do something about Premier Fitness. I would like to team up and  hope to get a lawyer and sue them. I am only 19 and this has me to already start off wioth bad credit. I can't afford their payments, or to pay them off with my future plans of moving back To Las Vegas. I was misrepresented on their contract and would like to put a stop to their lies and go- arounds with people.I'm not sure how to contact you on here, so contact me if you can if not them my e-mail is (((Redacted)))
